PC R 18-2296 RESOLUTION NO. 18-2296 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARROYO GRANDE APPROVING PLANNED SIGN PROGRAM 17-002; LOCATED AT 850 FAIR OAKS AVENUE; APPLIED FOR BY TRIPLE P, LLC WHEREAS, on January 26, 2016, the City Council adopted Resolution 4705 approving Conditional Use Permit 15-006 for the construction of a new approximately 45,000 sq. ft., three-story, medical office building; and WHEREAS, the applicant has filed a Planned Sign Program application to allow for the installation of two (2) new monument signs, one (1) new wall sign, one (1) new vehicle directional sign, and two (2) new directory signs; and WHEREAS, the project site is located at 850 Fair Oaks and is part of the Office Mixed-Use (OMU) zoning district; and WHEREAS, signage proposed to exceed typical permissible square footage and count maximums may be permitted with the approval of a Planned Sign Program; and WHEREAS, the Architectural Review Committee has reviewed the project and has recommended approval to the Planning Commission due to the well thought out design, the attractive color scheme, and the proportionate scale of the proposed sign program; and WHEREAS, the Planning Commission has reviewed the project in compliance with the California Environmental Quality Act (CEQA), the State CEQA Guidelines, and the Arroyo Grande Rules and Procedures for Implementation of CEQA and has determined that the project is exempt per Section 15311(a) of the CEQA Guidelines regarding new construction of an on premise sign; and WHEREAS, the Planning Commission has reviewed the project at a duly noticed public hearing on February 20, 2018; and WHEREAS, the Planning Commission finds, after due study, deliberation and public hearing, that the following circumstances exist and findings can be made: Planned Sign Program Findings: 1. The proposed sign is consistent with the goals, objectives, policies and programs of the Arroyo Grande general plan, specific plan, and any applicable design guidelines or approvals; The project is consistent with General Plan Policies LU92-2.2 and LU 12-2.7 due to the signage being integrated into the overall site and architectural theme of the office building and the size and quantity of signs being minimized in light of the scale and unique nature of the project site. The proposed sign conforms to applicable development standards and provisions of this title and will not be detrimental to the public health, safety and welfare; The purpose of the Planned Sign Program is to provide flexibility for uses with unique design elements and needs. The proposed signage supports a new medical office facility with unique design elements and scale and will not be detrimental to the public health, safety and welfare due to conditions placed upon the project. 3. The physical location or placement of the sign is compatible with the surrounding neighborhood and does not pose a safety risk. The proposed signage is compatible with the surrounding neighborhood dueto the minimal amount of signage when compared to the scale of the structure the signage will be placed upon. The signage will not pose a safety risk due to the signage being constructed and installed in conformance with the California Building Code. NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Arroyo Grande hereby approves Planned Sign Program 17-002 as set forth in Exhibit "B", attached hereto and incorporated herein by this reference, with the above findings and subject to the conditions as set forth in Exhibit "A", attached hereto and incorporated herein by this reference. CONDITIONS OF APPROVAL: GENERAL CONDITIONS 1. The applicant shall ascertain and comply with all State, County and City requirements as are applicable to this project. 2. The project shall substantially conform to the plans on file in the Community Development Department, dated December 21, 2017. 3. The applicant shall agree to indemnify and defend at his/her sole expense any action brought against the City, its agents, officers, or employees because of the issuance of said approval, or in the alternative, to relinquish such approval. The applicant shall reimburse the City, its agents, officers, or employees, for any court costs and attorney's fees which the City, its agents, officers, or employees may be required by a court to pay as a result of such action. The City may, at its sole discretion, participate at its own expense in the defense of any such action but such participation shall not relieve the applicant of his/her obligations under this condition. 4. The permit shall expire on February 20, 2020 unless a building permit is issued for the project. BUILDING DIVISION 5. The applicant shall comply with the current California codes including the specifically adopted City of Arroyo Grande provisions. 6. Prior to any additional work being done onsite, the applicant shall obtain all necessary permits from the Building and Life Safety Division. PLANNING COMMISSION 7. Monument sign "B" shall be placed as close to the nearby retaining wall as feasible while not impacting the catch basin. 8. The monument signs shall say"850 Fair Oaks Ave." or"850 Fair Oaks Avenue."
