A IWiOLUTION OF THE CITY OOUNCIL OP THE CITY
OF ARROYO GRANDE GRANTING A VARIANCE, CASE
NO. 88-121. APPLIED FOR BY ANNE ROBERTSON AT
292 GULARTE ROAD
WHEREAS, the City Council of the City of Arroyo Grande has considered Variance
Application No. 88-121, filed by Anne Robertson, for a Variance tran the maxilml11 building
height of 15 fect at 292 GuJarte Road in the "R-l" SIngle Fwnily Residential District; and
WHEREAS, - the City Council has held a public hearing on this application in
accordance with the City Code; and
WHEREAS, the City Council rands that the following cirCUTb1:ances exist:
1. That the adjus1rnent authorized shall not constitute a grant of special privilege
Inconsistent with the limitatioos upon other properties in the vicinity and district
in which the subject property is situated;
2. That because of spec!al cirCUllrtances applicable to the subject property, including
size, shape, topography, location, or SUITOII'IdIngs, the strict application of the
provisions of this chapter is found to deprive the subject property of privileges
enjoyed by other properties in the vicinity and under identical zone c1nssifi-
cations;
3. That the granting of the Variance will not be contrary to the Intent of this
chapter or to the public safety, health and welfare;
4. That due to special conditions or exceptional characteristics of the property or its
location, the strict appJIcatlon of the provisions of this chapter would result In
difficulties and WUlecess&ry hardship;
5. The granting of the Variance will not be materially detrimental to other properties
or kind uses In the area because the views currenUy enjoyed by the surrounding
properties will not be slgnlficanUy impacted by the proposed development;
6. There are exceptional or extraordinary circ\m;tances applicable to the intended
use that do not apply to other properties in the swne zone. The property has no
apparent or significant viewsheds, nor does it appear to affeet surrounding
viewsheds.
7. The strict application of the ordinance deprives such property of privileges
enjoyed by other properties in the vicinity or In the same zone beeause the 15-
foot restriction would limit the buildable potential of the lot, and other parcels In
the area have been developed with two-st~ hanea; and
8. The granting ot the Variance is canpatible with the objectives, policies, and
general land uses specified In the Gener81 Plan because the intent of the urgency
ordinance is being met, as there is subltantlal protection of the vie~heds on
adjacent property, and the proposed development is in confonnance with the goals,
policies and objectives of the General Han.
NOW, THEREFORE, BE IT RPBOLVED that the City Council of the aty of Arroyo
Grnnde hereby approves said Variance subject to the standard conditions of the City and those
listed below.
1. The development of the site shall occur in substantial conformance with the
approved plans.
