PC Minutes 1993-02-02ARROYO GRANDE PLANNING COMMISSION FEBRUARY, 2, 1993 The Arroyo Grande Planning Commission met in regular session with Chairman Soto presiding. Present are Commissioners Moore, Tappan, Carr, and Reilly. Current Planner Scott Spierling is in attendance. APPROVAL OF MINUTES - On a motion by Commissioner Carr, seconded by Commissioner Moore, and unanimously carried, the minutes of December 15, 1992 and January 5, 1993 were approved with the following minor correction to the Minutes of January 5. Under Resolution No. 93 -1403 on Page 3, in the paragraph beginning with "After it was agreed... ", the third line from the bottom of this paragraph beginning with "whether the changes within..." should read "whether the change is within... ". ORAL COMMUNICATIONS - None PUBLIC HEARING - TENTATIVE PARCEL MAP CASE NO. 92-507, SUBDIVISION OF A 3.2 ACRE PARCEL AT 1101 HUASNA ROAD, APPLICANT IS BOB BOWEN Current Planner Scott Spierling stated that the reason for requesting a continuance on this item was because the City Attorney required more time regarding the legal implications on the riparian rights. Chairman Soto asked the audience if there was anyone that objected to this continuance. With no objection from the audience, a motion was made by Commissioner Tappan, seconded by Commissioner Reilly, and unanimously carried to continue this item until February 16, 1993. NON - PUBLIC HEARING ITEM - REQUEST FOR INTERPRETATION OF CONDITIONAL USE PERMIT AT 1069 EL CAMINO REAL, APPLICANT ROB AND LORI GILLESPIE Current Planner Scott Spierling briefed the Commission on this item. Then Chairman Soto opened the public hearing. Lori Gillespie, 345 Tally Ho Road, Arroyo Grande, stated the reasons she felt the Conditional Use Permit was not necessary were that the property is used only for parking and overnight storage of trucks and that the small prefab unit on the property was for storing equipment overnight to prevent rusting. She stated this unit was temporary and would be removed whenever they vacated the premises. Rob Gillespie, 345 Tally Ho Road, Arroyo Grande, stated some reasons that he felt the Conditional Use Permit should not be required, and that the cost it would involve would be burdensome to their business at this time. The Planning Commission queried both applicants and discussed this item among themselves. As no improvements had been made, no retail sales would be involved, and the use was not more intensive, it was agreed this permit was not necessary, but certain limitations should be included in the resolution. A motion was made by Commissioner Carr moved to approve the resolution with the following modifications. Item 1 to have the words "landscape and maintenance" deleted. An Item 3 to be added: A Conditional Use Permit will be required if any of the following occur: a. Public utility improvements; b. construction requiring a Building Permit; c. employee parking exceeding 12 vehicles; d. retail sales; and e. storage of materials or fuels. The following action was taken: RESOLUTION NO. 93 -1405 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARROYO GRANDE PROVIDING AN INTERPRETATION OF THE DEVELOPMENT CODE THAT A CONDITIONAL USE PERMIT IS NOT REQUIRED FOR A LANDSCAPE AND MAINTENANCE BUSINESS LOCATED AT 1069 EL CAMINO REAL, IN THE INDUSTRIAL ZONE 417 41$ Arroyo Grande Planning Commission Page 2 February 2, 1993 On motion by Commissioner Carr, seconded by Commissioner Tappan, and by the following roll call vote, to wit: AYES: Commissioners Moore, Tappan, Carr, Reilly, and Chairman Soto NOES: None ABSENT: None the foregoing Resolution was passed and adopted this 2nd day of February 1993. NON - PUBLIC HEARING ITEM - CITY OF ARROYO GRANDE, DISCUSSION OF FIRE DEPARTMENT ISSUES, KURT LATIPOW, FIRE CHIEF As Fire Chief Kurt Latipow was not present, this item will be continued to a time when Mr. Latipow is available. PLANNING DIRECTOR /PLANNING COMMISSION ITEMS AND COMMENTS Current Planner Scott Spierling explained the different configuration regarding the Lopez Continuation School Courtyard to the Planning Commission. The commissioners agreed that it was in substantial conformance with the approved plans. John Soto will be the Planning Commission representative to the Update Long Range Planning Report Committee with Clark Moore as his alternate. The Planning Commission was reminded of the Planners Institute's upcoming meeting. The flyers given to the commissioners preceding the meeting on the APA San Luis Obispo Subsection Event Thursday, February 25, 1993 was briefly discussed. Chairman Soto mentioned the Press Release regarding the feasibility study to share police services with Grover Beach. This will be discussed at the regular Arroyo Grande City Council Meeting on February 9, 1993.
