NOTICE IS HEREBY GIVEN, pursuant to Section 66499.20% of the Government Code of the State of
California, that the real properties described herein, have been merged together into one parcel or unit of
land, and that said real properties are not separate properties for the purpose of subdivision or
development.
NOTICE IS FURTHER GIVEN that said merger has been executed by the owners of the real properties,
and not by a local agency.

Beneficiary's Consent to Lot Merger
Rocking Spade, LLC,formerly Kendall Road, LLC,is a Beneficiary under Deed of Trust dated September 4,
2012, recorded September 7,2012 as Instrument Number 2012050287 of Official Records, in the Office of
the County Recorder of the County of San Luis Obispo, State of California. Said Deed of Trust is modified
by an agreement executed by NKT Development, LLC and Rocking Spade, LLC,recorded May 30, 2013 as
Instrument Number 2013030992 of said Official Records, and modified by Beneficiary Name Change —
Deed of Trust, executed by Rocking Spade, LLC,recorded May 30, 2013 as Document No. 2013030992 of
said Official Records. The Deed of Trust and modifications encumber the real property described in the
attached 'Notice of Merger and Certificate of Subdivision Compliance"(The"Notice'). As the Beneficiary of
said Deed of Trust, Beneficiary hereby consents to the execution and recordation of the Notice,and agrees
