THIS INDENTURE, made the 15th day of July , 1996, by
Thnmac A R17pp�R an di h K R�n 1 and John J Runels and Carol
A. Runels, hereinafter referred to as "Grantor", and the City of
Arroyo Grande, a political subdivision of the State of California,
hereinafter referred to as "City".
WITNESSETH:
That Grantor, for a valuable consideration, receipt of which
is hereby acknowledged, does hereby grant unto City,its successors
and assigns, a perpetual, permanent and exclusive easement for the
present and future construction, reconstruction, operation, repair
and maintenance of roadway excavation and embankment slopes for the
lateral and subjacent support of roads, roadbeds and appurtenances,
in such number and size, and with such accessory parts and
structures, as City or its successors in interest, from time to
time, deem necessary to install over, upon, under, and across that
certain real property situate in the County of San Luis Obispo,
State of California, described on Exhibit A, attached.
The easement granted herein includes the right to maintain the
easement area for soil erosion purposes and for the protection for
the lateral support of said roads, roadbeds and appurtenances.
Additionally, Grantor does hereby further grant to City its
successors and assigns, the necessary rights of entry to and from
the hereinabove described property for future construction,
reconstruction, operation, repair, or maintenance of said easement.

The consideration hereinabove recited shall constitute payment
in full for any damages to the remaining property of the Grantor,
his successors and assigns, by reason of the construction,
reconstruction, operation, repair and maintenance of the roadway
slopes or other structures referred to herein.
The provisions hereof shall inure to the benefit of and shall
bind the heirs, executors, administrators, assigns and successors
in interest of the respective parties hereto, and al covenants
shall apply to and run with the above described property.
IN WITNESS WHEREOF, Grantor has hereunto set his hand the day
and year first above written.
(AS used above the texm "GRANTOR" shall include the plural as well
as the singular number and the word "his" shall include the
feminine gender as the case may be.)

Chamisai in the City of Arroyo Grande, County of San Luis Obispo, State of Calffomia as shown
on the map filed in Book A of Maps at page 65 in the County Recorders Office of said County,
desaibed as follows.
Beginning at the intersection of the noRherly line of Lot 108 with the southeriy right of way of Fair
Oaks Boulevard as shown on the record of survey filed in Book 16 of Licensed surveys at page
98 in said County Recorders Office, said northerly line of Lot 108 having a bearing of north 89°
34' 27" east at said irdersedion; thence south 20° 48' 01" east 18.00 feet; to the beginning of a
curve concave to the north having a radius of 658.00 feet, a radial beari�g of south 20° 48' 01"
east and a central angle of 20° 22' S4"; thence, parallel with said southerly right of way westerly
along the arc of said curve 234.07 feet; thence north 85° 50' S5" west 126.23 feet to a point that
is 8.00 feet southerly, measured at right angles, to said southerly right of way, thence parallel
