Arroyo Grande Planning Commission
February 20 1990
The Arroyo Grande Planning Commission rrret in regular session with Chairman
Carr presiding. Present are Commissioners Flores, Soto, Gallagher, and Brandy.
Absent are Commissioners Moore and Fischer. Also in attendance are Planning
Director Liberto - Blanck and Current Planner Spierling.
PUBLIC HEARING - CONDITIONAL USE PERMIT 89 -467, ARCHITECTURAL REVIEW CASE 89-
441, 543 IDE STREET, SECOND RESIDENTIAL UNIT (ROBERT TAYLOR)
Current Planner Spierling reviewed the staff report dated February 20,
1990. The Staff Advisory Committee recommends that the Planning Commission adopt
;_i resolution approving Conditional Use Permit 89.467, adopt a Negative
Declaration, and instruct the secretary to file a Notice of Determination. It
was also recommended that Architectural Review Case 89-441 be approved by minute
motion.
Upon being assured by the Planning Commission Clerk that public hearing
for Use Permit Case No. 89 -467 had been duly published and property owner::
notified, Chairman Carr declared the hearing open.
Ken Martin, American House Moving and Demolition, representative of the
applicant, spoke in favor of the Use Permit being granted.
John Cramer, 211 Garden Street, spoke against construction of a second
residential unit in the area.
COMMISSIONER MOORE ENTERED THE MEETING AT 7 :20 P.M. AND IS NOW PRESENT.
Hearing no further comments for or against the proposed project, Chairman
Carr declared the hearing closed.
COMMISSIONER FISCHER ENTERED THE MEETING AT 7:28 P.M. AND IS NOW PRESENT.
Commissioner Flores recommended adoption of the draft resolution with
conditions outlined in the Staff Report dated February 20, 1990, and with the
added condition that the setback be 18 -1/2 feet from the creek.
After a brief discussion the following action was taken:
RESOLUTION NO. 90 -1271
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF ARROYO GRANDE APPROVING CONDITIONAL
USE PERMIT CASE NO. 89 -467, APPLIED FOR BY
ROBERT TAYLOR, LOCATED AT 543 IDE STREET TO
CONSTRUCT A SECOND RESIDENTIAL UNIT, ADOPTING
A NEGATIVE DECLARATION AND INSTRUCTING THE
SECRETARY TO FILE A NOTICE OF DETERMINATION
On motion by Commissioner Flores, seconded by Commissioner Brandy, and by
the following roll call; to wit:
AYES: Commissioners Flores, Soto, Gallagher, Brandy, and Chairman Carr
NOES: Commissioner Moore
ABSTAIN: Commissioner Fischer
ABSENT: None
the foregoing resolution was adopted this 20th day of February 1990.
On motion by Commissioner Flores, seconded by Commissioner Brandy, and
carried with one abstention and one "rio" vote, Architectural Review Case 89 --
441 was approved.
PUBLIC HEARING - CONDITIONAL USE PERMIT NO. 89 -466, ARCHITECTURAL REVIEW CASE
89 -439, EXPANSION OF A NON - CONFORMING USE, 138 SHORT STREET (BILLIE SWIGERT)
Current Planner Scott Spierling reviewed the staff report dated February
20, 1990, and stated the Staff Advisory Committee recommends that the Planning
Commission adopt a resolution denying Conditional Use Permit 89 -466, pursuant
to the findings for denial as stated in the staff report dated February 20,
1990, and Architectural Review Case No. 89 -439 should then be denied by minute
motion.

Upon being assured by the Planning Commission Clerk that public hearincr
for Use Permit Case No. 89 --466 had been duly published and property owners
notified, Chairman Carr declared the hearing open.
Billie Swigert, 127 Nelson Street, property owner of 138 Short Street,
spoke in favor of this project. She commented that because the lot was zoned
CBD, the residence became a non- conforming use, and stated she was opposed to
the zoning.
Planning Director Doreen Liberto- Blanck stated that in the updated General
Plan, the City will be permitting some residential uses, however, those uses
will. be predominately for apartments in conjunction with commercial uses, and
even under the new wording of the General Plan this lot still would be a legal
non-conforming use. •
Hearing no further comments for or against the project, Chairman Carr
declared the hearing closed.
After a brief discussion the following action was taken:

unanimously carried, Architectural Review Case 89 -439 was denied.
PUBLIC HEARING - VARIANCE CASE NO. 90 -145, 288 AND 293 LA CRESTA DRIVE, OAKCREST
ESTATES, VARIANCE TO EXCEED HEIGHT LIMIT OF WALL FROM 3 FEET TO 6 FEET
Current Planner Scott Spierling reviewed the staff report dated February
20, 1990, and stated the Staff Advisory Committee recommends that the Planning
Commission adopt a resolution approving Variance Case No. 90 -145, adopt a
Negative Declaration and instruct the secretary to file a Notice of
Determination.
Upon being assured by the Planning Commission Clerk that public hearing
for Variance Case No. 90 -145 had been duly published and property owners
notified, Chairman Carr declared the hearing open.
Ed Dorfman, 390 Platino Lane, spoke in favor of the variance. He referred
to his letter to the Planning Commission, dated January 17, 1990, and expressed
his reasons for the height of the wall and the materials to construct the wall.
Paul Rainey, 1153 Huasna Road, spoke in opposition to the Variance being
granted.
Hearing no further comments for or against the project, Chairman Carr
declared the hearing closed.

ADOPTING A NEGATIVE DECLARATION AND

OF DETERMINATION

PUBLIC HEARING - PARCEL MAP CASE NO 89 -482, 1040 MAPLE STREET, SUBDIVISION TO
CREATE TWO LOTS ON A 22,830 SQ. FT. PARCEL. PROPOSED GROSS LOTS SIZES ARE 9,900
SQ. FT. AND 12,930 SQ. FT. (ALEX J. RAMEY)
Current Planner Scott Spierling reviewed the staff report dated February
20, 1990, and stated the Staff Advisory Committee recommends the Planning
Commission adopt a resolution denying Parcel Map No. 89-492, based upon water
resources, unless the applicant agrees in writing to waive the time limits for
processing projects imposed by the Subdivision Map Fact. He also stated that if
the applicant agrees in writing, then the Staff Advisory Committee recommends
that this item be continued to the Planning Commission meeting of April 17,
1990, by which time it is expected that a City Water Policy will be adopted.
Upon being assured by the Planning Commission Clerk that public hearing
for Parcel Map Case No. 89 -482 had been duly published and property owners
notified, Chairmari Carr declared the hearing open.
Terry Orton, Westland Engineering, representing the applicant stated they
were aware that water would be an issue. He stated the applicant agrees on the
addition of the following mitigation measures: Installing 1:) water saving
toilets; new homes would be installed with water saving devices; and retrofitting
existing horses with both toilets and showers.
Commissioner Soto questioned Mr. Orton about signing a time limit waiver
until the Planning Commission finds out what the City's water policy is going
to be. Mr. Orton stated that they would agree to sign a time limit waiver if
appropriate. Planning Director Doreen Liberto-Blanck stated that the applicant
has to be the one to agree to sign the time limit waiver.
Byron Grant, Highland Road, spoke in favor of the project.
Hearing no further comments for or against the project, Chairman Carr
declared the hearing closed.
On motion by Commissioner Soto, seconded by Commissioner Gallagher, and
unanimously carried, Parcel Map Case No. 90 -482 was continued to April 17, 1990.
The applicant agreed to submit a waiver of the time limit.
PUBLIC HEARING - SIGN PERMIT CASE NO. 89 -97, ARCHITECTURAL REVIEW CASE 89 -432,
PLANNED SIGN PROGRAM, COMMERCIAL RETAIL STRUCTURE, BLDG. 4, VILLAGE CREEK PLAZA
IV, STATION WAY (MID COAST LAND COMPANY)
Current Planner Scott Spierling reviewed the staff report dated February
20, 1990, and stated the Staff Advisory Committee recommends that the Planning
Commission approve Architectural Review Case No. 89 -432 by minute motion, subject
to the attached findings and conditions of approval; and adopt a resolution
approving Planned Sign Program 90 -97, subject to the findings and conditions as
stated in the staff report dated February 20, 1990.
Upon being assured by the Planning Commission Clerk that public hearing
for Sign Permit Case No. 89 -97, had been duly published and property owners
notified, Chairman Carr declared the hearing open.

RESOLUTION NO. 90 -1274
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF ARROYO GRANDE APPROVING PLANNED
SIGN PROGRAM, CASE NO. 90 -97, APPLIED FOR BY
MID COAST LAND COMPANY (VILLAGE CREEK PLAZA IV),
AT STATION WAY AND FAIR OAKS AVENUE
On motion by Commissioner Soto, seconded by Commissioner Flores, and by
the following roll call; to wit:
AYES: Commissioners Flores, Soto, Moore, Gallagher, Brandy, Fischer, and
Chairman Carr

the foregoing resolution was adopted this 20th day of February 1990.
On motion by Commissioner Brandy, seconded by Commissioner Fischer, and
unanimously carried, Architectural Review Case 89 -432 was approved with the two
added conditions as listed below:
1. The applicant shall provide a water conservation program to
be utilized by the project and approved by the Public Works
Director, all water conservation devices and fixtures shall
be installed prior to final occupancy.
2. If found feasible by the Public Works Director and Planning
Director, the applicant shall provide oil water separation
devices on site, a plan shall be submitted prior to the
building permit, and devices installed prior to final
occupancy.
ARCHITECTURAL REVIEW CASE NO. 89-438, 1255 GRAND AVENUE, INSTALLATION OF
AUTOMATIC TELLER MACHINE (SECURITY PACIFIC NATIONAL BANK)
Current Planner Scott Spierling reviewed the staff report dated February
20, 1990, and indicated that the Staff Advisory Committee recommends that the
Planning Commission approve the proposed architectural review by minute motion
subject to the findings and conditions as stated in the staff report.
After discussion, on motion by Commissioner Soto, seconded by Commissioner
Fischer, and unanimously carried, Architectural Review Case No. 89 -438 was
approved subject to the findings and conditions as listed in the staff report
dated February 20, 1990.
PUBLIC HEARING (CONTINUED), PARCEL MAP CASE NO. 89-483, 1131 FAIR OAKS AVENUE,
LOT SPLIT TO CREATE TWO LOTS FROM A 16,304 SQ. FT. PARCEL (KIRBY GORDON)
Contract. Planner John Ashbaugh reviewed the staff report dated February
20, 1990, and provided the Planning Commission with additional information
regarding consistency with the general plan, drainage, traffic and aesthetics.
The Staff Advisory Committee recommends that the Planning Commission deny this
project, based ors the discussions of general plan density issues in the staff
report dated January 16, 1990.
Upon being assured by the Planning Commission Clerk that public hearing
for Parcel Map Case No. 89-483 had been duly published and property owners
notified, Chairman Carr reopened the hearing open.
Noel Higa, Engineering Development Associates, representative, informed
the Planning Commission that the grading plan was modified based on
recommendations at the meeting of January 16, 1990. He expressed his objections
to the finding that the project was inconsistent with the general plan, and
stated that the lots to be created are compatible with the area.
Veniona Kellerman, 1129 Fair Oaks Avenue, and Augustine Leyva, 1147 Fair
Oaks Avenue, stated they are opposed to the project.

Kirby Gordon, 401 Indio Drive, Pismo Beach, applicant, spoke in favor of
the project.
Hearing no further comments for or against the project, Chairman Carr
declared the hearing closed.

The Planning Commission denied Parcel Map 89 -483 with the following
finding:
1. The proposed map, design and improvement of this
subdivision is not consistent with the General Plan

is Low Density Residential 0.2 - 4.5 dwelling units per
acre, and the proposed subdivision would result in a
density of 5.35 dwelling units per acre.
