ZIMARIK COUNTY RECORDER nlll~ 1 :25 - PM-= This agreement entered into between Arroyo Grande Valley Japanese Welfare Association, A California Corporation of 490 E. Cherry Ave, here- inafter called owners, with the City of Arroyo Grande, a municipal cor- poration, hereinafter called City, is entered into in consideration of the following facts: 1. Owners are the owners of that certain land being all that property described in Quitclaim Deed recorded in Volume 970 at Page 249 of Official Records in the 'Office of the County Recorder of San Luia Obispo County, State of California, of the City of Arroyo Grande, commonly known as 490 E. Cherry Ave., Arroyo Grande, California. 2. City's Municipal Code Section 6-6.503 provides for no sewer aer- vice connection until owner has paid a sewer charge or entered into an agreement in writing to do so. 3. In consideration for the owners agreeing to pay to the City of Arroyo Grande the sum of $1,824.44 in 10 installments commencing Julv 1, 1" 19 78 , together with interest thereon, owners are granted a permanent right to connect to said sewer. In consideration of the foregoing, Arroyo Grande Valley Japanese Welfare Association, A California Corporation, hereby agree to pay to the City of Arroyo Grande at the City Hall, Arroyo Grande, California, the principal sum of $1,824.44 together with seven per cent interest on the unpaid balance of said dum, Said print~kpal sum will be p+iid in ten (10) equal pay- ments in the amount of $259.76 with the firat.~payment due July 1, 1978 and each payment thereafter due on July 1 of each year until said sum is paid in full. The owners may, at any time until said sum has been fully paid,-pay all or any portion of said obligation in excess of the sum due at the time of the July 1 payment. In the event that owners fail to make any payment as it falls due, the entire unpaid balance of said sum due to the Cipy of Arroyo Grande shall become immediately due and payable at the election of the City; and if it ie ~.,~o y- Za _» ~ _ ,o-S-s ~vo1.1970 racr 144 io-s-s ../ necessary for the City to initiate legal proceedings to collect any sums due under this agreement, owners agree to pay such amount as the Court deems reasonable on account of attouney's fees.
