AUG z o 1965 �� ,�� RE ADEA By�C�°62'fsi�f_ - Depury - Fee $--- ------- Indexed DOMPARED � � i_�� ,. ..� QUITCLAIM DEED ��1�3 Pa��31 THIS INDENTURE, made this 15th day of February, 1965, between the County of San Luis Obispo, a political subdivision and one of the counties of the State of California the party of the first part and hereinafter called County, and South San Luis Obispo County Sanita�ion District, the party of the second part; WITNESSETH: That the County for and in consideration of a valuable consideration, receipt of which is hereby acknowledged, does hereby release and forever quitclaim to said South San Luis Obispo County Sanitation District, all that certain real property situate in the County of San Luis Obispo, State of California, and described as follows: See attached sheet marked Exhibit "A". This quitclaim is subject to the following reservations: 1. There is hereby reserved to the County, its successors and 2. assigns, for the use and benefit of the public, a right of flight for the passage of aircraft above the surface of the premises hereby conveyed together with the right to cause in said airspace such noise as may be inherent in the operation of aircraft, now known or hereafter used for navigation of or flight in the air, using said airspace or landing at, taking off from or operating on Oceano County Airport. The South San Luis Obispo County Sanitation District, by accepting this conveyance, expressly agrees for itself, its successors and assigns, that it will not erect nor permit the erection of any structure or object nor permit the growth of any tree, or any other natural growth, to a height, or heights, above a mean sea level elevation of 56'. In the event the aforesaid covenantis breached, the County reserves the right to enter on the land conveyed hereunder and to remove the offending structure or object or to cut the offending tree and/or natural growth, all of which shall be at the expense of the South San Luis Obispo County Sanitation District. :� ;� F� C: N�` ZV Ce? ��i�3 P�43� � � 3. The South San Luis Obispo County Sanitation District, by ac- cepting this conveyance, expressly agrees for itself, its succes- sors and assigns, that it will not make use of the said property in any manner which might interfere with the landing and taking off of aircraft from said Oceano County Airport or otherwise con- stitute an airport hazard. In the event the aforesaid covenant is breached, the County reserves the right to enter upon the land conveyed and cause the abatement of such interference at the expense of the South San Luis Obispo County Sanitation District.
