ARROYO GRANDE PLANNING COMMISSION
February 15, 1983
The Arroyo Grande Planning Commission met in regular session with Chairman
Gerrish presiding. Present are Commissioners Carr, Cole, Moore, Moots and
Pilkington. Commissioner Benhardt is absent. Planning Director Hays is also
in attendance.
MINUTE APPROVAL
On motion by Commissioner Cole, seconded by Commissioner Carr, and unanimously
carried, the minutes of the regular meeting of January 18, 1983 were approved as
prepared.
REQUEST FOR ONE YEAR EXTENSION - PARCEL MAP NO. AG 81 -53, LOT SPLIT CASE NO.
81 -348, 1078 MAPLE STREET. (GARING, TAYLOR & ASSOC., INC.)
Planning Director Hays advised that the applicant is requesting an additional
one year time extension in which to file the final map. He noted that this will
be the last extension that can be granted on this parcel map. Commissioner
Moore stated he has no objections to the request, but would abstain because the
property in question is located in back of his house.
There being no further discussion, a one year time extension was granted
on Parcel. Map No. AG81 -53 on motion by Commissioner'Cole, seconded by
Commissioner Pilkington, motion carried with Commissioner Moore abstaining.
REVIEW COMMITTEE - ACTION - ARCHITECTURAL REVIEW CASE NO. 83 -268, PROPOSED OFFICE
BUILDING IN -THE "H -S" HIGHWAY SERVICE DISTRICT, 1248 GRAND AVENUE. (DON AND
BETTY MC HANEY).
Planning Director Hays briefly reviewed the plans for the new office
building, noting that the existing building would be moved to another location
on the property and the new two story office building would be constructed
in the approximate location of the existing building. He further noted that
40 on -site parking spaces are being provided. He stated that the Architectural
Review Committee - - reviewed the proposed development at their meeting of February
9, 1983 and are recommending approval as per plans on file.
After a brief_ discussion,. Architectural Committee Action, dated February
9, 1983 was approved on motion by Commissioner Moots, seconded by Commissioner
Cole, and unanimously carried.
PUBLIC HEARING.- VARIANCE CASE NO. 83 -90, TO ALLOW ERECTION OF A 5 FT. FENCE
IN THE FRONT YARD SETBACK, TRACT NO. 1000, 250 SO. ELM STREET. (ASPEN VILLAGE
INVESTORS).
Planning - Director Hays advised that the applicant is requesting a Variance
to place a perimeter fence in the front yard setback of a condominium project
now under construction. He stated that the proposed fence would have 6 ft.
high support posts with a wrought iron type configur_a.tion.between the posts
on top of a 2 -1/2 ft. block. He noted that a Variance is needed to place
this within the setback area, and the proposed design. of the fence would not
be detrimental to the design of the overall project.
Upon being assured by Planning Director Hays that Variance Case No.. 83 -90
had been duly published and property owners notified, Chairman Gerrish declared
the hearing open.
Mr. Kirby Gordon, 260 Coral Court, Pismo Beach, one of the applicants,
stated that the purpose of the 2 -1/2 ft. block wall is to partially retain
the dirt that is along the front because of the grading plan. He also noted
that the stucco on the wall will be the same color as the stucco on the
project.
Upon hearing no further comments for or against the proposed Variance,
Chairman Gerrish declared the hearing closed, and the following action was
taken:

With regard to architectural review of the project, after a brief
discussion, on motion by Commissioner Carr, seconded by Commissioner Cole,
and unanimously carried, Architectural Review Case No. 83 -267 was approved
as recommended by the Architectural Review Committee in their report dated
February 9, 1983.
PUBLIC HEARING - LOT SPLIT CASE NO. 83 -378 - LOT LINE ADJUSTMENT, TRACT 1056,
SO. ELM STREET. (JOHN WYNN)
Planning Director Hays reviewed that last year the Commission approved a
parcel map creating 6 parcels for a 5 lot residential area and a 1 lot common
open space area. He noted that, prior to preparing the final map there was
a problem in that the actual property lines are 2 ft. off of what had .
originally been indicated.and, in order to rectify this, a new map must be
prepared moving the lot lines over 2 ft. He advised that the Subdivision
Review Committee met on the matter and recommend approval of the lot line
adjustment.
Upon being assured by Planning Director Hays that public hearing for
Lot Split Case:No. 83 -378 had been duly published and property owners noti-
fied, Chairman Gerrish declared the hearing open.
Don McHaney, applicant for the lot split, advised that it is the
upstairs area - that overhangs the 2 ft.
Upon hearing no further comments from the audience, Chairman Gerrish
declared the...hearing closed. After a brief discussion, on motion by
Commissioner Pilkington, seconded by Commissioner Moots, and unanimously
carried, Lot Split Case No. 83 -378 was approved as recommended by the
Minor Subdivision Committee in their report dated February 9, 1983.
PUBLIC HEARING - AMENDMENT TO SEC. 9- 4.502(e) OF THE ZONING ORDINANCE REGARDING
NONCOMMERCIAL GUEST HOUSES IN "R-A" DISTRICT.
Planning Director Hays advised that in about a month he will bring to the
Commission anew provision that will have to be brought into law which is
referred to_as _'.'Granny Flats ", which are additional small structures that
are allowed in residential areas. He stated it might be more appropriate to
discuss the matter__of.noncommercial guest houses at that time. and maybe con-
sider limiting-.thesize of noncommercial guest houses.
Upon being assured by Planning Director Hays that public hearing for
amendment to .Sec. 9- 4.502(e) of the Zoning Ordinance had been duly published,
Chairman Gerrish declared the hearing open. Upon hearing no comments from
the audience. for or against the proposed amendment, Chairman Gerrish advised
that the matter would be tabled to a later date.
PUBLIC HEARING - REZONING CASE NO. 83 -168, ORDINANCE AMENDMENT TO CHANGE
DESIGNATED USES, ZONING AND LAND USE DESIGNATION BACK TO ORIGINAL HIGHWAY
SERVICE DISTRICT, LOT 2, TRACT 604, OAK PARK ACRES. (REUBEN KVIDT).
Planning Director Hays advised that a few years ago the Commission and
Council rezoned Lots 1 and 2 in Oak Park Acres from Highway Service to
Neighborhood Commercial as requested by the applicant. The request was
to allow for an Alpha Beta development, however, since then the K -Mart
project has been completed and Lot 1 is just about fully developed now.
The applicant feels that Lot 2 would be better developed under the Highway
Service District instead of Neighborhood Commercial and, therefore, requests
the City change the zoning back to the original district. Mr. Hays advised
that the entire area is zoned "P -D" Planned Development, and within the "P -D"
area are the different zoning districts, .:. and the uses are listed in Ordinance
140 C.S., which is the ordinance that approved the development.
Upon being assured by Planning Director Hays that public hearing for
Rezoning Case No. 83 -168 had been duly published and property owners noti-
fied, Chairman Gerrish declared the hearing open.

Rueben Kvidt, General Partner, Oak Park Acres, spoke in favor of the
zone change. Upon hearng.no further comments for or against the proposed
zone change, Chairman Gerrish declared the hearing closed.
Planning Director Hays advised that the Commission action would be a
recommendation to the City Council that Ordinance 140 C.S. be amended to change
the specific zoning designation and the designated uses from "C -N" to "H -S"
District. Commissioner Carr stated he finds it very difficult to act without
knowing what uses are included on the list, and also he feels strongly about
changing the zoning and the land use at the same time. Planning Director
Hays pointed out that the General Plan Land Use Element itself is not being
changed; the only thing that is being changed is the zoning designation within
the district.
COMMISSIONER MOORE LEFT THE MEETING AND IS NOW ABSENT.

OF ARROYO GRANDE RECOMMENDING APPROVAL OF AN AMEND-
MENT TO ORDINANCE C.S. CHANGING THE SPECIFIC
ZONING DESIGNATIONS'AND DESIGNATED USES FROM "C -N"
NEIGHBORHOOD COMMERCIAL DISTRICT TO "H -S" HIGHWAY
SERVICE DISTRICT.

a. Beauty /Health Salon, 1560 Chilton Street in the "P -C"
Professional Commercial District. (Jay and Marilyn Fisher).
Planning Director Hays referred to the letter from Jay and
Marilyn Fisher,dated February 5, 1983, outlining their intended use of
the property at 1560 Chilton Street. He advised that the applicants are
requesting that:the Commission find this type of use similar to other
uses allowed in_.the "P -C" District. He noted that the property in question
fronts both on Chilton and El Camino Real.
Marilyn Fisher, applicant, outlined their intention for the property,
stating it wouid_be a beauty /health spa type of operation, with perhaps a
garden type lunch room, juice bar, etc.
Chairman Gerrish commentedWhat, in looking through the Zoning Ordinance,
it appears that the logical place for this type of business would be in a
"P -C" zone which allows restaurants, beauty shops and residences.
After further discussion it was the consensus of the Commission that
the requested use would be similar in character to other uses permitted
in the "P -C" District, and the following action was taken:

b. Wedding Chapel and Residence, 155 Fairview Drive in the "H -S"
Highway Service District. (Chaplain and Mrs. Daniel Dyer)
Planning Director Hays stated that the.etter from Chaplain and
Mrs. Daniel Dyer, dated February 4, 1983 outlines their request for a
residence and wedding chapel in the Highway Service District. He noted
that the existing residence is quite large and the subject property is
also quite large. He stated he has two concerns regarding this request.
One is the parking requirements for this type of use, and second, this
type of use is not really specified in the Highway Service District.
Mr. Ivan Shiman, representing the applicant, spoke regarding the
property in question. He pointed out that churches, mortuaries and lodges
are permitted in the Highway Service Districtand, his opinion, the
requested use would be similar to those uses. Chaplain Dyer, applicant,
reviewed the proposed use of the property stating, basically, they intend
to live in the residence and open up a wedding chapel.
After discussion, it was the concensus of the Commission that the
requested use would be similar in character to other uses in the Highway
Service District_and_ the following action was taken:

IMPROVEMENT PLANS_FOR TRACT NO.. 741 'IWILDWOOD.RANCH ". (CHUCK TEMPUS).
Planning Director Hays reviewed that back in 1980 the Commission and
Council adopted Ordinance 214 - C. S._ which rezoned an area known as Wildwood
Ranch. He pointed - out that there were 44 conditions to be met, one of
which was that the final development plan will be subject to the City's
architectural review and approval. He stated that the improvement plans
have been submitted for this_tract for the streets, sewers and water system,
and they have_been. approved by the City Engineer certifying that the plans
are complete and_mee:ts all ordinances and conditions of approval. Mr. Hays
explained that it is very technical detailed information, however, the
conditions require that the Planning Commission and City Council approve
these plans.
Chairman Gerrish commented that, in his opinion, technical items
such as this should not be within the purview of this Commission, however,
he has no problem with sending them on to .the City Council.
After a brief discussion, on motion by Commissioner Cole, seconded
by Commissioner Pilkington, and unanimously carried, determining that
the improvement plans for Tract No. 741 are in compliance with City
ordinances and conditions of approval, and recommending that said plans
be forwarded to the City Council for review.

There being no further business before the Commission, the meeting
was adjourned by the Chairman at 9:30 P.M.
