RIGHT OF WAY AGREEMENT -- Decobert
FAIR OAKS PROJECT, CITY OF ARROYO GRANDE
Document No. AG-1 , in the form of a Grant Deed covering the
property particularly described therein, has been executed and delivered
to Timothy J. Smith, Right of Way Agent, acting on behalf of the City
of Arroyo Grande, a municipal corporation of the State of California.
Ir, consideration of which, and the other considerations hereinafter
set forth, it is mutually agreed as follows:
1. The parties have herein set forth the whole of
their agreement. The performance of this agree-
ment constitutes the entire consideration for said
document and shall relieve the City of all further
obligation or claims on this account, or on account
of the location, grade or construction of the pro-
posed public improvement.
2. The City of Arroyo Grande shall:
(a) Within sixty days therefrom pay the under-
signed grantor the sum of.'$ ���� p�
for the property or rights as conveyed by the
Grant Deed No. AG- 1 , when title to said
property vests in the City of Arroyo Grande,
subject to all matters of record.
3. It is understood and agreed by and between the
parties hereto that the amount payable under Clause
2(a) above includes, but is not limited to, p'ay-
ment for ornamental tree
, which are
considered to be part of the realty and are being
acquired by the City in this transaction.

4. It is also understood and agreed by and between
the parties hereto that City will at no expense to
Grantor perform the following work at time of
construction:
a. reset or restore as necessary all
affected utility services.
b. conform remaining yard area to back of
sidewalk as required.
c. conform existing driveway to new con-
struction including the installation
of new driveway apron or d� pression.

Permission is hereby granted to the City and/or its
agents, or contractor to enter upon Grantor's property
as necessary, to perform the above described work.
5. Grantor warrants that there are no oral or written
leases on all or any portion of the property exceed-
ing a period of one month, and the Grantor agrees to
hold the City harmless and reimburse the City for
any and all of its losses and expenses occasioned
by reason of any lease of said property held by any
tenant of Grantor for a period exceeding one month.
