PC Minutes 1987-08-04Arroyo Grande Planning man August 4, 1987 The Arroyo Grande Planning Commission met in regular session with Vice Chairman Gerrish presiding. Present are Commissioners Flores, -Soto, Olsen, and Moore. Commissioner Boggess and Chairman Carr are absent. Planning Director Rogoway is also in attendance. MINUTE APPROVAL Upon hearing no additions or corrections, the minutes of the regular meetings of July 7 and July 21, 1987 were approved as submitted on motion by Commissioner Soto, seconded by Commissioner Flores, and unanimously carried. PUBLIC HEARING - USE PERMIT CASE NO. 87 -425, TO ALLOW FOR AN INVITATIONAL BED AND BREAKFAST INN, 1190 W. BRANCH STREET IN THE "P-D" PLANNED DEVELOPMENT DISTRICT. (WESLEY AND DONNA CARISON). Planning Director Rogoway pointed out that the property in question has been carved out of the Rancho Grande Development with the original ranch house on separate property from the development. He stated it is the intent of the applicants to allow guests by invitation only. The structure has two guest bedrooms and seating areas; the floor plan of the house shows that it can be separated into two living units. Mr. Rogoway advised that staff has made an investigation of the initial environmental conditions and finds there would be no environmental effect. He further advised that the property is zoned "P -D" Planned Development and, therefore, the matter must go before the Planning Commission and City Council Mr. Rogoway stated that if the Commission accepts the staff recommendations, it is also recommended that a Negative Declaration be issued. Upon being assured by the Planning Commission Secretary that public hearing for Use Permit Case No. 87 -425 had been duly published and property owners notified, Vice Chairman Gerrish declared the hearing open. Mr. Wesley Carlson, owner of the property, spoke in favor of the Use Permit being granted. He briefly explained how an invitational bed and breakfast stay operates, pointing out it is a low -keyed operation and not a commercial type venture. Hearing no further comments for or against the proposed Use Permit, Vice Chairman Gerrish declared the hearing closed. The Commmission approved the issuance of a Negative Declaration and, after a brief discussion, the following action was taken: RESOLUTION NO. 87-1127, A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARROYO GRANDE RECOMMENDING APPROVAL OF A USE PERMIT, CASE NO. 87 -425, APPLIED FOR BY WESLEY - AND DONNA CARLSON. On motion by Commissioner Soto, seconded by Commissioner Olsen, and by the following roll call vote, to wit: AYES: Congnissioners Flores, Soto, Olsen, Moore and Vice Chairman Gerrish NOES: None ABSENT: Commissioner Boggess and Chairman Carr the foregoing Resolution was adopted this 4th day of August 1987. PUBLIC HEARING - REZONING CASE NO. 87 -201, PROPOSED ZONE CHANGE FROM "R -1" SINGLE FAMILY RESIDENTIAL DLSTRICT TO "R -1 -D" SINGLE FAMILY RESIDENTIAL DISTRICT WITH A DESIGN OVERLAY, HIILCRFST DRIVE AREA. (ARROYO GRANDE PLANNING COMMISSION). Planning Director Rogoway commented that, as a result of urging from a number of property owners in the Hillerest Drive /Newport Avenue area, a new alternative to the zoning previously considered by the Planning Commission has been suggested. He stated that the previously proposed rezoning called for the area to be changed from an R -1 Single Family Residential District to an RA -B2 -D District, with the -D providing certain alternate standards for the development of property in this area However, because of the number of non- conformities created by the proposed rezoning, the neighborhood felt another alternative to the RA zoning should be considered. Mr. Rogoway stated it is now proposed that consideration be given to change the zoning designation from R -1 Single Family Residential to R -1 -D, with the -D specifying alternative standards for the development of property including the - following: (a) A further restriction on height of construction of main building to protect the view shed of existing homes behind the construction site; (b) Increasing the minimum lot size from 6,000 sq. ft. to 12,000 sq. ft. for residential uses, and 20,000 sq. ft. for institutional uses; 363 364 Arroyo Grande Planning Qmnis ion, 8 -4-87 Page 2 (c) Increasing the front yard setback on lots fronting the north side of Hillcrest Drive from 20 ft. to 50 ft.; and (d) A provision protecting non - conforming structures which are damaged or destroyed, and which are located in front yard setback areas to be allowed to reconstruct at the same location. Mr. Rogoway pointed out that the new proposal eliminates most of the non - conformities created by the previous proposal. At the same time, it takes care of the primary concerns expressed by the property owners within the neighborhood and prohibits the creation of structures or new lots that would be contrary to the intent and desires expressed by the neighborhood residents. Upon being assured by the Planning Commission Secretary that public hearing for Rezoning Case No. 87 -201 had been duly published and property owners notified,_ Vice Chairman Gerrish declared the hearing open. Don Dennison, 1353 Hillcrest Drive; Bob Mitchell, 1360 Hillcrest Drive; Kirk Glen, 1315 Hillcrest Drive, Joe Zdana, 1341 Hillcrest Drive; Richard Duffin, Newport Avenue; Sam Stagg, 1353 Sierra Drive; Glen Holzer, 1485 Hillcrest Drive; and Mary Evelhock, 1450 Hillcrest Drive, spoke in favor of the proposed zone change. Kenneth Levine, 1425 Hillcrest Drive; Nancy Sipes, 1410 Hillcrest Drive; and Leonard Lenger, 1203 Carpenter Canyon Road, spoke in opposition to the proposed zone change. Hearing no further comments from the audience for or against . the . proposed zone change, Vice Chairman Gerrish declared the hearing closed. Commissioner Soto commented that the majority of the neighborhood seems to be in favor of the proposed zone change, including Colleen Phelan, 1473 Hillcrest Drive, as stated in her letter to the Planning Commission Chairman dated July 31, 1987. Vice Chairman Gerrish referred to other ordinances that have been adopted with " -D" Overlays. He commented that Ruth Ann Way and Montego Streets have such ordinances restricting heights. Also, there is a " -D" ordinance that restricts lot size on Branch Mill Road. After a brief discussion, the following action was taken: RESOLUTION NO. 87 -1128 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARROYO GRANDE RECOMMENDING TO THE CITY COUNCIL APPROVAL OF ZONE CHANGE APPLICATION NO. 87 -201, TO REZONE CERTAIN AREAS OF THE HILL CREST EST DRIVE/NEWPORT AVENUE PROPERTIES On motion by Commissioner Flores, seconded by Commissioner Olsen, and by the following roll call vote, to wit: AYES: Commissioners Flores, Soto, Olsen, Moore and Vice Chairman Gerrish NOES: None ABSENT: Commissioner Boggess and Chairman Carr the foregoing resolution was adopted this 4th day of August 1987. Included with the Commission's action was the approval of a Negative Declaration on the rezoning. ATTEST: Planning Director Rogoway advised that this matter will be before the City Council in three weeks. PUBLIC HEARING - REZONING CASE . NO. 87 -198, RANCHO GRANDE, AMENDMENT TO PLANNED DEVELOPMENT ORDINANCE 186 C.S. (OTISE, INC). Planning Director Rogoway advised that this matter is being continued at the request of the applicant.
