TAIS AGREE��NT entered into this °_�y of , 1951,
between J. W. RIIHIJ and JESSE M. RUHL, husband and wiPe, hereinafter oalled
GRANTORS and the CITY OF ARROYO GRANDE, a municipal corporation, harein-
aPter designated as CITY.
W I T N E S S E T H:
That the Grantors in considaration oP the sum of FiPteen Hundred and
no/100 (�1500.00) Dollars receipt oP whieh is hereby acknowledged do here-
by grant to the City of Arroyo Grande, a municipal oorporation, that real
property looated in the City oP Arroyo Grande, County oP San Luis Obispo,
State of California, deeoribed as followa:
Portion oY Lot 107 oY Subdiviaion oP Ranchos Corral de Piedra, Pismo and
Bolsa de Chemisal, in the City of Arroyo Grande, Countq oP San Luis OIDispo,
State oY California, more particularly described as f ollows: Beginning at
a point on the Easterly line of Cienega or Haleyon Road S 0� 7'E 278.87 Yt
Prom the intersection oY the Northerly lot lina of the said Lot 107 with the
Easterly line of Halcyon Road said point being marked with an aale as shown
upon Aqap oP survey oY a portion of Lot 107 filed in Book 3 at paga 85 ra-
cords and surveys in the County oP San Luis Obispo, State oP CaliPornia,
Thence South 0° ']' E- 6 Yt to point of beginning. Thence first South 0°'J'E
50 ft, 3'henoe Seoond N89°51' �aat 150 ft, Thenoe Third N 0a '�* �fest 5@ it
to the N line of property owned by J, W, attd Jessie M. Ruhl, Thence Fourth
South 89��1' PJest along the North line of property owned by J. W, and
Sessie M. Ruhl to the point oP beginning a right oP way 3 ft in width and
eatending Prom the Easterly line oP the above described propertp and eg-
tending Easterly along the North line oP the J, W, and Jessie M. Ruhl
property 572 Pt more or less to Alpine St. said right oP way for the con-
struction and maintenance oP a water main.
Together with the right of way over the hereinabove desaribad real
property which said right of way shall be for the purpose of enabling said
City oP Lsrroyo Grande to install and maintain and operate a water main
thereon and therein.
In aonsideration of the convegance by the Grantors oP said real pro-
perty to the City, the City agrees to erect on said property a pump-house
to house the pumping equipment used in connection with said well which said
pump-houae ahall be finished with stucco and painted white a nd shall be
maintained in a neat and orderly appearance at all timea.
Should the well drilled by the City on the above-described property

deplete the water supply of the well or wells located on other property

beloaging to the aforesaid J. W. Ruhl and Jesse M. Ruhl from which the
hereinabove desoribed property has been taken, the City oY Arroyo Grande
agreea to supply to tha said J. V�. Ruhl and Jesae M. Ruhl or whichever oY
them shall continue to raniain on said proparty £or a period as long as
they or any oP them remain on said property, all water uaed by said par-
son or persons at the Citiea' cost oP produotion up to the amount oY �10.00
per month, it being understood that any water usad by said person or per-
soas, the cost oY production of whioh to the City eaceeda the sum of
�10.00 per month shall be paid for, by t he said person o� p�A�sons above-
named, anq provisions contaitted herein to the oontrary notwithstanding.
The City agraes that it will not drill a well on the herein�.bove de-
scribed propertq at a distance lass than Yifty (50) Yeet Yrom fehe eaist-
ing J. W. Ruhl well so long as the said well is used for a wa#rer supply.
The property over which such additional right oP way is to be convey-
ed in tha event of the exercise oP the option to purchase bq t he City of
Arroyo Grande is described as follows, to-wit:
A Right of way 3 Pt in width and extending from the Ely line oP the above
described property and extending Ely along the North line of the J, W.
