1. Petoseed is the owner of that cectain ceal pcopetty identified as San Luis
Obispo County Patcel Map C.0.85-035 which is situated outside of the
corporate limits of the Citq of Arroyo Grande in an acea that is not
presently ptovided with City water and aanitacq sewec services,
2. Petoseed has secured app�oval of development plana and pe�its fram the
County of San Luis Obispo foc an agcicultutal rescacch facility to be
located on said Paccel B(Sec San Luis Obispo County Construction Petmit
ApplicationNo. 51210 andPropecty andProject Layout marked as E:hibit B
attached) and does desire sanitacy sewec and water facilities fcam the
City of Arcoyo Grande,
3. Petoseed desices to landscape the cntry way to devcloFment at the end of
LeannaDcive in ordcc to improve the visual effect of its development upon
andfr�the adjoining ccsidential ncighbochood at Leanna Drive and Parcel
B tntry.
4. 'Ihe City Council of the City of Aczoyo GLande eapresses a willingness to
pcovide Citywatec and sanitacy sewer services to said property only to the
eatcnt that it is necessary for domestic secvices to the 7,000 aquare foot
administration and reseacch building of the development, and ezpressly
refuaes to allow thesc utilitiea and scrvices to be used for any othec
develo�mcnt or foc othet purposes such as plant propagation or irrigation
oc to pcovide fot any othec services than arc cspresely refetred to in this
agreement.
I�I7W, ZF�REFORE, it is agceed betwcta the partits as follows:
1. The City of Atcoyo Graade will allow Petoseed to conncct to the City's
water and sewer sanitary lines on the following terms and conditions:

Petoseed to pay all scrvice charges, permit fees and meet
conditiona as sctforth in applicablc City Ordinances and/oc as
established by the City Council of the City of Acroyo Grande and
as set fotth in Eshibit A, attached. Ezhibit A ceflects
charges in effect onOctober 24, 1985, and such charges will be
tevised upon application for service connections in the event
City aecvice fees and charges change prior to the application
datc.
(c) Petosecd's cight to City scrvices does not eztend to any
fleveloFmtnt oc buildinga or usea othec than the 8,200 square
foot admiastcation and research building.
(d) Eire hydrant installation on Paccel B with a direct conncction
fcom a City water main is espccssly prohibited.
(e) City watec mains are to pcovide foc damestic flows only. If
fice pcotection is to be considered, it �st be thcoagh stocage
and intecnal mains, with apptoptiate backflow ptevention
devices.

(h) 'Ihis agrcement becomes null and void and City may discoatinue
watct and sanitacy acwer service to devttopment in the event
Petosced does not fully camplete landscaping and signage
accocding to the City approved landscaping and signage plan
within siz months of facility occupancy and/oi fails to
maintain landscaping and signage to a ceasonablc standard at
any time aftet landscaping installation.
(i) Petoseed dcveloFment of Pacccl B shall not in any way inccease
atorm drainage flows in the City at any location.
