L �J ;TOTAL 00110823 � �� r� IRREVOCABLE AND PERPETUAL OFFER TO DEDICATE PUBLIC STORM DRAiN, PUBLIC WATER, PUBLIC SEWER, AND EMERGENCY ACCESS EASEMENT THIS OFFER TO DEDICATE, made this 10'" day of December 1999; by Taos Holding Corporation of the City of Arroyo Grande, County of San Luis Obispo, State of California, hereinafter termed Offeror: WHEREAS, said Offeror desires to facilitate the subdivision of Tract 1834 Unit 5 in the City of Arroyo Grande, County of San Luis Obispo, State of California; and, WHEREAS, in order to facilitate the subdivision of Tract 1834 Unit 5, the Offeror desires to dedicate an easement for certain public improvements to be constructed outside the Tract Boundaries; and, WHEREAS, said Offeror desires to make an irrevocable and perpetual offer to dedicate an easement for the purposes of a public storm drain, public water, public sewer, and emergency access, along with any appurtenances and incidental uses. NOW, THEREFORE, for a valuable consideration, the receipt and sufficiency of which is hereby acknowledged, said Offeror covenants and promises as follows: 1. That said Offeror is the owner of the real property described in Exhibit A and shown schematically in Eachibit A-1. 2. That said Offeror does hereby offer to the City of Anoyo Grande an easement for public storm drain, public water, public sewer, and emergency access, along with any appurtenances and incidental uses, over, under, upon and across the following property described in Exhibit B and shown schematically in Exhibit B-l. 3. That within said easement, the City shall have the right to install, operate and maintain, repair and replace, and enlarge or decrease the size of public storm drain facilities, public water system facilities, public sewer system facilities, and emergency access improvements, and any appurtenances and incidental uses. 4. That said Offeror agrees that this easement for public storm drain, public water, public sewer, emergency access is and shall be binding on their heirs, legatees, successors and assignees.
