HomeMy WebLinkAboutPC Minutes 1977-10-18412 Arroyo Grande Planning Commission October 18, 1977 . The Arroyo Grande Planning Commission met in regular session with Chairman Gerrish presiding. Present are Commissioners Harris, Moots, Ries and Vandeveer. Commissioners Cole and Hitchen are absent. Also in attendance is Planning Castro. MINUTE APPROVAL Upon hearing no additions or corrections, the minutes of the regular meeting of October 4, 1977 were approved by the Chairman as submitted. REQUEST FOR APPROVAL OF STREET NAMES FOR TRACT NOS. 604, 672 and 673 - OAK PARK ACRES Planning Director Castro referred to a letter from Mr. Kvidt, dated October 17, 1977 suggesting some alternative names to the street names that are in conflict with those in the City or County area. He advised with regard to Tract #672, the street names recommended by staff would be the same except those as noted on the plans. He pointed out that Mr. Kvidt has submitted the names of "Grieb Drive" and "Clevenger Drive ", which the local Historical Society felt would be appropriate, stating these names are acceptable to staff if the Commission so desires. He further advised that for Tract #673, there were three names submitted, and the staff felt that "Acorn Drive" would be more in keeping with the Oak trees and the character of the neighbor- hood. With regard to street names for Tract No. 604, Mr. Castro advised the staff is requesting that these names be withheld for the time being until the map has been approved by the Commission. Commissioner Harris stated he would like to see more names used of people who have had a part in the history of the City. He suggested delaying a decision and renaming the other streets after pioneer families too. Planning Director Castro stated, in his opinion, it would be a good idea to inter -mix some of the older historical names throughout the City, and that two pioneer names in this tract would be enough. After discussion, on motion by Commissioner Vandeveer, seconded by Commissioner Ries, and carried, that the street names for Tract #672 are acceptable as proposed, except as noted on the plans, and that "Acorn Drive" would be an acceptable street name for Tract #673. PUBLIC HEARING - PROPOSED STREET NAME FOR OAK HILL ROAD Upon being assured by Planning Director Castro that public hearing for the proposed street name for Oak Hill Road had been duly published, posted and property owners notified, Chairman Gerrish declared the hearing open. Planning Director Castro referred to the letter from Mr. Lemon, dated Sept- ember 22nd and a letter from Mrs. Lundgren, dated July 20th, which had been sent to the Commissioners with their agenda material. He pointed out that in August the City Council had reviewed this matter and they had concurred with the name of the private road as "Oak Hill Road ", but since that time a letter had been re- ceived from Mr. Lemon requesting that the private road be named "Lemon Lane ", which the staff felt warranted a public hearing on the matter. Mr. Castro also read a report from Public Works Director Anderson, dated October 5, 1977, which was a result of Mr. Anderson's research into the "Oak Hill Road" designation. He stated that this road has been known as Oak Hill Road by our emergency services and the Post Office for a number of years and, it is the staff's opinion that it should re- main as "Oak Hill Road ". Mr. Richard Lemon stated that the road was never designated as "Oak Hill Road" on any official map and, according to the City Code, Section 8 -2.05, a "road" is a diagonal road on a continuous street; and a "lane" is a curving discontinued road and, therefore, since the road is only a few blocks long and all in curves, it should not be named "road ", but should be a "lane ". Mr. Lemon stated if the road is not renamed "Lemon Lane ", he would request that the matter be continued. Mrs. Lundgren, 535 Traffic Way, stated she has lived there for years on '35 acres, and that she was opposed to changing the name of the road. Mrs. Elizabeth Jackson, 208 Fair View Drive; Mrs. Madeline Steele,1598 Hillcrest Drive; Mrs. Merilee Peck, 560 -A Oak Hill Road; Mrs. Simpson, 150 Tally Ho Road, speaking for Mrs. Honeycutt, 560 Oak Hill Road:v were present and spoke in opposition of the requested street name change. Mrs. Marie Cattoir suggested that if the road name had to be changed for the sake of being confused with Oak Park Road, it should be changed to something not using anyone's sur name, and should be changed to a theme blending with Stagecoach Road. Arroyo Grande Planning Commission, 10 -18 -77 Page 2 Mr. Lemon stated, with regard to the comment of naming the road using a sur name, he had intended to put lemon trees in this area, and that is one of the reasons he had wanted the name "Lemon ". He further advised he would also go along with the name "Lemonwood ", which would be in keeping with "Pearwood" and "Rosewood ". There being no further discussion,. Chairman Gerrish declared the hearing closed, and after a brief discussion by the Commission, the following action was taken: RESOLUTION NO. 77 -568 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARROYO GRANDE RECOMMENDING THAT THE UN -NAMED STREET AT THE END OF PEARWOOD AVENUE BE OFFICIALLY NAMED "OAK HILL ROAD ". On motion by Commissioner Vandeveer, seconded by Commissioner Ries, and by the following roll call vote, to wit: AYES: Commissioners Harris, Moots, Ries, Vandeveer and Chairman Gerrish NOES: None ABSENT: Commissioners Cole and Hitchen the foregoing Resolution was adopted this 18th day of October 1977. PUBLIC HEARING - USE PERMIT CASE NO. 77-269, FREE STANDING SIGN, OAK PARK ACRES (KVIDT) . a;_ Upon being assured by Planning Director Castro that public hearing for Use Permit Case No. 77 -269 had been duly published, posted and property owners noti- fied, Chairman Gerrish declared the hearing open. Planning Director Castro read the staff report, dated October 12, 1977, stat- ing the size of the sign is 12' x 12', and that it is not an uncommon sign advertis- ing a subdivision from the roadway. He stated the staff would recommend approval of the Use Permit, subject to review in one year, and review every year thereafter until the project has been completed. He further advised that the sign conforms to the Ordinance with regard to height, etc. Mr. Reuben Kvidt, petitioner, stated they would rather have one sign that summarizes what is there, rather than a number of smaller signs. He advised the sign merely announces what is being done so that the public will have some idea of the development. There being no further comments for or against the proposed Use Permit being granted, Chairman Gerrish declared the hearing closed. Commissioner Vandeveer commented, in his opinion, the sign did not appear to be particularly sales oriented to the property, but more as advertising for the various contractors that assisted in the project, and he did object to this advertising of the contractors. Planning Director Castro stated it is like any other commercial enterprise or development who normally advertise the people who are backing up a particular project; and he did not feel it is really advertising for the contractors or the bank financing the project. Mr. Kvidt explained, with regard to the names of the companies listed on the sign, it was his suggestion that they be included and they had volunteered to pay a portion of the sign. Planning Director Castro pointed out that the staff has been receiving a number of calls from people wanting to know what the project is. He stated this is a large project and a long term project and, in his opinion, a development of that size is going to have to have some advertising. Commissioner Ries stated he would be in favor of the sign itself, but would suggest deleting the contractors, and he also felt the matter should be reviewed in six months. After further discussion, the following action was taken: 413 414 Arroyo Grande Planning Commission, 10 -18 -77 AYES: NOES: ABSENT: RESOLUTION NO. 77 -569 U RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARROYO GRANDE GRANTING A USE PERMIT, CASE NO. 77 -269. On motion by Commissioner Ries, seconded by Commissioner Harris, and by the following roll call vote, to wit: Commissioners Harris, Moots, Ries, Vandeveer and Chairman Gerrish None Commissioners Cole and Hitchen Page 3 the foregoing Resolution was adopted this 18th day of October 1977. PUBLIC HEARING - USE PERMIT CASE NO. 77 -268, 145 SO. HALCYON ROAD, CONDOMINIUM UNITS IN A "P -C" DISTRICT (FILER). Upon being assured by Planning Director Castro that public hearing for Use Permit Case No. 77 -268 had been duly published, posted and property owners noti- fied, Chairman Gerrish declared the hearing open. Planning Director Castro advised that this project is adjoining R -3 lots, with two six unit apartments to the immediate west of the proposed project site. He stated the staff has no objections to the granting of the Use Permit subject to the conditions as listed in the staff report from Mr. Sullivan, dated October 12, 1977. Mr. Nash Brown, Project Architect representing Mr. Filer, was present and stated he would answer any questions concerning the project. Ms. Judy Winegard, 251 So. Alpine St., inquired as a point of clarification, if archaeological review is required when the petitioner applies for a Use Permit. Planning Director Castro informed Ms. Winegard that the standard condition that has been added is that if there is any evidence of archaeological findings of any sort, the contractor is required to stop and a more extensive analysis of the project in question is made. In answer to Mrs. Jackson's question as to what the Castro advised the property abutting to the east is zoned fronting on Halcyon up to the hospital facility are zoned mercial District, and on Grand Avenue, the properties are District. adjacent zoning is, Mr. R -3, and the properties P -C Professional Com- zoned Highway Service There being no further discussion for or against the proposed Use Permit, Chairman Gerrish declared the hearing closed. After a brief discussion by the Commission, the following action was taken: AYES: NOES: ABSENT: RESOLUTION NO. 77 -570 U RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARROYO GRANDE GRANTING A USE PERMIT, CASE NO. 77 -268. On motion by Commissioner Vandeveer, seconded by Commissioner Ries, and by the following roll call vote, to wit: Commissioners Harris, Moots, Ries, Vandeveer and Chairman Gerrish None Commissioners Cole and Hitchen the foregoing Resolution was adopted this 18th day of October 1977. PUBLIC HEARING - REZONING CASE NO. 77 -110, 590 E. CHERRY AVE., FROM "RA -B3" RESIDENTIAL AGRICULTURAL DISTRICT TO "R -1" SINGLE FAMILY RESIDENTIAL DISTRICT (MARSALEK). Planning Director Castro read his memo to the Planning Commission, dated October 18, 1977, with regard to the proposed zone change. He advised that the City Council has requested that the Planning Commission be informed of their desires that no official action on auy zone change request on prime agricultural • • Arroyo Grande Planning Commission, 10 -18 -77 Page 4 land be considered until the Agricultural Committees recommendation is completed. After a brief discussion, it was agreed by the Commission that the matter be def- fer;red pending receipt of the Agricultural Committee's report. It was further agreed that the public hearing for said zone change request would again be pub- lished, posted and notices sent to property owners. PUBLIC HEARING - REZONING CASE NO. 77 -111, 617, 601 AND 509 GRAND AVENUE, AND 163 SO. ALPINE STREET, "RA -B3" RESIDENTIAL AGRICULTURAL DISTRICT TO "R=1" SINGLE FAMILY RESIDENTIAL DISTRICT (CITY OF ARROYO GRANDE). Upon being assured by Planning Director Castro that public hearing for Re- zoning Case No. 77 -111 had been duly published, posted and property owners notified, Chairman Gerrish declared the hearing open. II Planning Director Castro explained that as a result of rezoning request granted to Mr. Miller at 139 So. Alpine Street, and Mr. Walker at 155 So. Alpine Street from RA -B3 to R -1 District, there was a one lot spot zone created and it is the staff's recommendation that the property at 163 So. Alpine Street be rezoned from RA -B3 to R -1 District. Also, there are three parcels which have access to Grand Avenue that are partially zoned "H -S" Highway Service, and partially zoned "RA -B3" Residential Agricultural District. Mr. Castro advised with regard to the property fronting on Grand Avenue, it is the staff's understanding that the larger "L" shaped parcel is in escrow, and in view of the fact that they have never met and discussed the matter with the new owners, staff is requesting that this matter be dropped from any further consideration at this time, and that the small parcel on So. Alpine Street be recommended to the City Council for rezoning from "RA -B3" to "R -1" District. In answer to Bill McCann's question with regard to the problem of circulation through those particular properties, Planning.Director Castro advised it was his understanding that Mr. Walker will be working th Mr. Miller to obtain ingress and egress. He further pointed out that if the properties adjacent to Grand Avenue were requested for commercial use, then the problem of circulation would be eliminated. There being no further discussion for or against the proposed zone change, Chairman Gerrish declared the hearing closed. Commissioner Harris stated the only thing the zone change is affecting is a single family lot, which will bring it into conformance with the General Plan; it won't affect the land use, because there is a house there now. Chairman Gerrish stated, in his opinion, there are several other areas in the City that have been spot zoned, and he couldn't see how this one particular lot warrants the efforts of rezoning, and it was his feeling that this change should be part and parcel of a larger action. After further discussion, the following action was taken recomrending re- zoning the property at 163 So. Alpine Street only. RESOLUTION NO. 77 -571 Z RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARROYO GRANDE RECOMMENDING APPROVAL OF AN AMENDMENT TO THE MUNICIPAL CODE OF THE CITY OF ARROYO GRANDE AS PROVIDED BY CHAPTER 4 ZONING, ARTICLE 32 OF SAID CODE. On motion by Commissioner Harris, seconded by Commissioner Moots, and by the following roll call vote, to wit: AYES: Commissioners Harris, Moots, Ries, Vandeveer and Chairman Gerrish NOES: None ABSENT: Commissioners Cole and Hitchen the foregoing Resolution was adopted this 18th day of October 1977. REVIEW GENERAL PLAN AMENDMENTS TO RECONSIDER THE PROPOSED MEDIUM DENSITY RESIDENTIAL FOR CROWN HILL AREA. Planning Director Castro advised the Planning Commission and audience that this matter is not a public hearing, but merely a study session between the staff and Planning Commission, and that the proposed General Plan Amendment stems from a letter to the City Council from Mrs. Carl F. Carlson regarding her concerns on the 415 Arroyo Grande planning Commission, 10 -18 -77 Page 5 Crown Hill area being primarily (1) nature of the area; (2) traffic, and (3) water. At the City Council meeting of September 13th, the letter from Mrs. Carlson was reviewed, and the Council requested that the Planning staff take action and further present a report to the Planning Commission. He advised that in reviewing the concerns, the staff tends to agree with Mrs. Carlson's points of contention. The staff also feels it is important to understand that the General Plan is a document representing a development program for the next 20 years, and provides no phasing of its various land use elements and, consequently, we are confronted with issues of incompatibility between existing land use and what may be a very functional and proper land use 10 or 15 years in the future. Planning Director Castro reviewed a report to the Planning Commission, dated October 14, 1977.. He advised that in view of what the staff has noted in the report, staff is recommending that the Planning Commission take separate action to rezone to low density classification those properties abutting the Loomis Heights Subdivision and the Methodist Campground properties; the multiple development desig- nated for the Crown Hill area from a point on Le Point Terrace east to Corbett Canyon Road be revised to low density residential; and that the properties south of Huasna Road be reverted to an interim holding classification, preferably the "A" district, until such time as a re- evaluation of other existing or proposed multiple areas are considered. Commissioner Harris referred to the recent rezoning of Ide Street from "R -2" to "R -1 ", stating he felt this area should also be considered for General Plan amendment to change the density from medium density residential to low density residential to reflect the "R -1" zoning. He stated that the "R -2" zoning was in conformance with the General Plan, and when the zoning was changed, it became in conflict with the General Plan. After considerable discussion, a public hearing was set for the next regular Planning Commission meeting of November 1, 1977, to consider a General Plan Amend- ment on the four areas previously mentioned. JAMES HEIGHTS TRACT NO. 625 Planning Director Castro pointed out that in the approval of Tract No. 625, the Public Works Department recommended an improved road of 28 ft. on the easterly end of. the project, where the new alignment of James Way will begin. He further stated he believed the only criteria that determined the 28 ft. improvement was the two travel lanes the Commission required for ingress and egress. Mr. Castro further noted that at the time the subdivision was approved, everyone was of the opinion that the City had 65 ft. of right of way, as noted on the assessor's map. However, when the property was surveyed for improvements, it was discovered that only 32 ft. of right of way existed. Mr. Castro pointed out that, based on the 32 ft. of right of way, the minimum street improvement will be reduced from 28 ft. to 19 ft. of paving. He stated that the staff feels the 19 ft. improvement is not the most desirable, but is acceptable, and he recommended that if Public Works Department agrees on the improvements, that the requirements be revised from 28 ft. to 19 ft. After discussion, the Commission recommended that staff work with the Public Works Department to modify the cross section to 19 ft.
