AGREEMENT 1,ND GRANT OF RIGHT OF WAY
LE6 A. BRISCO and MINTA L. BRISCQ, husband and wife,
GRANTORS herein, for and in consideration of the sum of One ($1,00)
Dollar, receipt of which is hereby acknowledge, and other valuable
considerations hereinafter set forth, do hereby grant unto the
CITY dF ARROYO GRANDE, a municipal corporation and one of the Cities
in the County of San I,uis Qbispo, State of California, the right of
way, over, under and upon the following described rezl property
situate in the County of San Luis Obispo, State of Cali£ornia,
to wit:
A strip of land to be used for the purpose
of constructing, installing, naintain ing,
repairing and/or replacing a water line or
water lines fifteen feet (15') in width,
and described as follows:
Beginning at the most Southerly corner of
Tract No. 46 as shown on Map entitled
"Tract No. 46, a subdivision of a part of
Lots 1., B, C, 22 and 23 of the Town of
Grover and a part of Lot 106 of the sub-
division of Rancho Corral de Piedra etc"
filed for record in the Office of the
County Recorder of San I.uis obispo County,
California, in Map Book 5 at Page 64 and
running thence North 3 22' 30" East a dis-
tance of 218.84 feet; thence South 86 34'
30" East a distance of 995.50 feet to the
true point of beginning. Said true point
of beginning also being the most Southeast-
erly corner of a right of way designated as
No. 2 in a deed conveyed to the City of
Arroyo Grande by Leo A. Brisco and Minta L.
Brisco recorded October 13, 1948 in Volumn
462 of Official Records at Page 411, records
of said County; thence South 86 34' 30" East
a cistance of 15 �eet to a point; thence
North 3 15' East 110 feet more or less to a
point on the Southwesterly prolongation of the
Northwesterly line of that property described
in deed to Dorman N. Buttram and Maxine Buttram
recorued in Volumn 1150 of Official Records, on

Page 75, records of said County; thence North
32° 12' East along said Southwesterly prolonga-
tion and the Northwesterly line of that property
deeded to Dorman N. Buttram and Maxine Buttram
to the Southerly line of the California State
Highway right-of-way as it existed August 15,
1933; thence North 57° 33' West along the said
Southerly Highway line to a distance of 15.00 feet
to a point; thence South 32° 12' West to a point
which is located North 8 15' East a distance of
120 feet more or less from true point of begin-
ning; thence South 3 15' West to said true point
of beginning,
As further consideration, said CZTY OF ARRoYO
GRANDE promises and agrees.
1, GRANTORS shall have the right to connect to
said water line or lines and receive water
therefrom, at any time, or at any place where
said GRANTORS presently own contiguous property,
at such rates, charges and regulations as shall
be established by said CITY OF ARROYO GRANDE
applicable to the public generally;
2. If during its use of said property, the CITY QF
ARBQYQ GRANDE causes damage to the existing walks,
roads, landscaping or growing crops thereon, said
CITY QF ARROYO GRANDE promises at its own cost
and expense to replace the same to its former
condition or shall pay for such damage so suffere3;
3. In the event said CITY OF ARROYO GRANDE shall
not commence the use of the said property as
a right of way for such water line or lines
within one year from the date hereof, or, if
having commenced such use thereafter discon-
tinued such use for a continuous period of
five (5) years, then, in either of such events,
said CITY OF ARROYO GRANDE agrees and promises
that it will, on demand of GR�NTORS, quitclaim
such interest as it may have in the subject
property to GRANT(IRS.
The uses, conditions and covenants herein contained
shall be binding upon and shall inure to the benefit of the
heirs, executors, adminis trators, successors and assigns of
the respective parties hereto.
IN WITNESS WkIE:RE�F, GRANTORS have hereunto set their
hands, and the CITY OF ARROYO GRANDE has caused its corporate
name to be subscribed by its officers, thereunto duly author-
ized by resolution of the City Council of the CITY OF ARROYO
