This Agreement is entered this 19th day of August , 1996, by and between
the City of Arroyo Grande, California, a municipal corporation ("City') herein, and Darren
Shetler ("Developer" herein).
WHEREAS on April 30, 1991, the City Council conditionally approved Developer's
Tentative Tract Map 1834, which is a subdivision of Parcel 6 and a-peFEier�ef Parcel 9,
Parcel Map 77-103, as recorded in Book 28 at Page 85, in the City of Arroyo Grande,
said maps being on file in the Office of the County Recorder of San Luis Obispo County,
California, and;
WHEREAS Mitigation No. 23 to that approval reads as follows:
"Prior to recordation of the final map, the developer shall enter into an
agreement with the City, in a form approved by the City Attorney, whereby
the developer agrees, on behalf of himself and his successors in interest to
pay the Ciry a fee of Two Thousand Six Hundred Fifty-Six Dollars, ($2,656.00)
per residential unit for traffic mitigation. This fee shall be paid for each
residentia� unit, prior to issuance of each building permit or within five (5) years
of recordation of the final map, whichever is sooner."
WHEREAS on February 20, 1996, the City Council approved an amendment
to Developer's Tentative Tract Map 1834, and S�ecific Development Plan No. 90-01,
reducing the Yraffic mitigation fees from $2,656.00 per residential unit to $1,069.22 per
residential unit.

NOW THEREFORE, in order to mitigate all traffic impacts of the Tract 1834
subdivision and to satisfy said Mitigation No. 23, the Developer and City agree as follows:
1. Developer, or Developer's successor in interest to the fee title to each
residential lot in Tract 1834 shall, prior to the issuance of a building permit for the
construction of a single family residence on such lot, or not later than five (5) years from
the date of the recordation of the final map for Tract 1834, whichever shall first occur, pay
to the City a fee of One Thousand Sixty-nine Dollars and Twenty-Two csnts. ($1,069.22)
2. This Agreement shall bind and inure to the benefit of the parties hereto and
to their successors in interest to all governmental interests and the above described real
properties.
3. This Agreement shall be caused to be recorded in the Official Records of the
County Recorder of the County of San Luis Obispo concurcently with the final map for
Tract 1834 and shall become effective upon said recording.
