PC Minutes 1982-04-06ARROYO GRANDE PLANNING COMMISSION April 6, 1982 The Arroyo Grande Planning Commission met in regular session with Chairman Gerrish presiding. Present are Commissioners Benhardt, Cole, Moots, Pilkington and Sebastian. Commissioner Saruwatari is absent. Planning Director Hays is also in attendance. MINUTE APPROVAL The minutes of the regular meeting of March 16, 1982 were approved as prepared on motion by Commissioner Benhardt, seconded by Commissioner Pilkington, and unanimously carried. COMMUNICATIONS Planning Director Hays presented an item for architectural review which involves an additional building at the existing Five Cities Rent -All. He advised that the applicant owns a structure located in Oceano and he wishes to utilize it as a storage building for the rental business. He further noted that the applicant has a Use Permit granted by the City and it is a legal use. After a brief review and discussion, on motion by Commissioner Sebastian, seconded by Commissioner Genhardt, and unanimously carried, the request to move an additional building in on the Five Cities Rent -All property was granted with the condition that when the business moves from the premises or the Use Permit is terminated, that the building be removed from the site. The Planning Director was directed to work with the applicant regarding any necessary modification to the building such as colors, etc. PUBLIC HEARING - PROPOSED AMENDMENT TO ORDINANCE NO. 221 C. S. COVERING THE "KNOLLWOOD" DEVELOPMENT, TO AMEND EXHIBIT "A" TO MODIFY THE PROPOSED CIRCULATION SYSTEM AND LOCATION OF THE CLUSTERED HOUSING UNITS. (STEWART ENGINEERS, AGENTS FOR THE PETITIONERS). Planning Director Hays advised that the applicants.have proposed an amend- ment to Ordinance 221 C.S. amending Exhibit "A ". He pointed out that this exhibit details the areas to be developed, and the proposed amendment would modify the circulation system to lessen the impacts of construction for the circulation system. He noted that the proposed amendment does not affect the number of proposed units, however, it slightly alters the location of the dwelling units due to the new road alignment. Mr. Hays stated it is the applicants' opinion that there would be - less environmental damage as a result of the proposed road alignment. He further stated that if the Commission desires to amend the ordinance, what would happen is Exhibit "A" would -- be amended to show the new road alignment. Upon being assured by Planning Director Hays that public hearing for amendment to Ordinance 221 C.S. - had been duly published, posted and property owners notified, Chairman Gerrish- declared the hearing open: Vern Williams, Stewart Engineers, spoke representing the applicants. He explained the reasons for the proposed realignment, noting that there doesn't appear to be any particular negative aspects to the project, and the positive aspect is that the clustered housing units will be moved to a more accessible site. There being no further comments for or against the proposed amendment, Chairman Gerrish declared the hearing closed.. Commissioner Sebastian commented that, in his opinion, the proposed road alignment is much better than the previous one. He pointed out that the new Exhibit "A" indicates the extension of West Branch Street to be a "future" extension. Commissioner Sebastian noted ;that the Ordinance, Item 10b under ':Streets" states "...to facilitate circulation between U. S. Highway 101 interchanges at Branch Street and Brisco Road, it will be necessary during Phase I to design and construct the Frontage Road between its two existing improved sections fronting the new County Center and the City property on Vernon Avenue ". Commissioner Sebastian requested that Exhibit "A" be changed to insure that there is no misunderstanding for future Commissions and Councils. Mr. Williams, Engineer for the applicants, stated the wording on the proposed Exhibit "A'.' was an engineer's oversight. Chairman Gerrish stated if the word "future" is deleted, that should solve the problem. Commissioner Moots commented that the extension of West Branch is going to become very important and he wants to be sure that it is completed with the first phase. Arroyo Grande Planning Commission, 4 -6 -82 After further discussion, the following action was taken: RESOLUTION NO. 82 -895 RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARROYO GRANDE RECOMMENDING APPROVAL OF AN AMENDMENT TO ORDINANCE NO. 221 C. S., KNOLLWOOD DEVELOPMENT. AYES: Commissioners Benhardt, Cole, Moots, Pilkington, Sebastian and Chairman Gerrish NOES: None ABSENT: Commissioner Saruwatari the foregoing resolution was adopted this 6th day of April 1982. 9. Landscaping of channel per previously approved plans prior to grant of occupancy of buildings of either parcel. Upon being assured by Planning Director Hays that public hearing for Lot Split Case No. 82 -375 had been duly published, posted and property owners notified, Chairman Gerrish declared the hearing open. Upon.hearing comments for or against the proposed lot split, Chairman Gerrish declared the hearing closed. After a brief discussion, Lot.Split .Case No. 82 -375 was approved subject to the 9 recommended conditions -of Page 2 On motion by Commissioner Cole, seconded by Commissioner Moots, and by the following roll call vote, to wit: PUBLIC HEARING - SUBDIVISION REVIEW, TENTATIVE SUBDIVISION MAP TRACT NO. 1000, AN 18 UNIT CONDOMINIUM PROJECT. PROPERTY GENERALLY LOCATED BETWEEN SO. ELM STREET AND ASPEN STREET, NORTH OF ASH AVE. (ASPEN VILLAGE INVESTORS). Planning'Director Hays advised that this item is being continued. The reason for the continuance was that the Use Permit was granted for an air space condominium project and, after discussing the matter with the applicants, they would like to have a Planned Unit_ Development instead. He stated that, in• order. for them to proceed with a subdivision map for a Planned Unit Development, the petitioners would have to have the Commission's concurrence amending the Use Permit to a Planned Unit Development. Chairman Gerrish stated he doesn't see any problem with the change as long as the applicants are aware of the setback requirements. After a brief discussion, on motion by Commissioner Sebastian, seconded by Commissioner Benhardt, and unanimously carried, Use Permit Case No. 81 -316 was amended to allow for a Planned Unit Development in lieu of an Air Space Condo- minium development. PUBLIC HEARING - LOT SPLIT CASE NO. 82 -375, PARCEL A OF PARCEL MAP AG 81 -108, WEST BRANCH STREET. (K -MART CORPORATION). Planning Director Hays reviewed that when the Commission approved the K -Mart project, a pad was shown in the southwesterly corner of the site to be used for a restaurant. He stated that a restaurant chain now wishes to develop this property, however, they want to own the site on which they wish to build.and, therefore, they are requesting a split of this parcel from the larger parcel on which K -Mart will be constructed. Mr. Hays stated he could no problem with this proposal, since the use was always intended for this site. He pointed out that architectural review will be given to the building prior to construction. He further pointed out that the conditions of approval of the K -Mart lot split will still be in effect, together with all conditions of the Ordinance. Mr. Hays read the recommended conditions of approval of the Minor Subdivision Committee, dated March 31, 1982. In addition, he recommended that the following two con- ditions be added to the 7 conditions recommended by the Committee: 8. Appropriate fence or barrier to be installed with building permit to protect public from possible hazard resulting from 2:1 fill banks. Design to be approved by Director of Public Works and Planning Director prior to recordation. In answer to Commissioner Sebastian's question as to who is going to be responsible for landscaping of the channel, Mr. Caballero, representing the applicant, advised that they are submitting a preliminary landscape plan that would be through the channel and, in effect, Arroyo Grande Investments will be landscaping the entire thing. He noted a condition of the original lot line adjustment map was that the slope through the channel be planted. PUBLIC HEARING - LOT SPLIT CASE NO. 82 -374 (LOT LINE ADJUSTMENT), PROPERTY GENERALLY LOCATED SOUTH OF OAK PARK BOULEVARD AND JAMES WAY CENTER INTERSECTION ON THE EAST SIDE - OAK PARK ACRES. (LEE WEBB /JOHN ROSENLOF -JAMES WAY CENTER). Planning Director Hays advised that the application is for a lot line adjust- ment to adjust the line dividing parcels 1 and 2. The proposal is to increase Parcel 2 by moving the line northerly 200 ft., and the purpose of the adjustment is to allow the development of a motel and restaurant on Parcel 2. He pointed out that the Commission previously approved a motel on Parcel 2, however, the applicants now wish to expand the motel and they need this additional area. He further pointed out that this adjustment will somewhat change the existing development plan for the area, and a condition of approval is to prepare a new plan for these parcels; also, there will be a subsequent architectural review of the motel. Upon being assured by Planning Director Hays that public hearing for Lot Split Case No. 82 -374 had been duly published, posted and property owners notified, Chairman Gerrish declared the hearing open. Lou Caballero, Los Padres Engineers, representing the applicants, briefly reviewed the development plan to give the Commission a prospective of what the developer is planning to do. He stated that the original development plan called for a smaller motel, a restaurant and medical offices. He noted that the medical buildings are still proposed, but that one of the buildings will be smaller; and also the James Way Center, as originally proposed, will be smaller. Mr. Caballero pointed out one problem that exists is the parking for the motel, in that it does not meet the City's criteria. Planning Director Hays advised that this will come back to the Commission under architectural review. There being no further discussion for or against the proposed lot split, Chairman Gerrish declared the hearing closed. Commissioner Sebastian commented that, in'his opinionit.is important that there is some flow of people from the motel to the other facilities without having to get into their cars and drive around, whi.chwould generate. a bit of traffic. He recuested::that staff keep this in mind to insure that there is some sort of participation between these parcels to provide that flow of people. After further discussion, Lot Split Case No. 82 -374 was approved subject to the 10 conditions listed in Minor Subdivision Committee Action, dated March 31, 1982, on motion by Commissioner Sebastian, seconded by Commissioner Benhardt, and unanimously carried. PUBLIC HEARING CONTINUATION - SUBDIVISION REVIEW, TENT. SUBDIVISION MAP, TRACT NO 10.43 "EQUESTRIAN ESTATES ", A 40 UNIT SINGLE FAMILY RESIDENTIAL SUBDIVISION, PROPERTY GENERALLY LOCATED EASTERLY OF PILGRIM WAY AND THE ARROYO GRANDE HIGH SCHOOL PROPERTY, NORTHEASTERLY OF VALLEY ROAD AND ABUTTING HIGHWAY 101 ON THE EASTERLY PROPERTY LINE. (BUSICK /GEARING DEVELOPMENT). Planning Director Hays advised that the applicant's representative had called him today and requested that the matter be continued to the next meeting. Mr. Hays stated, in his opinion, the meeting of May;4th: would be the very earliest'_...: that the documents would be ready, and the first meeting in June would probably be more realistic. Chairman Gerrish suggested that the matter be tabled and re- advertised when the EIR supplements are available. After a brief discussion, on motion by Commissioner Benhardt, seconded by Commissioner Cole, and unanimously carried, Subdivision Review of Tract No. 1043 was tabled until such time as the supplement to the Environmental Impact Report is available and the matter re- advertised when appropriate.. COMMUNICATIONS Chairman Gerrish advised that the next regular Planning Commission meeting of April 20, 1982 will be held at 8:00 P.M. instead of 7:30 P.M. because the City Council will have their reorganization meeting on that same night. Chairman Gerrish noted that Planning Director Hays will not be available for the May 18, 1982 regular Planning Commission meeting and has requested that L;1 Arroyo Grande Planning Commission, 4 -6 -82 ATTEST: Page 4 the meeting be cancelled. After a brief discussion, on motion by Commissioner Cole, seconded by Commissioner Pilkington, and unanimously carried, the Planning Commission meeting of May 18, 1982 was cancelled.
