Failure of the contract purchaser to pay the amount required or otherwise comply with the terms of the contract will result in the cancellation of the contract. Cancellation of the contract effectively terminates the equitable interest of the contract purchaser and of all others claiming an interest in the property under him. - The contract purchaser has failed to comply and the department now intends to take final action with the issuance of a Notice of Cancellation of Contract. Since the California Department of Veterans Affairs is fee title holder of subject property, general foreclosure action is not required to remove the equitable interest of the contract purchaser. In accordance with Section 344.2 of the California Code of Regulations, Title 12. Military and Veterans Affairs, you are hereby notified that as a lienholder, you have 30 calendar days in which to begin foreclosure or other action necessary to protect your junior lien or security interest in the property. Please immediately notify the Foreclosure Unit of the California Department of Veterans Affairs of your intended action. Your written response is required in this office within 30 days of the date of this letter or your interest in this property shall be terminated and forfeited. The rights, duties and obligations of all parties claiming an equitable interest in the property are governed by the terms of the CalVet Loan Contract, the Military and Veterans Code of the State of California and the California Code of Regulations, Title 12.
