Dear Mr.Adams,
My wife,Sigrid,and I purchased 1450 Jasmine P1 in Arroyo Grande in September 2006 under the Moderate Income
plan. We are writing to request that you release us from the Moderate Income restrictions for selling our home.
Here are the material facts of our situation. In light of our knowledge that some other homeowners who also
purchased homes under the Moderate Income restrictions have recently been released from those restrictions and
have subsequently sold their homes on the open market,we enquired with Century 21 a few weeks ago about selling
our home,so that we could buy a house with more room for our growing family. Our realtor reported to us that we
are no longer under the Moderate Income restrictions for selling our home. We asked him to confirm this,and he
was told incorrectly,by whomever he checked with,that we were. After his confirmation to us,we made a
contingency offer to buy another house(at 951 Cameron Ct in Arroyo Grande). Not only would this house afford us
more room for our growing family,but also its included guest house would allow us to house Sigrid's mother. The
owners accepted our contingency offer,and we then put our Jasmine Place house on the market. Within a few days
we had several offers,one of which we accepted at a good price. Today our realtor informed us that his information
was incorrect,and that the reality is that decisions about releasing homeowners from the Moderate Income
restrictions are done on a case-by-case basis.
In this case,the financial situations and plans of at least three families are on the line(us,the sellers of the Cameron
Ct house that we want to buy, and the buyers of our Jasmine Place house). All three parties have spent considerable
sums of money already in doing our due diligence in inspecting the homes,etc. Sigrid and I know that,if we are not
released from the Moderate Income restrictions,then we will not be able to improve our housing situation,since
nobody in his right mind would purchase our home on the Moderate Income plan when there are equally good
houses on the open market that currently sell for the same price that our house would sell for.
Sigrid and I fully understand that you have no responsibility for the fact that our realtor relied on false information
in advising us about selling our house and buying another house. We also know that you have no obligation to grant
our request. All I can say is that we sincerely believed that we had satisfied our obligation to enquire about this
matter by having our realtor check,and double-check,to confirm that we could sell our home on the open market.
Finally,I want you to know that we love living in Arroyo Grande: that is why the house we wish to buy is in
Arroyo Grande. We are not trying to make a bunch of money on the deal. Indeed,we will merely break even on the
deal,given today's very low interest rates;however,we will not be able to sell or buy unless we are released from
the Moderate Income restrictions in a timely manner(our escrow closing date is May 10). For these reasons,we ask
you please to release us from selling under the Moderate Income restrictions.
