HomeMy WebLinkAboutPC Minutes 1975-08-05Arroyo Grande Planning Commission August 5, 1975 The Arroyo Grande Planning Commission met in regular session with Chairman Calhoon presiding Present are Commissioners Cole, Gerrish, Mathews, Moots, Ries and Sandoval, Also in attendance are Phnning Director Gallop and City Administrator Butch. MINUTE APPROVAL Upon hearing no additions or corrections, the minutes of the regular meeting of July 15, 1975 were approved by the Chairman as prepared. ELECTION OF OFFICERS - YEAR 1975 °76 Chairman Calhoon opened the nominations for Chairman of the Planning Commission. Commissioner Moots nominated Chairman Calhoon for reelection for 1975-76, seconded by Commissioner Ries, Commissioner Cole moved that nominations be closed and that the records show that a unanimous ballot was cast in favor of Chairman Calhoon's re- election. Motion seconded by Commis- sioner Ries, and unanimously carried. Chairman Calhoon opened the nominations for Vice Chairman of the Planning Commission. Commissioner Mathews nominated Commissioner Moots for re- election, seconded by Commissioner Ries. Commissioner Cole moved that nominations be closed and that the records show a unanimous ballot was cast in favor of the re- election of Commissioner Moots as Vice Chairman of the Arroyo Grande Planning Commission for the year 1975 °76. Motion seconded by Commissioner Sandoval, and unanimously carried. NEGATIVE ENVIRONMENTAL IMPACT REPORT PONDING BASIN ENCINAS BONITAS PARK ,SELM STREET PARK Director Gallop noted this is a City Public Works project which has been in process for several years, It was set out in the first Public Ser- vices and Facilities Element of the General Plan in 1966 and again in 1970, and is an on -going program. Because the program is going into a new phase, a Negative Environmental Impact Report is being requested. ZONED After discussion, the following action was taken: RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARROYO GRANDE ACCEPTING A NEGATIVE ENVIRONMENTAL IMPACT DECLARATION On motion by Commissioner Cole, seconded by Commissioner Ries, and by the following roll call vote, to wit: AYES: NOES: ABSENT: RESOLUTION NO, 75 EIR Commissioners Cole, Gerrish, Mathews, Moots, Ries Sandoval and Chairman Calhoon None None The foregoing Resolution was adopted this 5th day of August 1975. DETERMINATION OF USE - GOLF DRIVING RANGE IN A C -N NEIGHBORHOOD COMMERCIAL DISTRICT Director Gallop noted that this is a request for a determination of use for a golf driving range in any C -N zoned district. He added that the C-N zone is set up primarily for neighborhood - commercial types of retail convenience businesses, and that it has the same off - street parking require- ments as any other commercial zone. He stated that he could not recommend this determination, since this type of use would then be allowed anywhere in a C-N zone, even next to a residential zone, which could be bothered by night - lighting and traffic. Arroyo Grande Planning Commission, 8 - -75 After discussion, the following action was taken: RESOLUTION NO, 75 RESOLUTION OF THE PLANNING COMMISSION OF TkE CITY OF ARROYO GRANDE DETERMINING THAT A GOLF DRIVING RANGE IS NOT COMPATIBLE IN A C-N NEIGHBORHOOD COMMERCIAL ZONED DISTRICT, On motion by Commissioner Cole, seconded by Commissioner Gerrish, and by the following roll call vote, to wit: AYES: NOES: ABSENT: Commissioners Cole, Gerrish, Moots, Ries, Sandoval and Chairman Calhoon Commissioner Mathews None The foregoing Resolution was adopted this 5th day of August 1975. PUBLIC HEARING m USE PERMIT CASE NO. 75 °237, TO ALLOW A RESIDENTIAL CARE HOME FOR THE AGED 295 ALDER STREET (LEE AND THELMA HARKLERODE) COMMISSIONER RIES WAS EXCUSED BECAUSE OF A POSSIBLE CONFLICT OF INTEREST AND IS NOW ABSENT. Director Gallop stated that this use permit request was based on an earlier determination by the Planning Commission that a residential care hpme for the aged is permissible in an R-G zoned district. He referred to a map of the property, noting that it is presently improved with a house which has met the State home care standards and will require minor remodeling. Under State licensing, the owners could get a permit for up to six persons; however, they are only requesting a permit for five persons. Director Gallop said that he would recommend that curb, gutter and sidewalks be required as part of the use permit, Upon being assured by Director Gallop that public hearing for Use Permit Case No, 75 had been duly published, posted, and property owners notified, Chairman Calhoon declared the hearing open. Mrs. Robert B. Stone, 279 Alder, was present and stated that she did not want to see anything commercial go into this neighborhood. She felt that it would create parking and traffic problems, She also questioned the alley that was shown on the public hearing notice, stating that there is no such alley in existence. Director Gallop answered that this is an abandoned alley. Mr. Sloane, 1014 Ash, stated that he agreed with Mrs. Stone. He was primarily concerned that the care home might expand at some later date. Mr. Spohn, 1026 Ash, agreed with both Mrs. Stone and Mr. Sloane, Mr. W. B. Smith, 1030 Ash, felt that this is a residential area and wondered what would happen if the care home wished to expand at a later date. Mr, Henry Santos said that he did not feel that this was a proper place for a home like this. There are many children that use the street, going to and from school, and it is too noisy for a rest home, He stated that he is not against all rest homes; he just felt that this was not the proper place for one There being no further discussion for or against the proposed use permit, Chairman Calhoon declared the public hearing closed. Chairman Calhoon stated that he had been checking into this type of thing during the last few years, and he did not believe that there would be any increase in traffic with only five persons. Page 2 153 154 Arroyo Grande Planning Commission, 8 -5 -75 Page 3 Commissioner Cole asked Mr. Smith how far away he lived from the pro- posed care home; he stated that he lived two homes away. She then asked about the zoning restrictions which Director Gallop reviewed. Director Gallop added that, if the neighbors did not object to five persons, this could be made part of the .use permit, with the condition that the care home never be allowed to expand to more than five persons, He also stated that there could be up to thirteen apartments built on this piece of property, as this is an R -G zone, which would generate more traffic than the care home would. After discussion, the following action was taken: RESOLUTION NO. 75-395 U RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARROYO GRANDE GRANTING A USE PERMIT, CASE NO. 75 -237, On motion by Commissioner Cole, seconded by Commissioner Gerrish, and by the following roll call vote, to wit: AYES: Commissioners Cole, Gerrish, Mathews, Moots, Sandoval and Chairman Calhoon NOES: None ABSENT: Commissioner Ries The foregoing Resolution was adopted this 5th day of August 1975. COMMISSIONER RIES IS NOW PRESENT. PUBLIC HEARING - USE PERMIT CASE NO. 75 -238, CONSTRUCT AN APARTMENT COMPLEX, 280'SOUTH ELM STREET (VICK PACE CONSTRUCTION) Director Gallop displayed a map showing the location of the proposed multi - building apartment complex, noting that the property presently has a house in the middle of it which would be converted to a duplex. A use permit is required when more than one structure is proposed. The other buildings would be grouped around the existing house in order to retain the existing trees. The plans have already been approved by the Architectural Committee, and the developer will be required to develop all three street frontages, underground all utilities and landscape plans are to be approved by Director Gallop. Upon being assured by Director Gallop that public hearing for Use Permit Case No, 75 -238 had been duly published, posted, and property owners notified, Chairman Calhoon declared the hearing open. Doris Olson, representing the Santa Maria Times, inquired as to the size of the lot, which is 150 feet x 266 feet, There being no further discussion for or against the proposed use permit, Chairman Calhoon declared the public hearing closed. Commissioner Moots asked if the existing house would be altered on the outside in any way, Director Gallop stated that all that would be done is to paint, add a new roof, etc. The accessory buildings will be removed. After discussion, the following action was taken: On motion by Commissioner Mathews, seconded by Commissioner Ries, and by the following roll call vote, to wit: RESOLUTION NO. 75 -396 u RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARROYO GRANDE GRANTING A USE PERMIT, CASE NO. 75 -238 AYES: NOES: ABSENT: Commissioners Cole, Gerrish, Mathews, Moots, Ries, Sandoval and Chairman Calhoon None None Arroyo Grande Planning Commission, 8 - Page 4 The foregoing Resolution was adopted this 5th day of August 1975. PUBLIC HEARING - VARIANCE CASE NO, 75 - 54, TO ELIMINATE THE REQUIREMENT OF A GARAGE OR CARPORT FOR OFF STREET PARKING PURPOSES 298 NORTH ELM STREET STHOMAS AND MELINDA WEBB Director Gallop stated that, since this is a variance case, the Commis- sion, if it wanted to grant the variance, must find reasons for approving the variance, rather than reasons for disapproving. This would include things like topography, location of property, hardship created by a former owner and builder, etc.; financial consideration was not a reason. He passed out a report from the Public Works Construction Superintendent„ He also noted that the house was built before that area was in the City Limits; at that time the County did not have standards on driveway slopes. Upon being assured by Director Gallop that public hearing for Variance Case No. 75 - had been duly published, posted, and property owners notified, Chairman Calhoon declared the public hearing open,, Thomas Webb, owner of the property, was present and gave a petition to Director Gallop which his neighbors had signed. Forty persons had signed the petition which stated that they were in accord with the variance request and with the improvements Mr. Webb wished to make to the property. He also passed out a map of the slope of the driveway as compared to the legal slope. He stated that he wished to widen the driveway enough for three vehicles. He then presented a map of the plans he wished to develop. The maps and petition were accepted and made a part of the files. Commissioner Cole asked if the garage was enclosed, Mr. Webb stated that it was; he had purchased the home last year and it was enclosed at that time and all he had done was to put a window into it. Director Gallop stated that the reason Mr. Webb was applying for a variance was that the Building Inspector had seen the new window in the garage and asked that Mr. Webb stop work immediately, which he did, The following persons were present at the public hearing and spoke On the proposed variance: Marvin Swaim, 849 Pearl Drive, stated that he felt that the driveway was very dangerous as it is now, and in his opinion the garage was not usable, Carl Zell, 1213 Linda, stated he had no objection to the variance. Eleanor Murray, 290 North Elm, stated that she believed that the work Mr. Webb had started was a definite improvement and he should be allowed to finish. There being no further discussion for or against the proposed variance, Chairman Calhoon declared the hearing closed. After discussion, the following action was taken: RESOLUTION NO. 75 V RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARROYO GRANDE GRANTING A VARIANCE, CASE NO 75 -54 On motion by Commissioner Sandoval, seconded by Commissioner Ries, and by the following roll call vote, to wit: AYES: Commissioners Cole, Gerrish, Mathews, Moots, Ries, Sandoval and Chairman Calhoon NOES: None ABSENT: None The foregoing Resolution was adopted this 5th day of August 1975. 155 156 ..: Arroyo Grande Planning Commission, 8 -5-7; PUBLIC HEARING - REZONING CASE NO, 75-82 821 HUASNA ROAD FROM R -A -B=1 RESIDENTIAL AGRICULTURAL ZONED DISTRICT, TO ZONED DISTRICT (BROYLES Director Gallop referred to the parcel of property, noting that it is just east of the parcel which was recommended for rezoning at the last Com- mission meeting. AYES: Commissioners Cole, Mathews, Moots, Ries, Sandoval and Chairman Calhoon NOES: None ABSENT: Commissioner Gerrish The foregoing Resolution was adopted this 5th day of August 1975. COMMISSIONER GERRISH IS NOW PRESENT. NEGATIVE ENVIRONMENTAL IMPACT REPORT - After a brief discussion, the following action was taken: RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARROYO GRANDE ACCEPTING NEGATIVE ENVIRONMENTAL IMPACT DECLARATION, AYES: NOES: ABSENT: None None R -1 RESOLUTION NO, 75 - 399 EIR S ING 821 HUASNA ROAD LE FAM LY RES (DENT COMMISSIONER GERRISH WAS EXCUSED BECAUSE OF A POSSIBLE CONFLICT OF INTEREST AND IS NOW ABSENT, Page 5 AL Upon being assured by Director Gallop that public hearing for Rezoning Case No. 75 -82 had been duly published, posted, and property owners notified, Chairman Calhoon declared the hearing open. There being no further discussion for or against the proposed zone change, the Chairman declared the hearing closed, After discussion, the following action was taken: RESOLUTION NO. 75 -398 Z RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARROYO GRANDE RECOMMENDING APPROVAL OF AN AMENDMENT TO THE MUNICIPAL CODE OF THE CITY OF ARROYO GRANDE AS PROVIDED BY CHAPTER 4 ZONING, ARTICLE 32, OF SAID CODE, On motion by Commissioner Mathews, seconded by Commissioner Cole, and by the following roll call vote, to wit: Director Gallop distributed a Negative Environmental Impact Report for the zone change at 821 Huasna Road, On motion by Commissioner Moots, seconded by Commissioner Sandoval and by the following roll call vote, to wit: Commissioners Cole, Gerrish, Mathews, Moots, Ries, Sandoval and Chairman Calhoon The foregoing Resolution was adopted this 5th day of August 1975. REVIEW COMMITTEE ACTION - ARCHITECTURAL REVIEW CASE NO, 75 -106, DRIVE- THROUGH PHOTO BOOTH AND LOT SPLIT CASE NO. 75 -222, 1160 MAPLE STREET Director Gallop reviewed the Committee actions on the cases, and after a brief discussion, the reports were ordered filed, LAND USE PLAN REFERRAL FROM CITY COUNCIL Director Gallop stated that it was his understanding that a Council 1 1 Arroyo Grande • Planning Commission, 8 -5 - Page 6 member had questioned whether the State legislation, which requires the Zoning Ordinance and the Map of the City to be consistent with the Land Use Plan, was actually being followed by the City in the adoption of the last revision of the Land Use Plan. This referral was to this point. The Planning Director stated that he had attended a conference this past week, at which time this trouble- some problem of the terminology used in the legislation was discussed to great length. One of the co- authors of the legislation spoke on the matter. Director Gallop stated that he had ordered cassettes of that lecture; and as soon as they arrived, they will be transcribed so that members of the Commission and Council, may have this information before he would make recommendations for alterations to the Land Use Plan, and before the Commission was to consider changes and re- adoption. He stated that as soon as all of this information was available, revision of the Plan could be considered. LETTER FROM ADDISON WOOD CONCERNING PROPERTY AT THE INTERSECTION OF VALLEY ROAD AND LOS BERROS ROAD Director Gallop distributed a letter from Addison Wood, with regard to the property at the intersection of Valley and Los Berros Roads, It is approxi- mately one acre in size and is triangular in shape. Mr. Wood wanted some sug- gestions from the Planning Commission as to use of the property. He felt that it should be zoned C -N; however, the Planning Director felt that this would not be a good idea, as there is an existing C-N district just north of this area. Administrator Butch suggested P -D zoning as a possible solution. After a discussion, the Commission felt that they could not make any definite recommendations to Mr. Wood, ADJOURNMENT There being no further business before the Commission, on motion by Com- missioner Sandoval, seconded by Commissioner Mathews, and unanimously carried, the meeting was adjourned at 9 :21 P.M, for 'a short study and discussion session.
