PC Minutes 1996-01-02ARROYO GRANDE PLANNING COMMISSION JANUARY 2, 1996 The Arroyo Grande Planning Commission met in regular session with Vice Chairperson Tappan presiding. Present were Commissioners Beck, Carr, Deviny, Soto and Lubin. Chairperson Keen was absent. Community Development Director Doreen Liberto - Blanck and Current Planner Scott Spierling were in attendance. Vice Chairperson Tappan advised the audience that the Non - Public Hearing Item, Request for an Interpretation by Paul Deffebach, was to be continued to the next regular meeting of January 16, 1996. APPROVAL OF MINUTES - On motion by Commissioner Carr, seconded by Commissioner Beck, and unanimously carried, the minutes of the regular meetings of November 21 and December 5, 1995 were approved. ORAL COMMUNICATIONS - None PUBLIC HEARING - TENTATIVE PARCEL MAP CASE NO. 95 -528 FOR A FOUR (4) LOT MINOR SUBDIVISION AT 1059 MAPLE STREET (RICHARD DEBLAUW CONSTRUCTION) Current Planner Scott Spierling presented the staff report. The proposal is for a four (4) lot parcel map, all four lots meet the requirements of the Development Code for minimum lot size, width and depth. The proposed lots also meet the minimum setback requirements in the Residential Single Family designation. The issues of concern for the project are: (1) undergrounding of utilities (this is addressed in the conditions of approval) and (2) orientation of the future house on parcel 1 (either orientation would satisfy the requirements of the Code). Vice Chairperson Tappan opened the public hearing. Richard DeBlauw, 744 Alta Vista Way, Arroyo Grande, Applicant - asked if the City intended to develop assessment districts Citywide to underground utilities and he wonders if it is appropriate that he waive the right of future owners to protest an assessment district in the future should one be formed. Community Development Director Doreen Liberto - Blanck replied that the Long Range Planning Committee has been reviewing plans to underground utilities Citywide and one option includes assessment districts. This particular location is not under discussion at this time. Regarding the rights of future property owners, this is a condition suggested by the Public Works Director and adopted by the City Council. When no one else came forward to speak Vice Chairperson Tappan closed the public hearing. Commissioner Lubin expressed concern with waiving the rights of future property owners regarding protecting a future assessment district. His other concern was drainage on the project. Commissioner Deviny stated that he felt waiving the rights of future property owners is a simple deed restriction and he is comfortable with that method of handling the issue. He inquired of staff if there would be a vault required or a conduit? He also expressed concern that there should be some future cost savings to the property owners of this parcel, if an assessment district is formed at a later date, if there is a vault required at this stage of construction. Current Planner Spierling stated that the utility companies have normally required a vault in this type of project. 1 1 1 1 1 1 Arroyo Grande Planning Commission Page 2 January 2, 1996 Commissioner Soto expressed concern with the separate access for parcel 1 onto Maple Street which would remove on- street parking spaces. He feels that the common drive provides good parking for the project and parcel 1 should be accessed from it. It is his understanding that within the project the utilities will be undergrounded. Commissioner Beck also expressed concern with access for parcel 1. Commissioner Carr asked if the applicant preferred two (2) driveways: one for parcel 1 off Maple Street and the common drive for the other three? Mr. DeBlauw agreed. Commissioner Carr asked if all four (4) lots would be included in the proposed assessment district? Community Development Director Doreen Liberto - Blanck replied that would be determined by the City Council when the assessment district was formed in consultation with the Public Works Director. There was discussion by the Commission of allowing the existing shop to remain; orientation of, and access to, parcel 1; installation and utilization of the vault and undergrounding the utilities; drainage from the project; the possibility of a future assessment district and the right to protest; and the off - street parking provided off the common driveway. Community Developrnent Director Doreen Liberto - Blanck reviewed exceptions to undergrounding per the Developrnent Code; she stated that the second portion of Condition #20 was directly requested by the Public Works Director. After discussion by the Commissioners, the following action was taken: Add New Condition #16A: Concurrently with recordation of the Parcel Map, the applicant shall record a deed restriction affecting parcel 1 that requires any house constructed on said lot to front on Maple Street with a garage accessed from the common driveway. An access denial strip shall be recorded concurrently with the Parcel Map, along the Maple Street frontage of Parcel 1 exclusive of the common driveway. Amend Condition #l20: Prior to recordation of the parcel map, the developer shall comply with Development Code Chapter 9 - 15, "Improvements ". All above ground utilities shall be undergrounded. Above ground utilities on the Maple Street property frontage may remain above ground but prior to recordation of the Parcel Map the applicant shall install conduit for future underground utilities per utility company specifications. NON - PUBLIC HEARING - REQUEST FOR INTERPRETATION OF DEVELOPMENT CODE SECTION 9- 12.100 REGARDING ACCESS TO A PUBLIC RIGHT -OF -WAY On motion by Commissioner Carr, seconded by Commissioner Deviny, and unanimously carried, this item was continued to the next regular meeting on January 16, 1996. PLANNING COMMISSION ITEMS AND COMMENTS A. Planning Commissions request for color standards. On November 21, 1995, the Planning Commission requested staff to develop a method to eliminate some of the confusion surrounding colors: Staff discussed this request with the Architectural Advisory Committee (AAC) and they recommended a two step process as outlined in the staff report. There was discussion regarding the Munsell Book of Color, the cost and how it is utilized by San Luis Obispo County; the need for architectural guidelines citywide; and the fact that paint manufacturers change paint colors frequently. Staff also discussed the current procedure which allows all components of a project to be reviewed concurrently. On motion by Commissioner Carr, seconded by Commissioner Soto, and unanimously carried, staff was instructed to implement Step 1 as presented in the staff report with the modification, the applicant weu d be required to paint a small test patch.. ". B. Update of Projects - the Planning Commission interpretation for Bob's Car Wash will be presented to the City Council next Tuesday on appeal; - the Long Range Planning Report will also be presented to City Council for discussion next Tuesday; - Tom Sullivan, Grover Beach, and Doreen Liberto - Blanck are again working on a countywide Planning Commission dinner, the tentative date is February 23, 1996; 1 1 1 1 1 Arroyo Grande Planning Commission Page 4 January 2, 1996 ATTEST: - GenCom, Inc. has advised staff that they will be submitting their application for developrnent in the next week; - staff is in the process of finalizing standard conditions of approval for Planning Commission review; and - the City Manager has authorized part time use of Bill Ballagh from the Public Works Department to handle code enforcement. Staff is preparing a Code Enforcement Manual for standard handling of concerns.
