Arroyo Grande Planning Commission
June 15, 1976
The regular meeting of the Arroyo Grande Planning Commission was called
to order by Planning Director Gallop, as Vice Chairman Moots was absent. The
Planning Director called for nominations for Acting Chairman: On motion by
Commissioner Ries, seconded by Commissioner Cole, and unanimously carried,
Commissioner Pope was appointed as Acting Chairman. Present were Commissioners
Cole, Gerrish, Mathews, and Ries One vacancy exists on the Commission.. Also
present were Planning Director Gallop, City Administrator Butch, City Engineer.
Garcia, Public Works Director Anderson, and Councilmen Millis and Gallagher, Jr..

The minutes of the regular meeting of June 1, 1976 were approved by
the Acting Chairman after hearing no additions or corrections.

Director Gallop stated that this property is just west of Gaynfair
on 2arroll Road The permit had been granted two years ago, and was normally
good for one year only; however, the Church stated that they were not aware
only;
of this time limit and were asking for an extension. He stated that there
had been no major changes in the area which would affect an extension on the
Use Permit. However, he recommended an extension for one year only and subject
to more development in the area He stated that the adjacent property owners
had expressed an interest in purchasing a portion of the Church property,
and if they did so, the Church may no longer be able to meet the square
footage requirements for their building as approved in the original Use Permit.
Bill Fulgium, 917 Cameron Court, pastor of the Church, stated they
had been operating under the assumption that a Use Permit was final, as a zone
change was, without a time limit. He felt that a condition for review would
hamper their plans and put: them under pressure from the adjacent properties.
He assured the Commission that the Church would begin building within the
next year.
On motion by Commissioner Mathews, seconded by Commissioner Gerrish,
and unanimously carried, the Commission approved extending Use Permit Case
No 74 -223, providing the property remain at or above 20,000 sq, ft.

Director Gallop stated that the Central Coast Ambulance Service had
been at their present location on South. Halcyon for 6 - 7 years, and the City
has had no problems at that location, and would assume there would be no
problem at the suggested new location. The staff had two recommendations if
the Commission approved the requested Uae Permit: that the siren or warning
signals should not be used until the vehicle reaches a major street; and that
the ambulance be maintained in the parking area to the rear of the building,
not in the public right of way, nor in the drive area within the building.
After being assured by Director Gallop that public hearing for the
proposed Use Permit had been deAly published, posted, and property owners
notified, the Acting Chairman declared the public hearing open.
Elizabeth Jackson, 208 Fairview, questioned the legality of the
public hearing as the newspaper notice had an incorrect address on one part
of the notice. Director. Gallop stated that this must be a typographical
error on the part of the paper as the notices sent Grit had had the correct:
address on them However, he suggested. the Commission hold the public hearing
and make a decision, and then if the. City Attorney fount this to be in error,
the public hearing could be reheld at a later. date.
On motion by Commissioner Gerrish, seconded by Commissioner. Mathews,

Commissioner Mathews questioned; the recommendation regarding the
siren.. The Planning Director stated this was meant for the business to

Acting Chairman Pope stated that public hearing on the Land Use
Element had been held at the last regular meeting of the Planning Commission;
it had been closed and comment was not restricted to Commission. members.
However, if there was a new item, the public hearing would be reopened
for public input on the item only The Commission then reviewed their
actions and recommendations of the previous meeting, as summarized in a memo
from Planning Director Gallop, dated June 4, 1976.

residential as determined by the City Council Commissioner Mathews stated
he just couldn't see this area for residential due to the noise from the
freeway.

The Commission agreed, to the removal of this property as •light: industrial from
the Land Use Plan, but expressed some concern over creating another light
industrial area somewhere in the City.

Northwest Corner of South Halcyon and Fair Oaks Avenue - The Commission
recommended changing this area to office-professional use, with Commissioner
Ries abstaining..
Flower Fields Huasna Road The Commission recommended changing the
• flower fields on Huasna Road to light density..
Sunset Building - The Planning Director stated he had contacted the
owner of the old Sunset Building property, The property owner had indicated
that he would like to have the property zoned "H -S" to be in conformance with
the present land use, This - would involve determining by actual measurement
where the zone would end and indicating this on the•Zoning Map- The Com-
mission recommended leaving this property as it presently is on the Land Use
Map and instituting a zone change to tPH -S ",
Miyake Property. - At their regular meeting of May 4, the Commission had
denied a requested rezoning on the Miyake property The petitioner had sub-
sequently appealed•this decision to the City Council, which had agreed to
give a first reading on the requested zone change, If the zone change is grant-
ed, the City will have 90 days to change the Land Use .Plan to conform to the
new zon.ing.. If this is done. at a later hearing, this will represent the
final change to the Land Use Plan that the City is allowed to make this
•year. However, if the Commission changed the Map now, they would still
have one change left for the year, Therefore, the Planning Director
recommended that the - Public Hearing be reopened for this item only,
On motion by Commissioner Gerrish, seconded by Commissioner Ries,
and unanimously carried, the Public Hearing was reopened to consider
changing the Land.Use designation on the Miyake property.
Bill McCann, 428 Tanner Lane, questioned the legality of reopring
the public hearing without legal advertisement, On the advise of City
Administrator Butch, the public hearing was closed.. Commissioner. Gerrish
xecomnended just leaving this as a non - conforming zoning, as there is :a
general reference already in the General Plan to several existing non-
conforming zonings.

Acting Chairman Pope noted that public hearing for Rezoning Case No
75-84 had been closed at the last regular meeting and discussion now would be
between Commission Members, The Planning Director added that the Commission
would be considering acceptance of the Tentative Subdivision Map in connection
with the requested zone change to "P -D" Planned Development.
Planning Director Gallop then reviewed in detail the staff recom-
mendations for the proposed development.
After a lengthy discussion, the Commission made the following
changes to the Staff Report: That redesign and reconstruction of the.inter
section of Oak Park Boulevard and Frontage Road is the responsibility of the
applicant and shall be bonded for performance with the recordation of the map
with construction to be completed before any of the lots are sold or developed;
that James Way be paved only to the easterly corner of Parcel 5 with the
recordation of the map and full underground utilities to.be placed on
James Way as it develops; that a water supply of adequate sized line and
pressure shall be developed and bonded for construction to the intersection of
Oak Park Boulevard and frontage Road prior to any lot being developed or sold..
After further discussion, the following action was taken:

RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
ARROYO GRANDE RECOMMENDING APPROVAL OF AN AMENDMENT
TO THE MUNICIPAL CODE OF THE CITY OF ARROYO GRANDE AS
PROVIDED BY CHAPTER 4 ZONING, ARTICLE 32, OF SAID CODE.
On motion by Commissioner Gerrish, seconded by Commissioner Cole, and by
the following roll call vote, to wits:

Director Gallop noted that this is the second unit of Loomis Heights,
and lies to the west of Loomis Height, Unit 1, It will consist of 12.57 acres,
which would permit: 13:1 lots. He then reviewed the Subdivision Review Board's
recommendations, which innlud €:d a recommendation that a variance be given on
.3 lot, which would allow 14 lots. They also recommended that any lot having
less than 85 ft, frontage be required to have a 50 ft: front. yard Setback;
this would allow for offst=reet parking on the parcW itself, rather than in the
right of way

in conformance with the Land Use Plan and the Zoning Ordinance.
The Commission now considered the request for a Negative Environmental
Declaration
Mrs Simmons, 150 Tally Ho Road, and Ella Honeycutt, 560 Oak Hill Road,
expressed concern about the traffic at the corner of Mason and Le Point.and
Mason and Branch, City Engineer Garcia stated that, from an engineering stand-
point, the intersections could handle quite a lot more traffic before there was
a problem. However, the City planned to watch this carefully and would peti-
tion Cal Trans for a stop light when the traffic wa - -anted, Mrs. Howycutt
also asked that it be noted t:hat.the City has a letter on file from Dr.
Hoagland of the Lucia Mar. School District stating that the schools are full.
After a brief discussion, the following actions were taken:

TO THE CITY COUNCIL VCR INFORMATIONAL PURPOSES ONLY.

COMMISSIONER MATHEWS EXCUSED HIMSELF DUE TO A POSSIBLE•CQNFLICT OF
INTEREST AND IS NOW ABSENT:
Diroctor Gallop stated that this tentative map is in compliance with
the 1}t acre lot developments 41lowod on "A" Agricultural Zoned Districts. The
proposed subdivision is locatod.eaeterly of the present Greenwood Subdivision,
Director Gallop reviewed the recommendations of the Subdivision Board, including
a recommendation of the Public Works Department that Greenwood Drive be extended
to intersect With Green Acres Drive, Commissioner Gerrieh corrected an error
on Page 3 of the Subdivision Review Board's recommendations, it should read
" ,below the 11 ft elevation.,
Bill McCann, 428 Tanner Lane, noted that on Page 14 of the Land Use Plan,
Paragraph 3, it states there is a 5 acre minimum sot for parcels in "A" zoning

Director Gallop stated that the Commission had recommended changing this to .7
dwelling units per acre; however, it-needed ,to be approved also by the City
Council.
After a lengthy discussion, on motion by Commissioner Gerrish,
seconded by Commissioner Cole, and unanimously carried, the Commission found
Tentative Tract Map No 600 to be in conformity with the Zoning Ordinance, On
motion b;, Commissioner Gerrish, seconded by Commissioner Cole, and carried, the
Commission found the Tentative Tract Map not to be in conformity with the
GenExa1 Plan, but to be in conformity with the action of the Commission of this
date concerning the Land Use Plan.
The Planning Director stated that this property had been applied for
Ag Preserve status on its prime ag land, but -._.r: was denied by City Council
action, Ella Honeycutt, 560 Oak Hill Road,. stated she questioned Mr, Green -
wood's motives in proposing development on this property; she believed it ap*
peared to be a very serious form of. black mail as Mr. Greenwood is aware of
the City's policies regarding agricultural lands,. She also questioned the use
of septic tanks on the property.,
Bill McGann, 428 Tanner Lane, questioned No 19 on the B -1 Form,
which referred to the project generating a controversy.
The Planning Director stated that staff had rechecked the Subdivision
Map Act and that it states a legislative body can not act on a Final or Tenta-
tive Map is it does not comply with the General Plan, On motion by Commissioner
GerrisF,'seconded by Commissioner Ries, and unanimous :1.y carried, the Commission
tabled all discussion on Tentative Tract Map No: 600 until such time as the.
City Council takes action on the Land Use Element of the General Plan:
COMMISSIONER MATHEWS IS NOW PRESENT.

The Commission indicated that they welcomed any public input and
appreciated receiving letters:. Commissioner Ries stated he thought the City
staff was doing a good job of providing the Commission tools to make adequate
decisions,

Bill McCann, 428 Tanner Lane, suggested having the City Attorney pre -
Sent at all Commission meetings, in case any legal. questions arise Commissioner
Ries stated he concurred if it would help meetings run smoother
Ella Honeycutt, 560 Oak Hill Road., stated that the County of Ventura
was hosting a field trip to Ventura; the trip Would .be on June 16 and the
topic wot:ld be preservation of agricultural lands in the wake of urban sprawl.
She stated any interested persons were welcome to attend.,

There being no further business, on motion by Commissioner Ries,
seconded by Commissioner Mathews, and unanimously carried, the Commission
adjourned at 10:25 P.:M.
