COVENANT RUNNING WITH LAND
This agreement entered into between Rodney A. Gibson
and Shirley D. Gibson , husband and wife, of
___277 E. Cherry Avenue, Arroyo Grande, California ,
hereinafter called owners, with the City of Arroyo Grande, a municipal cor-
poration, hereinafter called City, ie entered into in consideration of the
collowing facts:
1. Owners are the owners of that certain house and lot being all that
land described in Grant Deed recorded in Volume 1923 at Page 852 of
Official Renords of San Luis Obisvo County.

2. City's Municipal Code Section 6-6.503 provides for no sever ser-
vice connection until owner has paid a sewer charge or entered
into an agreement in writing to do so.
3. In consideration for the owners agreeing to pay to the City of
Arroyo Grande the sum of ,,$1 314.59 in 10 equal
installments co®encing July 1 19 78 ,
together with interest thereon, owners are granted a permanent
right to connect to said sever.
In consideration of the foregoing, Rodney A. Gibson and
Shirley D. Gibson hereby agree to pay to the City of Arroyo
Grande at the City Hall, Arroyo Grande, California, the principal sum of
$1,319.59 together with seven par cent interest on the unpaid
balance of said sum. Said principal sum will be paid in 10 equal
payments in the amount of $187.88 ,
with the first payment due J~ 1, 1978 and each pay®ent thereafter
due on July 1 of each Year until said sum is paid in
full. The owners may, at any time until said sum has been fully paid, pay
all or any portion of said obligation in excess of the sum due at the time
of the July 1 payment. In the event that owners fail to
make any payment ae it falls due, the entire unpaid balance of said sum due
to the City of Arroyo Grande shall become immediately due and payable at the

election of the City; and if it is necessary for the City to initiate legal
proceedings to collect any soma due under this agreement, owners agree to
pay such amount as the Court deems reasonable on sccount of attorney's
fees,
This agreement is set forth ae a covenant running with the land and
expressly binds the owners, their heirs, successors, and assigns.
