DECLARATION OF CONDITIONS, COVENANTS
AND RESTRICTIONS
This DECLARATION OF CONDITIONS, COVENANTS AND RESTRICTIONS
('Restrictive Covenant) is made this /1-0. day of J - r• I , 2013, (the "Effective
Date) by the City of Arroyo Grande, a municipal corporation (hereinafter referred to as
'Declarant).
WHEREAS, Declarant is the owner of certain real property in the City of Arroyo Grande
more particularly described in Exhibit"A'(the'Property) attached hereto and incorporated
herein by this reference.
NOW THEREFORE, Declarant hereby declares that the Property, and each and every
lot located therein, be held, transferred, conveyed, leased, occupied, or otherwise
disposed of, and used subject to the following conditions, covenants and restrictions,
which shall run with the land, and be binding upon Declarants heirs, successors in
interest, administrators, assigns, lessees, or other occupiers and users of the Property,
or any portion of it. Any conveyance, transfer, sale, or assignment made by Declarant or
any lots within the Property shall be deemed to incorporate by reference, and be subject
to, each of the provisions of this Restrictive Covenant.
1. Development Standards. The Property, and each and every lot located therein,
shall be subject to the following property development standards and restrictions:
A. Minimum Size of Structures: The minimum size for all primary
— residential structures (excluding garages) shall be one thousand six
hundred (1,600) square feet.
B. Roofs: All roofs shall be constructed of concrete, tile or shake
material.
C. Antennae: No visible antennae shall be constructed upon any lot.
D. Fencing: No barbed wire, chain link fencing, hog wire, or other metal
fencing shall be installed along any common boundary line.
E. Parking of Recreational Vehicles: All recreational vehicles, trailers, boats,
campers, and similar vehicles shall be kept and stored behind front or side
building setback lines.
F. Height Limits: The maximum height for all primary residential
structures (including garages) shall be 18 feet, as measured from the
center of the building pad. The maximum height for all accessory
structures shall conform to the standards of the Arroyo Grande Municipal
Code.
2. Reserved Rights. Declarant hereby reserves to itself, and to its personal
representatives, heirs, successors and assigns, all other rights accruing from its
ownership of the Property which are consistent with this Restrictive Covenant.
3. Judicial Enforcement. Enforcement shall be by proceeding at law or in equity,
either to restrain a violation or an attempted violation or by suit to recover
damages against any person or persons violating or attempting to violate any
covenant or restriction contained herein. The City of Arroyo Grande shall have
the authority to enforce the terms and conditions of this Restrictive Covenant.
4. Governing Law. This Restrictive Covenant has been executed and delivered in,
and shall be interpreted, construed and enforced pursuant to and in accordance
with the laws of the State of California.
5. Enforceability. If any term, covenant, condition, or provision of this Restrictive
Covenant is held by a court of competent jurisdiction to be invalid, void, or
unenforceable, the remainder of the provisions hereof shall remain in full force
and effect and shall in no way be affected, impaired or invalidated thereby.
6. Attorney's Fees. If suit, arbitration or other action of any type or nature is brought
to enforce any of the terms and conditions of this Restrictive Covenant, be it in
law or in equity, the prevailing party shall be entitled to an award of its attorney's
fees in addition to all other costs and/ or expenses of collection, suit, arbitration
and/ or other action taken.
7. Authority of Parties. All persons executing this Restrictive Covenant on behalf of
a party warrant that they have the authority to execute this Restrictive Covenant
on behalf of that party.
8. Liberal Construction. This Restrictive Covenant shall be liberally construed in
favor of the deed to effect the purposes of the Restrictive Covenant and the
policies and purposes of the District. If any provision is found to be ambiguous,
an interpretation consistent with the purposes of this Restrictive Covenant that
would render the provision valid shall be favored over any interpretation that
would render it invalid.

9. Amendment. This Restrictive Covenant may be modified, amended or deleted
by the execution of an amendment to this Restrictive Covenant, duly executed
and acknowledged by the each owner(s) of the Property. Such amendment shall
be effective upon its recordation in the official records of the San Luis Obispo
County. No amendment to this Restrictive Covenant shall be valid for any
purpose until approved in writing by the City of Arroyo Grande.
IN WITNESS WHEREOF Declarant has executed this Restrictive Covenant the day and
