accepted per attached City Council Resolution No. 4237 on December 8, 2009.

Resolution No. 4237 is a true, full, and correct copy of said Resolution passed and

RESOLUTION NO. 4237
A RESOLUTION OF THE CIN COUNCIL OF THE CITY
OF ARROYO GRANDE ACCEPTING A SEWER MAIN
AND STORM DRAIN AND APPROVING THE QUITCLAIM
OF A STORM DRAIN EASEMENT IN TRACT 2310 -
PHASEII
WHEREAS, the City Council conditionally approved easement agreements for storm drain and
sanitary sewer purposes with the South San Luis Obispo County SanRation District and S&S
Homes for Trad 2310 — Phase II; and
WHEREAS, the project was conditioned to relocate an existing sewer main owned by the South
San Luis Obispo County Sanitation Distrid and a public stortn drain owned by the City; and
WHEREAS, the City agreed to accept ownership of the relocated storm drain and sanitary
sewer main when all project improvements were fully constructed and inspected and found to
be in a good and safe condition; and
WHEREAS, the City agreed to quitclaim all interest in the existing storm drain easement when
alternate improvements were fully constructed and accepted; and
WHEREAS, the developer has constructed the improvements required by the conditions of
approval for Tract 2310 - Phase II; and
WHEREAS, staff has inspected the improvements and finds they are constructed in accordance
with the approved plans for the project.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Arroyo Grande, as
follows:
1. The City accepts the relocated storm drain easement and related improvements as
shown on the Final Map for Tract 2310 — Phase II.
2. The City accepts the relocated sanitary sewer main easement and related
improvements from the South San Luis Obispo County Sanitation District as shown
on the Final Map for Tract 2310 — Phase II.
3. The City approves the quitclaim of all interest in the existing storm drain easement
and authorizes the Mayor to execute ihe Quitclaim Deed.
On motion of Councii Member Arnold, seconded by Councii Member Feilows, and by the
following roll call vote, to wit:
AYES: Council Members Arnold, Fellows, Guthrie, and Mayor Ferrara
NOES: None
ABSENT: Council Member Costello
the foregoing Resolution was passed and adopted this 8 1h day of December 2009.
