Rodewaid Recorder Jan 27, 1997 Time: 15:18 � 5� AGREEMENT AFFECTING REAL PROPERTY This Agreement, dated t2" 3'�` , 1996, for tl�e com�enience of the parties is by and between the CiTy of Arroyo Grande (hereinafter "City") and James and Evadene Dotson (hereinafter referred to jointly as "Oa�ner") RECITALS WHEREAS, Owner is the fee owner of that certaiu parcel of real property generally described as situated at 801 Huasoa Road, Assessor's Parcel Numbecs 007-301-004 and 007-291-006, City of Arroyo Grande, County of San Luis �ispo, California, more specifically described aud depicted upon E�ibiu "A" and "B" attached hereto and incorporated herein; and WHEREAS, said real property is situated in a single family zone of the City; and WHEREAS, Owner resicks in an existing single family home on said Exhibit "A" properiy, and Owner desires to constmct a 640 squace foot second residential unit on said property; and WHEREAS, second units are, as of this date, pernvtted in single-family zones only with a Ciry Conditional Use Pemut after �wblic hearing; and Wf�REAS, after holding the required public hearing the Planning Commission of the City of Armyo Grande approved Conditional Use Pernut Case Number 94-520 for a second residential unit on said Eachibits "A" and "B" property; and WHEREAS, City desires to give recorded notice to all persons and especially sub�uem owners, of tLe restrictions that apply to second residential units in the City. NOW, THEREFORE, in consideration of the foregoing and the following mutual promises, covenanu and conditions, the parties agrce as follows: 1. 2. 7 If either the primary resideuce or the second residential unit is rented, the other shall be owner occupied The second residential unit shall be used for rental purposes only and shall not be offered for sale. The occupant of the second unit shall have the use of one gazaged paiidng spece and one open parking space. 4.
