October 21, 1975 The Arroyo Grande Planning Commission met in regular session with Chairman Calhoon presiding, Present are Commissioners Gerrish, Mathews, "Moots, and Sandoval. Absent are:Commissioners Cole and Ries.: Also present are Planning Director Gallop and Councilman Spierling. MINUTE APPROVAL The minutes of the regular meeting of October 7, 1975 were approved,: by Chairman Calhoon as prepared, It was noted that the minutes of September 16 were checked for accuracy in regards to the petition submitted by Mike and that the minutes were correct, REVIEW COMMITTEE ACTIONS: LOT SPLIT CASE NOS: 75 -226 75- 22875-229 AND 75-230 Director Gallop noted that all of the Lot Splits being reviewed by the Commission are in accordance with the Land Use Plan. After a brief discussion, the reports were ordered filed. PUBLIC HEARING - VARIANCE CASE NO, 75-55 TO ALLOW FOR CONVERSION OF EXISTING RETAINING WALLS TO A SINGLE CAR GARAGE LOCATED WITHIN THE FRONT YARD SETBACK AND WAIVING ONE OFF- STREET PARKING SPACE AT 508 & 512 LE POINT STREET (DONALD STICKLER) Director Gallop advised the Commission that the City Attorney'had re- viewed the Variance granted Mr, Stickler at the Commission meeting of Septem- ber 16, and in his opinion the Variance was not more restrictive than the application requested; therefore, the Resolution was not valid. The Director reviewed two memos from the Police Chief and the Fire Chief'regarding the safety aspects of the proposed garages;'he stated that there were no other new developments., Upon being assured by Planning Director Gallop that public hearing for Variance Case No, 75 -55 had been duly published, posted, and property owners notified, Chairman Calhoon declared the public hearing opens Mike Miner, 538 Le Point, stated that he believed there had been some misunderstanding at the last public hearing over the number of signatures that were on the petition which he presented to the Commission; he had stated that he had fifteen (15) homes represented on the petition, not fifteen (15) signatures.. He stated that he believed that his petition presented the best solution, Mrs, Darrell Stinson, 562 Le Point, presented a petition to the Com- mission, identical to the petition which she presented at the last public hearing, which had fifty -five (55) additional signatures on it; this petition requested the Commission not to grant the proposed Variance. She also re- viewed various sections of the Building Code and Zoning Ordinance dealing with Variances, stating that she did not believe that Mr, Stickler was eligible for a Variance in this case, She also questioned the garages being in the front yard setback, stating that she did not believe this was so, that they were in the public right of way. Mrs, Lane, 524 Le Point, was present and in favor of the petition presented by Mr,. Miner, which she had signed, Grant Lane, 524 Le Point, questioned the signing of the petitions, asking if they should only have the signatures of the neighbors or if they could have anyone sign. Director Gallop stated that anyone who wished could sign a petition; however, the signatures had no validity unless those signing appeared at the meeting;. Fred Steele, 1598 Hillcrest, questioned the setback variance request- Director Gallop stated that Mr. Stickler had an encroachment permit for the retaining walls, which could be revoked by the City at any time. jack English, 521 Le Point, asked if this variance request wasn't similar to the variance denied by the City Council. Director Gallop replied that the Commission was not acting on previous City Council action; they were acting on a variance request which they had determined was substantially different from the original request„ 1 178 Arroyo Grande Planning Commission, 10- 21 -75 Page 2 Mel de la Motte, 1250 Peach Street, San Luis Obispo„ representing Mr:. Stickler, stated he believed the Variance should be granted due to topography also though it significant that, if the petitions are correct, 3/4 of the residents on Le Point Street recommend that the buildinggs There being no further discussion for or against the proposed variance, Chairman Calhoon declared the public hearing closed, After a brief discussion, the following action was taken: RESOLUTION NO, 75-414 V RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARROYO GRANDE GRANTING A VARIANCE, CASE NO, 75-55. On motion by Commissioner Gerrish, seconded by Commissioner Mathews, and by the following roll call vote, to wit: AYES: Commissioners Gerrish, Mathews and Chairman Calhoon NOES: Commissioners Moots and Sandoval ABSENT: Commissioners Cole and Ries the foregoing Resolution was adopted this 21st day of October 1975, NEGATIVE DECLARATION OF ENVIRONMENTAL IMPACT - AMENDING ORDINANCE 24 C., S. BY ADAING ''-P" AGRICULTURAL .PRESERVE COMBINING ZONED DISTRICT Director Gallop stated that this was a Negative Declaration Statement on the "-P" Agricultural Preserve District which the Commission had approved at their last meeting. He also pointed out that while some communities require Environmental Impact Reports prior to Commission action, the City of Arroyo Grande has always required them as a supplement after approval by the Commission.. After a brief discussion, the following action was taken: RESOLUTION NO, 75-415 EIR RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARROYO GRANDE ACCEPTING NEGATIVE ENVIRONMENTAL IMPACT DECLARATION„ On motion by Commissioner Moots, seconded by Commissioner Sandoval, and by the following roll call vote, to wit: AYES: Commissioners Gerrish, Mathews, Moots, Sandoval and Chairman Calhoon NOES: None ABSENT: Commissioners Cole and Ries the foregoing Resolution was adopted this 21st day of October 1975, NEpATIyg DECLARATION OF ENVIRONMENTAL IMPACT - PROPOS p LOT §T LIT AND REZONING,, AT MYRTLE STREET AND NOGUERA PLACE Director Gallop noted that the Planning Commission had approved this rezoning at its last regular meeting and had reviewed the Committee action on the lot split earlier in the evening:. He stated that the lot split is pending City Council approval of the zone change„ After discussion, the following action was taken: RESOLUTION NO, 75-416 EIR RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARROYO GRANDE ACCEPTING NEGATIVE ENVIRONMENTAL IMPACT DECLARATION. On motion by Commissioner Gerrish, seconded by Commissioner Mathews, and Arroyo Grande Planning Commission, 10 -21 -75 by the following roll call vote,'to wit:. AYES: Commissioners Gerrish, Mathews, Moots, Sandoval and Chairman Calhoon NOES: None ABSENT: Commissioners Cole and Ries the foregoing Resolution was adopted this 21st day of October 1975 NEGATIVE DECLARATION OF ENVIRONMENTAL IMPACT - OPTIONAL DESIGN STANDARDS TRACT #577 LOOMIS HEIGHTS The Director reviewed the Negative 'Declaration Statement; noting that it was only for the "Optional Design Standards" approved by the Planning Com- mission at its last regular meeting; a separate Environmental Impact Report would be prepared when a subdivision is requested.. After a brief discussion, the following action was taken: RESOLUTION NO, 75 -417 EIR RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARROYO GRANDE ACCEPTING NEGATIVE ENVIRONMENTAL IMPACT DECLARATION. On motion by Commissioner Mathews, seconded by Commissioner Sandoval, and by the following roll call vote to wit: AYES: Commissioners Gerrish, Mathews, Moots, Sandoval and Chairman Calhoon NOES: None ABSENT: Commissioners Cole and Ries the foregoing Resolution was adopted this 21st day of October 1975, , WRITTEN CORRESPONDENCE The Planning Director referred to a memo addressed to the Commission and City Council, which he hid prepared at the City Administrator's request, in reply to reports written by Doctor Hoagland and Hank Wachtmannof the Lucia Mar School District. He believed that Mr. Wachtmann'sfigures were incorrect, and he had prepared his report to show what he felt were the correct figures, The Commission then discussed the report at some length; Chairman Calhoon opened the discussion to the public. Dorothy Rector, 545 Le Point Street, asked if it was necessary for the City to annex County property when it is opened up for lot splits, Director Gallop replied that the City has never petitioned for annexation; the property owners must do the petitioning Peggy Langworthy, Printz Road, asked the source of some of the figures in the report; the Director answered that they were extrapolations from the School District's figures or from public records in the Planning Office. Madelyn Steele, 1598 Hillcrest, stated that she had called the School District Office in regard to the reports, and that she believed there was a misunderstanding in terminology as far as tentative maps were concerned: Al Spierling, P,. 0, Box 399, stated that he also believed there was some misunderstanding with the tentative and proposed developments, .ADJOURNMENT There being no further business before the Commission, on motion by Commissioner Mathews, seconded by Commissioner Gerrish, and unanimously carried, the meeting was adjourned to a study session at 8:36 PpM.
