Arroyo Grande Planning Commission
April 16, 1974
The Planning Commission met in regular session with Chairman Pope presiding.
Present are Commissioners Calhoon, Goulart, Mathews, Moots, Ries, aad Sandoval.
Also in attendance are City Administrator Butch, Councilman Millis and Planning
Director Gallop,
MINUTE APPROVAL
Upon ;nearing no corrections or additions, Chairman Pope declared the minutes
of the regular 'Planning Commission meeting of April 2, 1974 approved as prepared,
INTRODUCTION OF NEW PLANNING COMMISSIONER
Chairman Pope introduced Commissioner Sandoval.and welcomed him to the
Commission,

Director Gallop reviewed that several months ago a new section was in=
corporated in the Architectural Review portion of the Zoning Ordinance which provides
that the Committee may approve a building arrangement other than that which is
permissive under the ordinance. He pointed out that the property in question was
split into four parcels and approved by the Subdivision Review Board some time ago.
He stated the density in this area is R -3 and would normally permit a triplex on
each of the four lots, however, the developer wishes to construct two sixplexes
with a common wall on two property lines, He advised the two sixplex units would
not increase the density or coverage, does not decrease off - street parking, but
would increase the open space. Director Gallop advised that the Committee approved
the concept with the feeling that two structures would be less of a bulk for the
area than four triplexes.
After review of the conditions of the Architectural approval, on motion
by Commissioner- Moots, seconded by Commissioner Ries, and unanimously carried,
to approve Architectural Committee action of April 5, 1974 granting approval for
construction of two six unit dwellings with a common wall separation.

REVIEW MINOR SUBDIVISION COMMITTEE ACTION AND ARCHITECTURAL
After a brief review of Architectural Committee Action on Case No, 7 -87,
Meyer, Merriam & Associates; and Lot Split Committee Action on Case No. 74 °197,
David Brown, Chairman Pope ordered them approved and filed.
CONTINUATION - TENTATIVE MAP FOR TRACT NO, 531 - "WALNUT CREEK TERRACE°!
Director Gallop reviewed that the Subdivision Review Board report was
reviewed in its entirety at the last regular meeting of the Commission and the
items were approved, with amendments, with the exception of Item 2, Page 3.
He pointed out that since the meeting, he has discussed the matter with
several individuals and groups of individuals involved with development of the
streambed. He further reviewed the action of the Parks and Recreation Commission
and the position they took with the City Council at a joint meeting on April 15th
with reference to streambed development.
Director Gallop stated that the City has accumulated some monies for
land acquisition for park use and the City Council had requested the Parks and
Recreation Commission to consider a land acquisition and development program.
Director Gallop outlined the Parks and Recreation Element of the General Plan
wherein the City is divided into nine neighborhoods with a park facility
designated in each neighborhood„ He stated the Parks and Recreation Commission
have recommended purchase of property on the easterly edge of the city to pro-
vide the nucleus for a community park which will eventually be somewhere in the
neighborhood of 25 to 30 acres, The property abuts a piece of property which,
if developed, would provide approximately 7 to 9 acres of stream park land.
On the other extreme end of the streambed, the Commission recommended purchase
of approximately 17 acres adjacent to the streambed and just north of Valley
Gardens Subdivision, and these would become terminus parks on the streambed
development, and eventually a third park would he located somewhere in the
middle.
Director Gallop advised that there are three areas in the City at the
present time where property has been subdivided and there are individual
properties owning a portion of the creek as subdivision lots; one is the 19 old
townB° area, and the other two areas are the two subdivisions on either side
of the area being discussed, The matter was discussed with the Parks and
Recreation Commission and it was their opinion that these two subdivisions

were not designed properly if we are going to preserve the streambed on accordance
with the General Plan, and the subdivisions were approved prior to the concept.
The Parks and Recreation Commission have recommended that, in the future, any new
subdivisions adjacent to the creek, after this one we are discus5:ung, be designed
so that a street would parallel the streambed and all and between the street and
the bottom of the creek be deeded to the City for park and open space purposes.
Director Gallop further advised that many of the property owners have already dis
cussed development and are aware they are going to be required to deed this land,
The Parks and Recreation Commission have also requested a policy be established
that will permit the staff to approach these individuals requesting a deed for
this land to the City now and, in exchange, they be given either (a) full
credit for this land as park land credit on assessed value at the time of the
division of the property; or (b) density transfer of acreage taken to the balance
of the property The Parks and Recreation Commission feels this would be an equit-
able way to get the streambed and protect it now. He added that such a proposal
would be coming tothe Commission at a later date.
With regard to the subject property, Director Gallop stated that in view
of the two suggested policies and in view of what has happened in the past, it
has been recommended that the City accept an easement from the subdivider for the
streambed and bank area for flood control purposes; dedication of all of the
actual water course east of the streambed center line; and dedication of the 20 ft.
pedestrian way over the Union Oil easement.
In answer to Chairman Pope's question as to whether or not the City
actually has recorded easements on the other subdivisions, Director Gallop
advised that a public easement for flood control and soil conservation purposes
prohibits the owners of the property from developing, however, they still have
to pay taxes on it.
Chairman Pope stated it was his feeling that the public should have the
right to usage of the streambed and if a private citizen cannot use the proposed
easement or use the streambed, then we have defeated the purpose of the Open
Space Element. Commissioners Ries and Goulart indicated they were in agreement
with Chairman Pope's feelings, in that the public should have access to the
streambed.
After further discussion, the following action was taken:

and by the following roll call vote, to wit:

NOES: Commissioners Goulart, Ries and Chairman Pope

The foregoing Resolution was adopted this 16th day of April 1974.
DISCUSSION RE: PROPOSED ORDINANCE CONTROLLING DUMPING OF RUBBISH. ETC. IN THE
STREAMBED
Director Gallop advised that one of the members of the Parks and
Recreation Commission had become concerned about dumping of rubbish, etc. in
the streambed and he had proposed an ordinance which would control the deposit-
ing of'any kind of materials within 150' of the high water mark, and that any
fill proposed within that area would have to go before the Parks and Recreation
Commission for review and consideration before a grading permit can be granted.
The matter has been referred to this Commission by the City Council.
He advised the proposed ordinance would very definitely effect any
development such as parking lots; there could be no fill, no grading, no
maintenance, and it would be a stigma on any particular piece of property if
it was within 150' of the high water mark.

Director Gallop pointed out that under State legislation, after the Open
Space Element of the General Plan has been adopted, then the City can adopt an
Open Space Zone, which will serve the same purpose as the proposed ordinance by
an overlaping zone on top of existing Land Use zoning and, in his opinion, would
have a better chance of being enforced because it is State mandated. He advised
the new amendment to the Zoning Ordinance would be coming to the Commission
probably by the end of the summer.
After discussion, Chairman Pope requested that the proposed ordinance
be referred to the Department of Public Works for a report of its effect,and
referred back to the Commission in the near future with alternates.
SOUTH CENTRAL COASTAL COMMISSION
Commissioner Goulart advised he had attended the South Central Coastal
Commission meeting in Santa Barbara last week, and that next week's meeting
will be held in San Luis Obispo on Thursday, and urged anyone that can, to
attend at least one of these meetings.
BIKE PATH _PLAN
Director Gallop advised that the Bike Path Plan would probably be
before the Commission next month as a recommended amendment to the Circulation
Element of the General Plan.
ADJOURNMENT
There being no further business before the Commission, on motion by
Commissioner Goulart, seconded by Commissioner Ries, and unanimously carried,
the meeting was adjourned at 8:20 P.M.
