PUBLIC UTILITY EASEMENT
THIS OFFER TO DEDICATE, made this 23rd day of November 2015; By Adam R.
Lyman and Olivia L. Lyman, husband and wife, (hereinafter "Offerors") and the City of
Arroyo Grande, County of San Luis Obispo, State of California, (hereinafter "Offeree"):
WHEREAS, said Offerors are the owners of the real property known as 367 Old Ranch
Road in the City of Arroyo Grande CA 93420, Assessor's Parcel Number 007-011-052
(hereinafter "Property").
WHEREAS, Offeree needs access to the Property for the use, operation and
maintenance of a public utility in existing easement.
WHEREAS, Offerors seek to clarify existing easement landscape management and
replacement requirements.
NOW, THEREFORE, For a valuable consideration, the receipt and sufficiency of which
is hereby acknowledged, said Offerors covenants and promises as follows:
1. ° That said Offerors are the owners of the real property described in Exhibit A and
shown schematically in Exhibit B attached hereto,
2. That Offerors agree to be responsible for any damages made to the landscaping
on the Property which might occur if repairs need to be made within the
easement, ,
3. - That said Offerors agree that the landscape maintenance and replacement
responsibility is and shall be binding on their heirs, legatees, successors and
assignees.
IN WITNESS WHEREOF, this Offer is hereby executed by the said Offeror on the day
