PC Minutes 1991-12-0333 c' ARROYO GRANDE PLANNING COMMISSION DECEMBER 3, 1991 The Arroyo Grande Planning Commission met in regular session with Chairman Brandy presiding. Present are Commissioners Boggess, Souza, Moore, Groves and Carr. Commissioner Soto is absent. Planning Director Doreen Liberto -Blanck and Current Planner Spierling are also in attendance. MINUTE APPROVAL Hearing no additions or corrections, the minutes of the regular meeting of September 17, 1991 were approved as prepared on motion by Commissioner Souza, seconded by Commissioner Boggess and unanimously carried. PUBLIC HEARING - CONDITIONAL USE PERMIT CASE 91 -488, 295 ALDER STREET (THE ALDER HOUSE), APPLIED FOR BY JO ANN BAZER AND VICTOR TOSE'. Current Planner Spierling reviewed the staff report, dated December 3, 1991, regarding the project. He advised that the Alder House is a residential care facility that provides assisted living for ambulatory senior citizens, noting that this use has been in operation for 13 -14 years. He briefly described the existing facility and the 20 room expansion as proposed by the applicants. He stated that the site is currently accessed through a circular, gravel driveway that connected to Alder Street. No parking spaces are formally delineated, however there is room for several cars to park in various locations on the site. Mr. Spierling further advised that development of this project will necessitate removal of some fruit trees, juniper trees, two eucalyptus trees and some of the Birch trees from the front yard. The large oak trees at the back of the site will be saved and receive appropriate pruning and mulching. He pointed out that the General Plan land use designation of the site is Senior Housing and, within that designation, several types of senior housing are permitted, including; single family attached, multiple family attached, mobile homes, and congregate or residential care facilities. The applicants are proposing an expansion of a residential care facility. The allowed density in the Senior Housing designation is 25 dwelling units per acre. The applicants are proposing an expansion to 20 rooms. The site is 35,390 square feet. These factors equate to a proposed density of 25 dwelling units per acre. The Architectural Advisory committee reviewed this project on October 7, 1991, and unanimously recommended approval of the project to the Planning Commission with the condition that the applicant submit a fence design for review and approval prior to issuance of building permits. Also, Mr. Spierling advised that a traffic study was prepared to address possible impacts related to development of this project. The traffic study indicated that this project would have a negligible impact on traffic and circulation. This traffic study was referred to the Public Works Department and the Parking and Traffic Commission for review and comment. The Parking and Traffic Commission reviewed the study at their regular meeting of November 18, 1991. The Commission felt that the study adequately addressed impacts and had no comments. After review of the project, both the Architectural Advisory Committee and the Staff Advisory Committee recommend that the Planning Commission approve the project, adopt a negative declaration, instruct the Secretary to file a Notice of Determination, and approve the associated architectural review. Upon being assured by the Planning Commission Secretary that public hearing for Conditional Use Permit Case No. 91 -488 had been duly published and property owners notified, Chairman Brandy declared the hearing open. Charles Rhia, Project Designer, briefly described the project. He stated they looked over the conditions of approval and had no objections, with the exception of the requirement for a "door ajar" alarm. He advised that this is an assisted living home and all of the people that are there are ambulatory and, more than likely, they stay inside of the house. Jo Ann Bazer, one of the applicants for the project, spoke in favor of the Conditional Use Permit. She advised that the facility offers custodial type of care, and there are very few of the people that go outside and walk. Arroyo Grande Planning Commission, 12/3/91 Page 2 In response to the question on the requirement for the "door ajar" alarm, Mr. Spierling stated that this condition was recommended by the Police Department, and the concern is that residents sometimes leave without authorization, and it is the Police Department's feeling that this alarm would alert the staff that people are out and around. Hearing no further comments from the audience, Chairman Brandy declared the hearing closed. After a brief discussion regarding the requirement for a "door ajar" alarm, Mr. Spierling suggested that if the Commission is concerned about this condition ( #39), the requirement could be revised as follows: "Prior to final occupancy, the applicants shall install a "Door Ajar" alarm on exterior doors that shall terminate in the office and the staff lounge, or alternative as approved by the Chief of Police." After further discussion, the following action was taken: RESOLUTION NO. 91 -1354 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARROYO GRANDE APPROVING CONDITIONAL USE PERMIT CASE NO. 91 -488 AND THE ASSOCIATED ARCHITECTURAL REVIEW, TO ALLOW FOR EXPANSION OF AN EXISTING RESIDENTIAL CARE FACILITY FROM 9 TO 20 ROOMS, APPLIED FOR BY JO ANN BAZER AND VICTOR TOSE' AT 295 ALDER STREET, AND ADOPTING A NEGATIVE DECLARATION AND INSTRUCTING THE SECRETARY TO FILE A NOTICE OF DETERMIINATION. On motion by Commissioner Boggess, seconded by Commissioner Moore, and by the following roll call vote, to wit: AYES: Commissioners Boggess, Souza, Moore, Groves, Carr and Chairman Brandy NOES: None ABSENT: Commissioner Soto the foregoing Resolution was adopted this 3rd day of December 1991 with the revision to condition of approval number 39 as recommended by staff. PUBLIC HEARING - CONDITIONAL USE PERMIT CASE 91 -491, 1167 GRAND AVENUE (JOSEPH AND CHERIE WAIS.) Mr. Spierling reviewed the staff report dated December 3, 1991. He advised that the site for this project was used for single family residential purposes until late 1989. In February 1990, Monarch Reality was granted a business license to operate from the site after installing a 3 -4 space parking lot and a drainage basin to accommodate the increased runoff. The reality office recently vacated the property. The parking is sufficient for the size of the existing building. The site is currently developed with a 600 square foot building and a 576 square foot covered patio. No changes in landscaping, buildings, or other site features is proposed. He stated that the applicants have proposed using the site for retail commercial use. Specifically, they wish to sell fish and pond supplies, large aquariums, and Koi (a species of fish typically used in large outdoor ponds). Fish and pond plants will located in 15 above - ground ponds located in the back yard. The interior of the building will be used for sales of associated merchandise, such as koi food, pond liners, garden supplies, house plants, fish medication, pumps, filters, and similar products. The proposed use is in the retail commercial land use category while previous uses were in the professional office and residential land use categories. Because of the change in land use categories and since retail commercial uses are generally more intensive than the previous uses a CUP was required to be filed. 337 338 Arroyo Grande Planning Commission, 12/3/91 Page 3 The Staff Advisory Committee recommends that the Planning Commission adopt a resolution adopting a negative declaration, instructing the Secretary to file a Notice of Determination, and approving CUP 90 -491 with the findings and subject to the recommended conditions of approval Upon being assured by the Planning Commission Secretary that public hearing for Conditional Use Permit Case No. 91 -491 had been duly published and property owners notified, Chairman Brandy declared the hearing open. Joseph Wais, 300 Miller Way, applicant, spoke in favor of the Conditional Use Permit. He stated he is in agreement with all of the recommended conditions. Leonard Lenger spoke in favor of granting the use permit. Hearing no further comments from the audience, Chairman Brandy declared the hearing closed and, after a brief discussion, the following action was taken: RESOLUTION NO. 91 -1355 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARROYO GRANDE APPROVING CONDITIONAL USE PERMIT CASE NO. 91 -491, TO ALLOW FOR RETAIL SALES OF KOI AND POND SUPPLIES, APPLIED FOR BY JOSEPH AND CHERIE WAIS AT 1167 GRAND AVENUE, AND ADOPTING A NEGATIVE DECLARATION AND INSTRUCTING THE SECRETARY TO FILE A NOTICE OF DETERMIINATION. On motion by Commissioner Carr, seconded by Commissioner Souza, and by the following roll call vote, to wit: AYES: Commissioners Boggess, Souza, Moore, Groves, Carr and Chairman Brandy NOES: None ABSENT: Commissioner Soto the foregoing Resolution was adopted this 3rd day of December, 1991. PUBLIC HEARING - CONDITIONAL USE PERMIT CASE 91 -492. 1590 W. BRANCH STREET (CARL'S JR. RESTAURANT /C. .1. ENTERPRISE.) Mr. Spierling advised that since this project is within a Planned Development zone, the Planning Commission will make a recommendation for approval or denial to the City Council. He stated that the applicant is proposing construction of a play area at the existing Carl's Jr. restaurant at 1590 W. Branch Street. To construct the play area, approximately 260 square feet of landscaping will be removed and replaced with a concrete slab. That area and an adjacent concrete walk will be fenced with a steel tube fence painted to match the building to create the play area. The size of the play area will be 21 feet by 28 feet or 588 square feet. A bicycle rack will also have to be relocated to facilitate development of the play area. The play area will be accessed by a new door in the front portion of the restaurant. The area will be exited by a gate in the fence that leads to a walk, that leads to the parking lot. Within the play area, the applicant will install a single manufactured, piece of playground equipment. This equipment consists of tubes, bridges, a slide and a "ball pool ", all located within a net - covered frame. The exterior dimensions of the equipment are 16.5 feet by 17.5 feet by 8 feet tall. Since the play area is 21 feet by 28 feet, this will allow some space around the sides of the equipment. The Staff Advisory Committee recommends that the Planning Commission adopt a resolution recommending that the City Council approve Conditional Use Permit Case No. 91 -492 with the findings and subject to the conditions listed in the staff report dated December 3, 1991. Upon being assured by the Planning Commission Secretary that public hearing for Conditional Use Permit Case No. 91 -492 had been duly published and property owners notified, Chairman Brandy declared the hearing open. Arroyo Grande Planning Commission, 12/3/91 Page 4 Tim Woodle, Architect and representative for the project, stated the applicants are in agreement with the recommended conditions. He stated that this particular type of equipment was chosen by the applicants based on safety factors. Hearing no further comments from the audience, Chairman Brandy declared the hearing closed. There being no further discussion, the following action was taken: RESOLUTION NO. 91 -1356 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARROYO GRANDE RECOMMENDING TO THE CITY COUNCIL APPROVAL OF CONDITIONAL USE PERMIT CASE NO. 91 -492, TO ALLOW FOR INSTALLATION OF A PLAY AREA AT AN EXISTING FAST FOOD RESTAURANT, APPLIED FOR BY CARL'S JR. RESTAURANT AT 1590 WEST BRANCH STREET. On motion by Commissioner Boggess, seconded by Commissioner Carr, and by the following roll call vote, to wit: AYES: Commissioners Boggess, Souza, Moore, Groves, Carr and Chairman Brandy NOES: None ABSENT: Commissioner Soto the foregoing Resolution was adopted this 3rd day of December, 1991. CONTINUED PUBLIC HEARING - TENTATIVE TRACT MAP NO. 2074, 250 AND 290 RIDGEVIEW WAY, 250 AND 290 RIDGEVIEW WAY (SALLY WHITE /ED CHADWELL.) Current Planner Spierling reviewed staff report dated December 3, 1991. The applicants have proposed moving the lot line between Ms. White's property and Mr. Chadwell's property and splitting Mr. Chadwell's property into two parcels. The proposed split will be in a flag lot configuration with long driveways to Ridgeview Way. Mr. Spierling advised that there are several major issues. The project needs high pressure water pressure service which is not available at this time. The Parks and Recreation Element of the General Plan indicates that a recreational trail should be provided up Ridgeview Way to the City Limits, which has not been resolved. Also there is a discrepancy is the size of the proposed lots. Staff Advisory Committee recommends that the Planning Commission adopt a resolution denying Tentative Tract 2074. Chairman Brandy re- opened the public hearing. Leonard Lenger, representative for Sally White, spoke in regards to the water elevation, flag lots, and the trail plan. Ed Chadwell, applicant, spoke in regards to flag lots, roads, water pressure, and the equestrian easement. Current Planner Spierling advised of several water booster systems which have been required by the City with the development of subdivisions. Hearing no further comments from the audience, Chairman Brandy declared the hearing closed. After further discussion, the Planning Commission decided to continue Tentative Tract 2074, 250 and 290 Ridgeview Way until February 18, 1992. NON - PUBLIC HEARING - PLANNING COMMISSION DISCUSSION OF NEON SIGNS Director Liberto -Blanck reviewed staff report dated December 3, 1991, on neon signs. Liberto- Blanck recommended that Planning Commission discuss and continue the item to December 17, 1991 instructing staff to return with a Resolution Interpreting when neon signs may be considered and place the item on the City Council's next agenda as an informational item. After a brief discussion, on motion by Commissioner Souza, seconded by Commissioner Carr, and unanimously carried, the neon signs item was continued until December 17, 1991. NON - PUBLIC HEARING - REVIEW OF ACCESS TO 221 E. BRANCH STREET (MARK GODFREY) Director Liberto -Blanck reviewed staff report dated December 3, 1991, regarding review of access to 221 East Branch Street. Liberto -Blanck advised that staff is not aware of any problems with the access. Staff recommends Planning Commission receive and file the report. PLANNING DIRECTOR/PLANNING COMMISSION ITEMS AND COMMENTS January 7, 1992 is tentatively scheduled for a joint meeting with Parking and Traffic Commission. Also, a joint meeting with Parks and Recreation Commission in February. Director Liberto -Blanck informed the Commissioners that Pearl Phinney will be retiring as Planning Commission Secretary as of December 31, 1991.
