R 1732 .- . .~ 11 .' ... . n / RESOLUTION NO. 1732 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARROYO GRANDE, CALIFORNIA, COVERING PRELIMINARY DETERMINATION AND ORDERING THE PREPARATION OF A REPORT ON SAID IMPROVEMENT WHEREAS, the CITY COUNCIL of the CITY OF ARROYO GRANDE, CALIFORNIA, is contemplating the construct ion of certai n public works of improvement under proceedi ngs conducted pursuant to the "Municipal Improvement Act of 1913", being Division 12 of the Streets and Highways Code of the State of California, in a special assessment district known and designated as ASSESSMENT DISTRICT NO. 81-1 (hereinafter referred to as the "Assessment District"). NOW, THEREFORE, IT IS HEREBY RESOLVED AS FOLLOWS: SECTION 1. That the above recitals are all true and correct. SECTION 2. That certain public works of improvement, together with appurtenances and appurtenant work, including acquisition where necessary, are proposed to be done and made within the boundaries of the Assessment District. In connection therewith, it is found and determined as follows: A. That the specific nature of the proposed works of improvement consists of all the work as shown on the proposed boundary map, as previously approved for this Assessment District. B. That the boundaries of the Assessment District and the lands and propert ies withi n the Assessment Di strict proposed to be assessed to pay the costs and expenses of said proposed works of improvement are as shown upon a map of the Assessment District, lIhich map has been heretofore approved and is on file with the transcri pt of these proceedings. Said map shall govern for all details as to the extent of the Assessment District. SECTION 3. That the statute under which it is proposed to conduct proceedings is the "Municipal Improvement Act of 19B", being Division 12 of the Streets and Highways Code of the State of California, with bonds proposed to be issued as authorized by the " Improvement Bond Act of 1915" , being Division 10 of said Code. SECTION 4. That this proposed improvement is referred to the SUPERINTENDENT OF STREETS, who is hereby appointed to procure all necessary information to prepare a report on the proposed improvement in the manner and form provided for in Division 4 of the Streets and Highways Code of the State of California, the "Speci al Assessment Investigation, Limitat ion and Majority Protest Act of 1931". SECTION 5. That this Resolution and the Report as ordered herein are pursuant to the provisions of said Division 4. SECTION 6. ( SECn ON 7 ~ That the works of improvement as proposed to be constructed under these proceedings, generally consist of the following: The construction of certain street improvements, including a water system and drainage improvements, together with all appurtenances, and including the grading work which is necessary for the foregoing improvements. The work is to be located in all or a port ion of the public easements and within RANCHO PARKWAY, WEST BRANCH STREET, JAMES WAY, HALCYON WAY, and MILLER WAY. A backbone water system, including the construction of a pump station, transmission pipeline system, and a water reservoir is included, all to serve and benefit properties located within the bounda- ries of ASSESSMENT DISTRICT NO. 81-1. SECTION 8. That this Council does, at this time, intend to make a contribution to pay for certain of the costs and expenses of the works of improvement, as proposed under these proceedings, as set forth in the Investigation Report, a copy of which is on file with the transcript of these proceedings.
