SUBJECT: CONSIDERATION OF ACCEPTANCE OF THE CORPORATION YARD
STORMWATER IMPROVEMENTS PROJECT, PW 2016-14

RECOMMENDATION:
It is recommended the City Council:
1. Accept the project improvements as constructed by Apodaca Paving in
accordance with the plans and specifications for the Corporation Yard
Stormwater Improvements Project;
2. Direct staff to file a Notice of Completion; and
3. Authorize release of retention, thirty-five (35) days after the Notice of Completion
has been recorded, if no liens have been filed.
IMPACT ON FINANCIAL AND PERSONNEL RESOURCES:
The amended Capital Improvement Program Budget includes $32,665 for the subject
project. The total project cost (design, construction, administration, inspection, etc.) is
estimated at $30,700. The contractor’s final construction cost is $27,164.31. The
remaining funds will be returned to the Public Works Administration Operating Fund.
The recommended action will not result in any impact on staff resources.
BACKGROUND:
On February 14, 2017, Council awarded a construction contract to perform the
Corporation Yard Stormwater Improvements project to Apodaca Paving for $26,449.60
and authorized the Interim City Manager to approve change orders in the amount of
$2,644.96. The subject project involved paving a portion of the Corporation Yard to
reduce the amount of sediment and loose particles that flow to the drainage system.
ANALYSIS OF ISSUES:
The contractor completed the work in accordance with the approved plans and
specifications ahead of contract timelines and under the available budget. There are no
outstanding issues.

ALTERNATIVES:
The following alternatives are provided for the Council’s consideration:
1. Accept the Corporation Yard Stormwater Improvements project;
2. Do not accept the project;
3. Accept the project but do not authorize release of retention; or
4. Provide direction to staff.
ADVANTAGES:
The project is complete. Accepting the improvements will allow staff to close out the
project. Remaining funds in this project account will be returned to the Public Works
Administration Operating Fund. The project reduces pollutants in stormwater runoff and
prevents the discharge of pollutants from the City’s Corporation Yard.
DISADVANTAGES:
The disadvantage of accepting the improvements would be if subsequent deficiencies in
the work are identified. However, the contract documents include a one-year warranty
period for the contractor to address any construction defects that may arise.
ENVIRONMENTAL REVIEW:
The project is categorically exempt from the California Environmental Quality Act
(CEQA) pursuant to Guideline Section 15301(c) for the minor alteration of existing
highways, streets and similar facilities.
PUBLIC NOTIFICATION AND COMMENTS:
The Agenda was posted at City Hall and on the City’s website in accordance with
Government Code Section 54954.2.
