R 1898 RESOLUTION NO. 1898 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARROYO GRANDE, CALIFORNIA, REFERENCING PREVAILING WAGE SCALE AND DIRECTING CALL FOR CONSTRUCTION BIDS WHEREAS, the CITY COUNCIL of the CITY OF ARROYO GRANDE, CALIFORNIA, has heretofore instituted proceedings under the prov i s ions of the "Municipal Improvement Act of 1913", being Division 12 of the Streets and Highways Code of the State of California, for the construction of certain pub 1 ic works of improvement in a speci al assessment district known and designated as ASSESSMENT DISTRICT NO. 81-1 (herei nafter referred to as the "Assessment Di strict"); and, WHEREAS, at this time there have been submitted for final revi ew the pI ans and specifications for the works of improvement for the Assessment District; and, WHEREAS, it is the intention of the City Council to also call for sealed proposals or bids for the doing of said work and improvements in said Assessment District; and, WHEREAS, it is necessary to determine the prevail ing rate of wages for the various classifications of ,workmen required in the performance of said work. NOW, THEREFORE, IT IS HEREBY RESOLVED AS FOLLOWS: SECTION 1. That the above reci tal s are all true and correct. SECTION 2. That the pI ans and specifications for the works of improvement in the Assessment District are hereby approved and authorized for bidding. SECTION 3. That it is hereby determined and ascertained that the general prevailing rate of per diem wages in the locality in which said work described is to be performed in the matter of the construction of certain public works of improvement, together wi th appurtenances, in the Assessment District, under the provisions of the "Municipal Improvement Act of 191 3", be i ng Division 12 of the Streets and Highways Code of the State of Cal ifornia, for each craft or type of workman or mech anic needed to execute the con- tract, and al so the general prevail ing rate for legal ho 1 i day and over- time work of each craft or type of workman or mechanic, is in accordance with the schedule obtained from the Director of Industri al ReI ations, pursuant to the provisions of Section 1773 of the Labor Code of the State of Cal i forni a, and reference is hereby made to copi es thereof on fil e with the transcript of these proceedings, which said copies are available to any interested party upon request. Further, a copy shall be posted at each job site during the course of construction. SECTION 4. That the proposal s or bids shall be opened and ex ami ned at a pub 1 i c meeting so called; and said results of the bidding shall be reported at the next regul ar meeting of this City Council after the opening of the bids. SECTION 5. That the terms and conditions for bidding on the works of improvement for this Assessment District are as set forth in full in the 8id Documents in the specifications as previously approved. Reference is hereby made to said Bid Documents heretofore approved and identified as follows: NOTICE INVITING SEALED PROPOSALS ASSESSMENT DISTRICT NO. 81-1 For all particulars as to bidding, the Notice Inviting Sealed Proposals above referenced and all incorporated ~ documents and 1 aws, incl udi ng but not limited to the "Municipal Improvement Act of 1913", shall control. -----.---....------ ._, -- -_._-------". . ~ ~ . , SECTION 6. That it is hereby determined that in the event the contractor, contract- ing owners included, does not complete the work within the time limit specified in the contract or within the time limit as shall be autho- rized, the contractor or contracting owners, as the case may be, shall pay as liquidated damages the iITIount or iITIounts as set forth in the speci ficat ions for the project, said iITIounts herein referenced and so incorporated. That it is impractical to determine the actual damage which will be sustained by reason of such del ay, but that the stated sum is a reasonable iITIount for said liquidated damages and is not being imposed as a penalty.
