HomeMy WebLinkAboutPC Minutes 1985-10-15i 1 ARROYO GRANDE PLANNING COMMISSION October 15, 1985 The Arroyo Grande Planning Commission met in regular session with Chairman Gerrish presiding. Present are Commissioners Carr, Moore, Soto and Flores. Commissioners Olsen and Boggess are absent. Planning Director Eisner is also in attendance. MINUTE APPROVAL Chairman Gerrish corrected the minutes of the Planning Coin,nission meeting of October 1, 1985, Page 3, Paragraph 2, amending Condition No. 1 to read: "Landscaping plan to be submitted to the Parks and Recreation Department for approval prior to issuance of a building permit. Said landscaping plan to include the eastern slope above the property." Upon hearing no further additions or corrections, the minutes of the regular meeting of October 1, 1985 was approved by the Chairman as corrected. REVIEW OF NAPA AUTO PARIS STORE PARKING REQUIREMENTS, 951 GRAND AVENUE. (SERVICE AUTO PARIS, ARCHITEC111RAL REVIEW CASE NO. 84 Planning Director Eisner requested that this matter be continued for two weeks. He noted that the manager of Napa Auto Parts has indicated he will have the necessary information available at that time. PUBLIC HEARING - LOT SPLIT CASE NO. 85 -412, 1300 HILLCREST DRIVE, IN THE "R - 1" SINGLE FAMILY RESIDENTIAL DISTRICT. (SAN LUIS ENGINEERING, AGENTS FOR JOHN VERMAZEN). Planning Director Eisner reviewed the staff report dated October 1, 1985. He called attention to the fact that City Council policy has been to discourage flag lots whenever an alternative reasonable use of the property exists. Upon being assured by the Planning Secretary that public hearing for Lot Split Case No. 85 -412 had been duly published and property owners notified, Chairman Gerrish declared the hearing open. Dave Rhiner, San Luis Engineering, representing the applicants, spoke in favor of the proposed lot split. He explained the purpose for the requested division is to provide a lot of about 7,500 sq. ft. for a hamesite for Mr.. Vermazen's daughter.. He pointed out that there is a nice Oak grove on the property, and they have taken care to preserve them. They have found they can preserve all but one of the Oak trees on Hillerest Drive. Michael Johnston and Julie Johnston, Nipomo, applicants, spoke in favor of the proposed lot split. Hearing no further comments for or against the proposed lot split, Chairman Gerrish declared the hearing closed. Commissioner Carr questioned the potential damage to the Oak trees when the driveway is put in, noting that it looks like the driveway will go over the canopy of the Oak trees. Dave Rhiner, San Luis Engineering, advised that the area of the driveway is really level and there won't have to be any large cuts going in there. Planning Director Eisner advised that a grading and drainage plan showing the trees will be required for review and approval by the Public Works Department. Corm - issioner Carr stated he feels strongly about lot splits and how we determine the buildable space on them and for that reason, he would not be able to support this. After further discussion, Lot Split Case No. 85 -412 was approved on motion by Corrniss.ioner Flores, seconded by Commissioner Moore, subject to the 5 conditions listed in the staff report, dated October 1, 1985, with the finding that the proposed lot split is consistent with the General Plan and Zoning. Motion carried by a 3 to 2 vote. PUBLIC HEARING - LOT SPLIT CASE NO. 85 - 415, PROPERTY LOCATED ON HIGHWAY 227 BETWEEN PASEO STREET AND CORBETT CANYON ROAD, IN THE "RA-B3 RESIDENTIAL AGRICULTURAL DISTRICT. (SAN LUIS ENGINEERING, AGENTS FOR L. E. GUIDOTTI). Planning Director Eisner advised this matter is being continued pending submission of an amended map. 217 PUBLIC HEARING - USE PERMIT CASE NO. 85 -400, 5 UNIT PROFESSIONAL OFFICE CONDOMINIUM CONVERSION, 1118 GRAND AVENUE IN THE "H-S" HIGHWAY SERVICE DISTRICT. (ROHLOFF ENGINEERING, AGENTS FOR APB ASSOCIATES ). Planning Director Eisner noted this is a two -part public hearing; first is a use permit associated with condominiums, and the second is a tract map for an air space condominium. He advised that the building is under construction and was previously approved under the architectural review process. Mr. Eisner further advised that all of the conditions ttat were previously established with the architectural review have either been met or are in the process of being met. The application has been reviewed by the Staff Advisory Committee and is recommended to the Con without conditions. 218 Arroyo Grande Planning Uarnis 10 -15-85 Page 2 Upon being assured by the Planning Secretary that public hearing for Use Permit Case No. 85 -400 and Tentative ell-act Map No. 1345 had been duly published and property owners notified, Chairman Gerrish declared the hearing open. Larry Rohloff, Rohloff Engineering, representing the applicants, noted that earlier approval by the City was subject to conversion to condominiums at a later date. Hearing no further comments for or against the proposed use permit and tract map, Cllair!Tan Gerrish declared the hearing closed. After a brief discussion, the following action was taken: RESOLUTION NO. 85 -1053 A RESOLUTION OF THE PLANNING COPdNQSSION OF TIM CITY OF ARROYO GRANDE APPROVING USE PERMIT CASE NO. 85 -400, APPLIED FOR BY ROHLOFF ENGINEERING, AGENTS FOR APB ASSOCIATES, FOR A FIVE UNIT OFFICE CONDOMINIUM AT 1118 GRAND AVENUE IN THE "H-S" HIGHWAY SERVICE DISTRICT. On motion by Commissioner Carr, seconded by Commissioner Soto, and by the following roll call vote, to wit: AYES: Commissioners Moore, Flores, Carr, Soto and Chairman Gerrish NOES: None ABSENT: Commissioners Boggess and Olsen the foregoing Resolution was adopted this 15th day of October 1985. RESOLUTION NO. 85 -1059 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARROYO GRANDE APPROVING TENTATIVE TRACT MAP NO. 1345, FILED BY ROHLOFF ENGINEERING, AGENTS FOR APB ASSOCIATES, AND REFERRAL TO THE CITY COUNCIL FOR INFORMATIONAL PURPOSES ONLY. On motion by Commissioner Carr, seconded by Commissioner Soto, and by the following roll call vote, to wit: AYES: Commissioners Moore, Flores, Carr, Soto and Chairman Gerrish NOES: None ABSENT: Commissioners Boggess and Olsen • the foregoing Resolution was adopted this 15th day of October 1985. PUBLIC HEARING - PROPOSED AMENDMENT TO THE CIRCULATION ELECT OF THE GENERAL PLAN. Planning Director Eisner briefly outlined the proposed amendment. He pointed out that staff has tried to reflect as clearly as possible the stated goals and objectives and, secondly, staff has been concerned that we follow and meet the requirements of the guidelines set forth by the Office of Planning and Research. He noted that the document before the Commission is intended to be a working draft; the Commission may wish to take the matter to a study session or, if the Commission feels comfortable enough with it, you can make recommendations and take it on to the City CouneiL Upon being assured by the Planning Commission Secretary that public hearing for the proposed amendment to the Carculation Element of the General Plan had been duly published and posted, Chairman Gerrish declared the hearing open. Hearing no cor►unents for or against the proposed amendment, Chairman Gerrish declared the hearing closed. Commissioner Soto stated he would like to see the matter go to a study session on October 29th since he has not yet had a chance to read the entire document. Commissioner Garr weed to the study session, noting that two Commissioners are absent tonight and he felt they should have an opportunity to be involved with the amendment before it goes forward. The other Conxr>issioners agreed that the matter should go to the study session on October 29th. After further discussion, Chairman Gerrish continued the public hearing to the first meeting in November and set the matter for the study session of October 29, 1985. PUBLIC HEARING - CPA 85-4, PROPOSED AMENDMENT TO THE GENERAL PLAN MAP 10' MODIFY PROPERTY FROM HEAVY COMMERCIAL/LIGHT INDUSTRIAL DESIGNATION TO LOW DENSITY RESIDENTIAL DESIGNATION (.2 10 4.5 DWELLING UNITS PER ACRE), JUNIPER AND POPLAR STREET AREA. Planning Director Eisner advised this matter is being continued to the next meeting of November 5, 1985, and would be on the agenda for the Connission's study session of October 29, 1985. 1 1 Arroyo Grande P1annirg Cr;mssion, 10 -15-85 Page 3 PUBLIC HEARING - ABATEMENT OF PUBLIC NUISANCE AT 532 AND 540 E. BRANCH ST?'tEET TO REMOVE AUTOI'1OBILES DI VARIOUS STATES OF DISREPAIR FROM FRONT YARDS. Planning Director Eisner reported that there are two properties involved regarding numerous automobiles in various states of disrepair located in the front and side yards. He advised that the resident at 532 E. Branch has removed some of the vehicles, but there has been no response from 540 E. Branch whatsoever. He noted that the matter will be brought to the City Council under the Nuisance Abatement ordinance and is being reported to the Planning Commission at this time for information, and also so that the Commission will be aware of the City's enforcement program. REVIEW OF VILLAGE CREEK PLAZA PROJECT, STATION WAY AT TRAFFIC WAY. Planning Director Eisner advised that with the approval of the Architectural. Review and the Use Permit on Village Creek Plaza there was a condition that the landscape design be brought back for the Commission's review and approval. The landscape architect is now prepared to review that material with the Commission. He noted there are some necessary modifications to the plan, which have been reviewed at staff level, however, because of the nature of the project, staff felt it was important enough to come back to the Commission. Carol Florence, Oasis Associates, Landscape Architects, referred to a copy of the conceptual plan approved by the City in February. She noted there have been some refinements of the site plan as well as the planting and irrigation plan. She stated that at the present time the applicants are only asking for building, and grading permits for two of the buildings; Buildings A and B, however, the plan that was approved also included building C D and E. She further stated that vehicle access has changed from the original plan. The original concept was to minimize the impact of this parking since it is quite large. We had the ability to lower this entire section wherein if you are standing or driving on 11.affc Way you are not looking over the tops of the cars. Some other things that were added is that a new planting island in the center of the parking lot has been established. She noted that the plan has been reviewed by the Parks and Recreation Department and signed by Parks and Recreation Director Keisler. Regarding the creek bank, Ms. Florence stated they will be cleaning up the azea, and will be retaining all of the existing Cottonwoods. She stated they do have a Fish and Game permit. Also, City staff has required that they extend the storm drain into the flow 12ne;, and the applicants are requesting at the present time to get a permit to complete this partEClar work prior to the end of this month. Chairman Gerrish inquired if the movement in the parking lot has affected the siuniber of parking spaces originally approved. Ms. Florence advised that 277 parking spaces are required and they are providing 278 spaces. Keith Gurnee, Richmond, Rossi and Montgomery, representing the applicants, pointed out what they are looking for is a reconmrendation of the issues that Carol has presented, which are minor differences between the original approval and where we are now. He asked that the Planning Commission acknowledge that those changes are taking place and that they still meet with the Commission's approval. He stated that, ,as: he understands it, the conditions of approval are being met, and there are three dedications yet to be made. Planning Director Eisner noted there are a couple of other issues. When the Om was originally approved there were some areas where sidewalks were shown and there was an agreement that it would be done in the Village style, which is exposed aggregate with red tile. However, when the final plan was done there were some 4 foot sidewalks in there because of the narrowness of the space. He suggested eliminating the 4 ft. sidewalks and have people cross in the crosswalks to the other side where standard sidewalks can be provided. After considerable discussion, on motion by Commissioner Moore, seconded by Commissioner Carr, and unanimously carried, the Planning Commission approved the detailed presentation and found it consistent, with minor modifications, with the conceptual plan previously approved by the Planning Commission. Commissioner Carr stated he would like to have this same type of review again when the rest of the property is developed. REQUEST FOR INTERPRETATION Planning Director Eisner stated he received a request from a Florist Shop in town to sell gift arrangements which would include a bottle of wine. Mr. Eisner pointed out that off - sale liquor does require a Use Permit, and the definition that we have of off -sale liquor is grocery store, liquor store, etc, and the issue came up if this request constitutes off -sale liquor. He further noted that the ABC material lists this as a separate category. Commissioner Soto stated, in his opinion, all ABC controlled establishments should be controlled by a Use permit. Chairman Gerrish agreed that any off -sale of alcoholic beverages should require a Use Permit. After further discussion, on motion by Commissioner Carr, seconded by Commissioner Flores, and carried with one abstention, determining that the sale of alcoholic beverages associated with flower shops require a Use Permit. 2: 6' Arroyo Grande Planning °o mission, 10-15 -85 COMMUNICATIONS Planning Director Eisner referred to the recent League of California Cities meeting held last week. He commented he had attended a very interesting seminar having to do with court law and the General Plan dealing with subdivision law and growth management. He stated, from his standpoint, a couple of things became very clear in tezms of what the courts are doing; they are putting additional credence on the General Plan the measure of what Cities do; was the action taken in view of the Qty's adopted General Plan, and is that General Plan adequate? The judge views "adequate" as being internally consistent - all 7 elements. Also, in making decisions related to both the General Plan and zoning, it is essential that the procedures include findings; that they be specific findings oriented towards the specific case. He emphasized it is essential that the Comrission develop findings to go with whatever recommendations they make.
