This Agreement is entered this 19th day of August , 1996, by and between
the City of Arroyo Grande, California, a municipal corporation ("City') herein, and Darren
Shetler ("Developer� herein).
WHEREASCity has in effect Ordinance 431 C.S., which relates to the well-being of
trees within most portions of the Ciry, but is not presently applicable to the Rancho Grande
project; and
WHEREAS on April 30, 1991, the City Council conditionally approved Developer's
Tentative Tract Map 1834, which is a subdivision of Parcel 6 and�-}�ortion-of Parcel 9,
Parcel Map 77-103, as recorded in Book 28 at Page 85, in the city of Arroyo, said maps
being on file in the Office of the County Recorder of San Luis Obispo County, California,
and
WHEREAS Condition No. 85 to that approval reads as follows:
"85. Prior to recordation of the final tract map, the developer and City shall enter
into a written agreement approved by the City Attorney that upon issuance of a
certificate of occupancy for any residence on any lot in the tract, that lot shall
thereafter be governed by Ordinance No. 333 C.S. Said agreement shall also
provide that upon City acceptance of tract improvements, all common areas of the
tract shall become governed by Ordinance No. 333 C.S."
and
WHEREAS City Ordinance 431 C.S. supercedes Ordinance 333 C.S..
NOW THEREFORE, in order to satisfy Condition No. 85, the Developer and City agree as
fol lows:
1. Immediately upon issuance of a certificate of occupancy for each
residential lot within Tract 1834, City Ordinance No. 431 C.S. as then in force, or any
successor Citywide statute then in force, shall automatically thereafter govern the entirety
of said residentiai lot.
2. Immediately upon acceptance by City of the subdivision improvements for
Tract 1834, said City Ordinance 431 C.S. as then in force, or any City-wide successor
statute then in force, shall automatically thereafter govern all common areas within said
Tract 1834.
3. Once becoming subject to the jurisdiction of City Ordinance 431 C.S. or
a successor Ciry wide statute as set forth in Paragraph 1 or 2, above, each portion of Tract
1834 shall thereafter remain subject to any further general City regulation concerning the
subject matter contained in Ordinance 431 C.S.
4. This Agreement shall bind and inure to the benefit of the parties hereto
and to their successors in interest to all governmental interests and the above described
real properties.
5. This agreement shall be caused to be recorded in the Official Records of
the County Recorder of the County of San Luis Obispo concurrently with the final map for
Tract 1834 and shall become effective upon said recording.
