AGREEMENT TO PAY TRAFFI FEES
This Agreement is entered this � day of J �tie , 1997, by and between the City of
Arroyo Grande, California, a municipal corporation ("City") herein), and OTTSE INC., a California
corporation ("Developer" herein).
WHEREAS on Aprii 30, 1991, the City Councii conditionally approved Developer's
Tentative Tract Map 1997, which is a subdivision of Pazcel 8 of Parcel Map 77-103, as recorded in
Book 28 at Page 85, in the City of Arroyo Grande, said maps being on file in the Office of the County
Recorder of San Luis Obispo County, California, and;
WHEREAS Mitigation No. 23 to that approval reads as follows:
"Prior to recordation of the final map, the developer shail enter into an agreement with
the City, in a form approved by the City Attorney, whereby the developer agrees, on
behalf of himself and his successors in interest, to pay the City a fee of Two Thousand
Six Hundred and Fifty-Six Dollars ($2,656.00) per residential unit for traffic
mitigation. This fee shall be paid for each residential unit, prior to issuance of each
building permit or within five (5) years of recordation of the final map, whichever is
sooner."
and;
WHEREAS on August l3, 1996, the City Council approved on amendment to Developer's
Tentative Tract Map 1997, and Specific Development Plan No. 90-04, reducing the traffic mitigation
fees from $2,656.00 per residential unit to $1,069.22 per residential unit.
NOW TFIEREFORE, in order to mitigate all traffic impacts of the Tract 1997 subdivisio❑
and to satisfy said Mitigation No. 23, the Developer and City agree as follows:
1. Developer, or Developer's successor in interest to the fee title to each residential lot
in Tract 1997 shall, prior to the issuance of a building permit for the construction of a single family
residence on such lot, or not later than five (5) years from the date of the recordation of the final map
for Tract 1997, whichever shall first occur, pay to the City a fee of One Thousand Sixt�Nine Dollazs
and Twentv Two Cents ( $1,069.22).
2. This Agreement shall bind and inure to the benefit of the parties hereto and to their
successors in interest to all governmental interests and the above described real properties.
3. This Agreement shall be caused to be recorded in the Official Records of the County
Recorder of the County of San Luis Obispo concurrently with the final map for Tract 1997 and shall
become effective upon said recording.
