PC Minutes 1990-04-17Arroyo Grande Planning Commission April 17, 1990 The Arroyo Grande Planning Commission met in regular session with Chairman Carr presiding. Present are Commissioners Flores, Gallagher,. Soto, Fischer. Absent are Commissioners Moore, and Brandy. Also in attendance are Current Planner Spierling, and Vicki Finucane, Assistant City Attorney. MINUTE APPROVAL Upon hearing no additions or corrections, the minutes of the Planning Commission meeting of January 2, 1990 were approved as prepared on motion by Commissioner Flores, seconded by Commissioner Soto, and unanimously carried. PUBLIC HEARING - VARIANCE CASE NO. 90 -146, SIGN CASE NO. 89 -90, VARIANCE FROM LANDSCAPE REQUIREMENT AROUND SIGN AREA AND NUMBER OF SIGNS PERMI'11r:U AT 610 GRAND AVENUE, ULTRAMAR (BEACON OIL) Current Planner Spierling reviewed Staff Report dated April 17, 1990. The Staff Advisory Committee recommends that the Planning Commission adopt a resolution approving Variance Case No. 90 -146, and adopt a negative declaration and instruct the secretary to file a notice of determination. Upon being assured by the Planning Commmission Clerk that public hearing for Variance Case No. 90 -146 had been duly published and property owners notified, Chairman Carr declared the hearing open. Commissioner Moore entered the meeting at 7:20 p.m. and is now present. Hearing no comments for or against the project, Chairman Carr declared the hearing closed. After a brief discussion the following action was taken: RESOLUTION NO. 90 -1287 A RESOLUTION OF THE PLANNING COlISSION OF THE CITY OF ARROYO GRANDE GRANTING A VARIANCE, CASE NO. 90 -146, APPLIED FOR BY ULTRAMAR (BEACON OIL COMPANY) LOCATED AT 610 GRAND AVENUE, FOR LANDSCAPING REQUIRIIMENT AROUND SIGN AREA AND NUMBER OF SIGNS PERMI ) On motion by Commissioner Soto, seconded by Commissioner Flores, and by the following roll call, to wit: AYES: Commissioners Moore, Flores, Soto, and Gallagher NOES: Chairman Carr and Commissioner Fischer ABSENT: Commissioner Brandy the foregoing resolution was adopted this 17th day of April 1990. PUBLIC HEARING - CONDITIONAL USE PERMIT CASE 89 -465, ARCHITECTURAL REVIEW CASE 89- 436, SECOND RESIDENTIAL UNIT OVER GARAGE AT 250 RIDGEVIEW WAY (JEROME WHITE) Current Planner Spierling reviewed the staff report dated April 17, 1990. 1 Arroyo Grande Planning Commission, 4 -17 -90 The Staff Advisory Committee recommends that the Planning Commission adopt a resolution approving Conditional Use Permit Case 89 -465, adopt a negative declaration and instruct the secretary to file a Notice of Determination, and approve Architectural Review Case 89 -436 by minute motion. Upon being assured by the Planning Commission Clerk that public hearing for Conditional Use Permit Case 89 -465 had been duly published and property owners notified, Chairman Carr declared the hearing open. Ed Chadwel l , 290 Ridgeview Way, representing Sally White spoke in favor of the project. Hearing no further comments for or against the project, Chairman Carr declared the hearing closed. The Planning Commission agreed on the following added condition ( #5): 5. All construction shall utilize fixtures and designs which minimize water usage. Such fixtures and designs shall include, but are not limited to low flow showerheads, water saving toilets, instant water heaters or hot water recirculatory systems and, if landscaped, drip irrigation with drought tolerant landscaping and etc. All water conserving designs or fixtures shall be installed prior to final occupancy. The Staff Advisory Committee recommends that. the .Planning Commission adopt a resolution approving - Parcel Map Case No. 89 -484, adopt a negative declaration and instruct the secretary to file a -Notice of Determination. Upon being assured by the Planning - Commission Clerk that public hearing for Parcel Map Case No. 89 -484 had been duly published and property owners notified, Chairman Carr declared the hearing open. .. JimMcGillis, San Luis Engineering, representative, briefly discussed the project and spoke in favor of the project. Don Abel. spoke in favor of the project on behalf of Marguerite Abel, owner of 580 Cerro Vista Lane; and Cindy Stricker of Century 21 Filer,. provided information about approval of a loan for the project. Anita Gaskil l , 633 Cerro Vista Circle; Bernard Landsman, 579 Newman Drive; Paul Cuellar, 321 S. 8th Street #6, Grover City; Tim and Sherry Storton, 581 2 1'6.9; 170r Arroyo Grande Planning Commission, 4 -17 -90 Newman Drive; and Steve Archulet, 1485 Brighton Avenue, spoke against the project. Hearing no further comments for or against the project, Chairman Carr declared the hearing closed. After a brief discussion, on motion by Commissioner Soto, seconded by Commissioner Gallagher, and unanimously carried, Parcel Map Case No. 89 -484 was continued to May 15, 1990. The applicant agreed to submit a waiver of the time limit. PUBLIC HEARING - PARCEL MAP CASE NO. 89 -488, 345 S. HALCYON ROAD (ARROYO GRANDE HOSPITAL), MERGE FOUR (4) LOTS INTO TWO (2) LOTS IN THE PROFESSIONAL COMMERCIAL ZONE (AMERICAN MEDICAL INTFiTIONAL) Continued to meeting of June 5, 1990 PUBLIC HEARING (CONT.) - TENTATIVE TRACT NO. 983, 139, 141, 143, AND 145 TALLY HO ROAD, RESUBDIVISION OF FOUR (4) EXISTING PARCELS INTO SIX (6) PARCELS (L. C. LAVINE) Contract Planner, John Ashbaugh, reviewed Staff Report dated April 17, 1990. The Staff Advisory Committee recommends that the Planning Commission adopt a resolution denying Tenative Tract Map No983 based on the findings for denial in the staff report dated April 17, 1990. Upon being assured by the Planning Commission Clerk that public hearing for Tentative Tract Map No. 983, had been duly published and property owners notified, Chairman Carr declared the hearing open. JimMcGillis, San Luis Engineering, representing the applicant, stated that they were misinformed regarding the 30 day extension agreement signed by the applicant. L. C. LaVine, developer of Tract 983, stated his complaints regarding incorrect information in regards to the extension, and requested that the 30 day extension be rescinded and a 90 day extension be granted. Current Planner Scott Spierling clarified that the first extension that was granted was an extension of time limits for processing a subdivision under the Subdivision Map Act of California. The Subdivision Map Act requires agencies to process a tentative map within 50 days of the completeness date. He pointed out that we are dealing with two different laws; the Subdivision Map Act requires 50 days and the Permit Streamlining Act is six months and one extension. The first extension was for the Subdivision Map Act and had nothing to do with the Permit Streamlining Act. Chairman Carr stated after reviewing this, he could not see any way that the 90 day extension could replace the first 30 day extension and, in his opinion, the alternatives are for the Commission to deny the application and the application could appeal to the City Council, or set a special hearing to hear this item sometime before the 29th of April. Assistant City Attorney Finucane explained that the law allows one extension up to a period of 90 days, and since the extension granted was only for 30 days, that is really what we have to adhere to. After further discussion the following action was taken: RESOLUTION NO. 90 -1290 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARROYO GRANDE DENYING TENTATIVE TRACT NO. 983 APPLIED FOR BY L. C. PUBLIC HEARING (CONT.) - TENTTATIVE TRACT NO. 1401 (REVISED), HALCYON ROAD AND ALPINE STREET, CREATION OF 3 PROFESSIONAL C 4ME RCIAL LOTS AND A REMAINDER OF 4.86 ACRES (JERRFN JORGENSEN) Current Planner Spierling reviewed the Staff Report dated April 17, 1990. The Staff Advisory Committee recommends that the Planning Commission adopt a resolution approving Tentative Tract No. 1401 (Revised), subject to the findins and conditions in the staff report dated April 17, 1990, adopt a negative declaration with mitigation measures, and instruct the secretary to file a Notice of Determination Upon being assured by the Planning Commission Clerk that public hearing for Tentative Tract NO. 1401 (Revised), had been duly published and property owners notified, Chairman Carr declared the hearing open. Dr. Jerren Jorgensen, applicant, spoke in favor of the revised tentative tract map. Hearing no further comments for or against the project, Chairman Carr declared the hearing closed. After a brief discussion the following action was taken: RESOLUTION NO. 90 -1291 A RESOLUTION OF THE PLANNING C OMISSION OF THE CITY OF ARROYO GRANDE APPROVING TENTATIVE TRACT MAP NO. 1401 LOCATED BETWEEN SOUTH HALCYON ROAD AND SOUTH ALPINE STREET APPLIED FOR BY JERREN JORGENSEN FOR CREATION OF THREE PROFESSIONAL COMMERCIAL LOTS AND A REMAINDER, ADOPTING A NEGATIVE DECLARATION AND INSTRUCTING THE SECRETARY TO FILE A NOTICE OF DETERMINATION On motion by Commissioner Soto, seconded by Commissioner Gallagher, and by the following roll call; to wit: AYES: Commissioners Moore, Fischer, Flores, Soto, Gallagher, and Chairman Carr NOES: None ABSENT: Commissioner Brandy the foregoing resolution was adopted this 17th day of April, 1990. ARCHITECTURAL REVIEW CASE NO. 89 -439, 138 SHORT STREET, EXPANSION OF AN EXISTING NON- CONFORMING USE (BILLIE SWIGERT) Current Planner Spierling reviewed the staff report dated April 17, 1990. He noted that this application has been before the Commission before and a Conditional Use Permit was denied based on the General Plan. The applicant appealed the denial to the City Council and, after review, the Council has directed staff to look at the new General Plan,and look possibly into the new Zoning Ordinance in a way in which historic residences such as this could be added on to and still be in conformance with the General Plan. In the meantime, the Council directed that the architectural review come back to the Planning Commission for review and to make recommendations to the Council. It is staff's recommendation that the Planning Commission recommend that the City Council require the applicant to: (1) Use wood siding and casement type windows in the construction of the addition. After a brief discussion, on motion by Commissioner Soto, seconded by Commissioner Gallagher, and unanimously carried, Architectural Review Case 89 -439 was approved, subject to the condition noted above. 4 17 1' 172° Arroyo Grande Planning Commission, 4 -17 -90 ADJOURNMENT There being no further business before the Commission, the meeting was adjourned by Chairman Carr at 11:45 P.M.
