DECLARATION OF ANNEXATION
This Declaration of Annexation by the City of Arroyo Grande, a Califomia municipal corporation,
hereinafter referred to as "Declarant," is made with reference to the following facts:
A. Declarant is the owner of certain real property located in the City of Arroyo Grande,
County of San Luis Obispo, State of California, more particularly described as Lots 2, 3
and 4 of Parcel Map AGPL 01 -052 (sometimes hereinafter referred to as the
"Property "), recorded in the Office of the Recorder of the County of San Luis Obispo,
State of California, on July 1, 2002, in Book 56 of Maps at Page 58, Document No.
2002 - 053365.
B. Declarant intends by this document to impose upon the Property mutually beneficial
restrictions under a general plan of improvement for the benefit of the owners of the
Property, said mutually beneficial restrictions entitled "Rancho Grande Declaration of
Covenants, Conditions and Restrictions" (the "CC &R's ") having been previously
recorded on December 17, 1986, as Document No. 83634 in the Official Records of
San Luis Obispo County, Califomia.
C. This Declaration of Annexation was authorized in an Amendment to Rancho Grande
Declaration of Covenants, Conditions and Restrictions (sometimes hereinafter referred
to as the "Amendment to CC &R'S ") recorded on June 18, 2002, as Document No.
2002049891.
NOW, THEREFORE, Declarant hereby declares that
1. Lots 2, 3, and 4, of AGPL 01 -052 shall be held, sold, leased, mortgaged, encumbered,
rented, used, occupied, improved and conveyed subject to the CC &R's as defined
above, for the purpose of enhancing and protecting the value and desirability of the
Property and every part thereof, and which shall run with the Property and be binding
on Declarant and its successors and assigns, and on all parties having or acquiring any
right, title or interest in or to the Property or any part thereof, their heirs, successors and
assigns, and shall insure to the benefit of each owner thereof.
2. Lots 2, 3, and 4, of AGPL 01 -052 shall be annexed to and shall become and constitute
a part of the Project, as that term is defined in the Amendment to CC &R's, and be
subject to, and encompassed within, the general plan and scheme of Rancho Grande,
as set forth in the CC &R's.
3. The owners of Lots 2, 3, and 4, of AGPL 01 -052 shall have the same rights, duties, and
obligations as the owners of lots within the Project.
4. The recordation of this Declaration of Annexation shall constitute and effectuate the
annexation of the Property.
IN WITNESS WHEREOF, the Mayor of the City of Arroyo Grande has executed this Declaration
on this date and year, November 26, 2002.
