PC Minutes 1981-09-15'66 ARROYO GRANDE. PLANNING COMMISSION September=15 .1 981 The Arroyo Grande Planning Commission met in regular session with Chairman Gerrish presiding. Present are Commissioners Cole, Pilkington, Saruwatari and Sebastian. Commissioners Benhardt and Moots are absent. Planning Director Hays is also in attendance. COMMUNICATIONS Planning Director Hays read a letter from Mr. Orrin Cocks addressed to the Commission, requesting that they find that a mini warehouse use is :. similar to other uses in the Highway Service District subject to obtaining a Use Permit. Mr. Hays stated that since the Highway Service District allows such a wide range of uses that possibly a mini warehouse could be considered if the site is suitable for that use, and the Use Permit could be conditioned where there would be no negative adverse impacts. After a brief discussion, it was agreed that the applicant be allowed to proceed with a Use Permit for a mini warehouse in the Highway Service District. RESOLUTION NO. 81 -856 RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARROYO GRANDE DETERMINING THAT A MINI WAREHOUSE IS SIMILAR IN CHARACTER TO USES PERMITTED IN THE "H -S" HIGHWAY SERVICE DISTRICT.SUBJECT TO USE PERMIT PROCEDURES. On motion by Commissioner Sebastian, seconded by Commissioner Pilkington, and by the following roll call vote, to wit: AYES: Commissioners Cole, Pilkington, Saruwatari, Sebastian and Chairman Gerrish NOES: None ABSENT: Commissioners Benhardt and Moots the foregoing Resolution was adopted this 15th day of September 1981. PUBLIC HEARING - TENTATIVE SUBDIVISION MAP, TRACT 1014, 11 UNIT CONDOMINIUM • PROJECT, 1146 ASH STREET, "R -G" DISTRICT. (LINDSEY). Planning Director Hays pointed out that at a previous meeting the Planning Commission approved a Use Permit for an 11 unit condominium project, and also architectural approval has been granted. The applicant has now filed a sub- division map for a one lot subdivision and, due to the lack of a quorum of the Subdivision Review Board,.staff is recommending approval of the tentative map with the 6 conditions listed in the staff report, dated September 10, 1981. Upon being assured by Planning Director Hays that public hearing for Tentative Subdivision Map for Tract 1014 had been duly published, posted and property owners notified, Chairman Gerrish declared the hearing open. Upon hearing no comments from the audience either for or against the proposed subdivision, Chairman Gerrish declared the hearing closed, and the following action was taken: RESOLUTION NO. 81 -857 RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARROYO GRANDE APPROVING TENTATIVE SUBDIVISION MAP, TRACT NO. 1014, AND REFERRAL TO THE CITY COUNCIL FOR INFORMATIONAL PURPOSES ONLY. On motion by Commissioner Sebastian, seconded by Commissioner Pilkington, and by the following roll call vote, to wit: AYES: Commissioners Cole, Pilkington, Saruwatari, Sebastian and Chairman Gerrish NOES: None ABSENT: Commissioners Benhardt and Moots the foregoing Resolution was adopted this 15th day of September 1981. PUBLIC HEARING - TENTATIVE SUBDIVISION MAP - 21 UNIT CONDOMINIUM PROJECT, 239 AND 247 SO. ELM STREET IN THE "R -G" DISTRICT. (BIAFORA, WEINER AND RANELLETTI). Planning Director Hays pointed -out that the Planning Commission had previously granted: !.a Use Permit for this project, however, during the architectural review of same,. the Commission found that the guest parking and the circulation was inadequate as proposed, and architectural approval was not granted. Subsequent to that,action, the'.applicant appealed the Commission's decision :Arroyo Grande Planning Commission to therCity Council who, cants have submitted the noted that since this is be a single lot subdivisi • 9 -15 -81 Mr. Hays advised that a Subdivision Review Board meeting was not due to lack of a quorum and, therefore, the recommended conditions of approval are listed in the staff report, dated September 10, 1981. He pointed out that the coverage is in violation of the Ordinance and the applicant should apply for a Variance from ..theordinance.;requireinent. He also stated his concern with regard to public safety on Elm Street, in that it is physically impossible for the Dempsey Dumpsters to turn around in the space that is provided, and they will have to back on to Elm Street. Another concern was that, in his opinion, the applicant may not have intentions of complying with Condition #4 in the report of September 10th, since the Commission denied architectural approval. Commissioner Cole stated her feelings that the Commission, as an advisory . committee,�made.:their findings,and the results were appealed to the City Council and the Council acted in favor of the applicants. Chairman Gerrish pointed out that the Commission provided guidance to the City Council and they elected to uphold the appeal and approve the project. • Jim McGillis, San Luis Engineering, stated what they asked the Council was whether a<portion,._of.:the..guest parking could.:be..considered as open space, and the interpretation from that meeting is that some guest parking is con- sidered as an amenity to the whole project and, therefore, is covered under the open space requirement.. After further discussion, the following action was taken: RESOLUTION NO. 81 -858 RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARROYO GRANDE APPROVING TENTATIVE SUBDIVISION MAP AND REFERRAL TO THE CITY COUNCIL FOR INFOR-, MATIONAL PURPOSES ONLY. PUBLIC HEARING - REZONING CASE NO. 81 -159, ZONE CHANGE FROM "A" AGRICULTURAL DISTRICT TO "RA -B3" RESIDENTIAL AGRICULTURAL DISTRICT, PROPERTY LOCATED SOUTHERLY OF EAST CHERRY AVENUE AND WESTERLY OF BRANCH MILL ROAD. (HAYES). Planning Director Hays advised that the applicant has submitted an appli- cation to rezone a 4.24 acre parcel from "A" Agricultural District to "RA -B3" Residential Agricultural District (40,000 sq. ft. minimum building site), and the proposal would allow up to 4 parcels to be created. He further advised that the applicant is also requesting that the Optional Design Standards be applied to allow flexibility in development of the parcel due to the topo- graphy. He noted that the location of the property is southeast of an "R -1" residential area, and the access to the property is the same access road to be used for the new water tank. Upon being assured by Planning Director Hays that public hearing for Rezoning Case No. 81 -159 had been duly published, posted and property owners notified, Chairman Gerrish declared the hearing open. 387 358 Arroyo Grande Planning Commission 9 -15 -81 Page 3 Jim McGillis, representing the applicant, pointed out that if the zone change is approved, the applicant is offering an open space easement to the City, which is approximately 70,000 square feet. He stated that the land use designation in the General Plan is low density residential, and they feel that the "RA -B3" zone request is a pretty good compromise. There is an existing home on the property now, and they are hoping to get three more building sites on the flat field area up above. Logan Saylors, 506 Launa Lane, inquired if there would be any added drainage on the back of the properties on Launa Lane. Mr. McGillis advised that there would be no added drainage and that the proposal is to improve the drainage ditch along the frontage of the property. Upon hearing no further discussion for or against the proposed zone change, Chairman Gerrish declared the hearing closed. Commissioner Sebastian stated he feels the zone change is appropriate because it isn't prime agricultural land, and it does establish a density of one unit per acre, which is the density that staff has used in determining what type of future resources our "A" zone is going to impact on us. Chairman Gerrish pointed out that the Residential Agricultural District is intended to permit mixed farm and residential uses, to provide an area for people to have small parcels of land larger than residential lots where live- stock, poultry, and small animals may be raised in limited number for home use or for pleasure, and obviously this is not what is be accomplished by the pro- posed zone change. After further discussion, the following action was taken: RESOLUTION NO. 81 -859 Z RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARROYO GRANDE RECOMMENDING APPROVAL OF AN AMEND- MENT TO THE MUNICIPAL CODE OF THE CITY OF ARROYO GRANDE AS PROVIDED BY CHAPTER 4 ZONING, ARTICLE 32 OF SAID CODE. On motion by Commissioner Cole, seconded by Commissioner Sebastian, and by the following roll call vote, to wit: AYES: Commissioners Cole, Pilkington, Saruwatari, Sebastian and Chairman Gerrish NOES: None ABSENT: Commissioners Benhardt and Moots the foregoing Resolution was adopted this 15th day of September 1981. After a brief discussion regarding the Request for Negative Declaration, the following action was taken: RESOLUTION NO. 81 -860 EIR RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARROYO GRANDE ACCEPTING NEGATIVE ENVIRONMENTAL DECLARATION. On motion by Commissioner Sebastian, seconded by Commissioner Cole, and by the following roll call vote, to wit: AYES: Commissioners Cole, Pilkington, Saruwatari, Sebastian and Chairman Gerrish NOES: None ABSENT: Commissioners Benhardt and Moots the foregoing Resolution was adopted this 15th day of September 1981. PUBLIC HEARING - VARIANCE CASE NO. 81 -80, VARIANCE TO REDUCE THE REQUIRED'OPEN SPACE AND INCREASE THE BUILDING COVERAGE, 290 SPRUCE ST., IN THE "R -G" GARDEN APARTMENT DISTRICT. (PECK /DeSCHANE). Planning Director Hays reviewed that at their meeting of September 1, 1981 the Planning Commission requested that the applicant submit a Variance appli- cation in conjunction with their proposed condominium project.because the original application for a Use Permit did not meet the ordinance requirement regarding open space coverage of the project. He advised that the applicant has submitted the Variance application requesting that the open space require- ment be reduced from the required 40% to 29 %, or that a portion of the driveway 1 1 1 Arroyo Grande Planning Commission, 9 -15 -81 be considered as a portion of the open space requirement to obtain the required 40 %. He pointed out that this is somewhat of a unique situation, in that previously a six unit condominium project had been approved on the corner, and what the applicant proposes to do is to compliment the already approved project and they will have a common open area between the two units. He pointed out that for the applicant to meet the open space requirements, they would have had to eliminate a unit, and since the Elm Street Park is just across the street, they felt that might be a point of consideration in granting the Variance. Upon being assured by Planning Director Hays that Variance Case No. 81 -80 had been duly published, posted and property owners notified, Chairman Gerrish declared the hearing open. Merilee Peck, applicant, spoke in favor of the Variance being granted and referred to the Owners' Statement that accompanied the Variance application. Upon hearing no further comments for or against the proposed Variance, Chairman Gerrish declared the hearing closed. Commissioner Cole stated she doesn.'.t...like the amount of open space, plus the fact that there is a problem with the guest parking and, in her opinion, the Commission's policy on guest parking should be adhered to. Commissioner Sebastian stated he likes the architectural concept of one project complimenting the other one and, in his opinion, three additional guest parking spaces could be developed and there are three spaces on Spruce Street which- would give six spaces, leaving 1 -1/2 spaces short. Rudy Veland, architect for the project and owner the adjoining project, Soto Park Terrace, advised that the idea was to develop a landscaped plaza and, realizing the Commission's feeling on the idea of off - street parking, 8 off - street parking spaces are being provided around the perimeter of the project and with the 3 on- street spaces, there are a total of 11 parking spaces available on this side of the street for this project. Also,each unit is provided with a two car garage, so the applicants don't think off - street parking is a real problem and would like to be granted a Variance to relieve them from the off - street parking requirement. Commissioner Sebastian stated the one concern he has is the compatibility between the two ownerships—and their C. C. & R.'s and, in his opinion, there_ should be a condition in the requirements where both projects have to act under one Association. Chairman Gerrish suggested that the two ownerships enter into an agreement f:or.cam::.ac:c.es.s_an:d_ part i.n.g. Hays pointed out that appropriate. condi.tions'.could be imposed regarding an agree- ment at the Tentative Map stage. After further discussion, the following action was taken: RESOLUTION NO. 81 -861 V RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARROYO GRANDE GRANTING A VARIANCE, CASE NO. 81 -80. There being no discussion, the.following action was taken: RESOLUTION NO. 81 - 862 U RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARROYO GRANDE GRANTING A USE PERMIT, CASE NO. 81 -326. ARCHITECTURAL REVIEW CASE NO. 81 -251, 6 UNIT CONDOMINIUM PROJECT, 290 SPRUCE ST. (PECK /DeSCHANE) Planning Director Hays referred to the staff report, dated September 10, 1981 noting 9.recommended conditions of approval. Commissioner Sebastian recommended that a 10th condition be added as follows: "Agreement by the applicant with the adjacent property owner for joint use of access, parking and the landscaped plaza." Planning Director Hays stated he would like to apply those conditions to the tentative map itself. Commissioner Sebastian stated he would like to see Planning Director Hays work with the architect and applicant in an effort to develop additional on -site parking that, in their opinion, can be accomplished without sacrificing what the architect is trying to accomplish. After further discussion, on motion by Commissioner Sebastian, seconded by Commissioner Pilkington, and unanimously carried, Architectural Review Case No. 81 -251 was approved subject to the 10 conditions noted. Also, Planning Director Hays was directed to work with the architect and applicant in an effort to develop any possible additional off - street parking. With regard to the Request for Negative Declaration, the following action was taken: RESOLUTION OF THE PLANNING COMMISSION OF THE'CITY OF ARROYO GRANDE ACCEPTING NEGATIVE ENVIRONMENTAL DECLARATION. RESOURCES STUDY Planning Director Hays referred to the Resources Study which was ,... included in the Commissioners' agenda packets. He advised the study covers the water supply and the sewer situation with respect to the City. The report was discussed briefly by the Commission. ORAL COMMUNICATIONS Commissioner Sebastian requested that he be relieved from serving on the Architectural Review /Minor. Subdivision Committee because he doesn't have the time. Commissioner Pilkington agreed to serve on the Committee. ADJOURNMENT There being no further business before the Commission, the meeting was adjourned by the Chairman at 9:00 P.M.
