RECITALS
Whereas, Declarant is the owner of that certain real property known as
465 Canyon Way, Arroyo Grande, CA 93420. Said real property is described as
follows:
WHEREAS, the Property was created by Tract Map No. 2265, which was
recorded in the Official Records of San Luis Obispo County on August 23, 2000
in Book 19, Page 31 of Maps as Document No. 2000-047633 (the "TM 2265");
Now, therefore, Declarant declares that said property shall be held,
transferred, encumbered, used, sold, conveyed, leased, and occupied subject to
this agreement and this agreement shall run with the property herein described
and shall bind the respected owner of said parcels, their heirs, representatives
and assigns:
1. Should a second residential dwelling unit exist on the subject
property, 465 Canyon Way, Arroyo Grande, CA 93420, such second dwelling unit
cannot be sold independently and the owner of the subject property shall occupy
one of the dwellings on the premises.
IN WITNESS WHEREOF, Declarant has executed this Agreement the day and
