22 Arroyo Grande Planning Commission September 4, 1973 The Arroyo Grande Planning Commission met in regular session with Chairman Pope presiding. Present are Commissioners Calhoun, Goulart, Gaalltckson, Oones and Spierling. Commissioner Porter is absent. Also in attendance are City Administrator Butch, Public Works Director Anderson, Cety Engineer iareng, Councilman Talley end Plenrhtng ©erector Gallop MINUTE APPROVAL On motion by Commissioner Goal1tckson, seconded by Commissioner Goulart, and unanimously carried, the minutes of the regular meeting of August 2l, 1973 were approved as prepared. REVIEW VARIANCE CASE NO. 7350 - M O N T STORAGE IN A C -N D I S T R I C T . l5 GRAND AVENUE CHARLES LOONEY1 Director Gallop reviewed the case, and pointed out that on February 20, 1973 this Comm sston granted a Variance to fir. Looney on the request of Mr. Garrison, who is the lessor of the property, and with the knowledge of the property owner, for a paint contracting business. Because of the nature of the business, and the fact that tt was a Variance, there was rather a substantial list of conditions recommended by staff; eight to number, plus a ninth condition r e q u i r i n g a review in s t x months. use property has been t respected almost con tinously since the Variance was granted and we have not had compt Lance with practically all of the eight requirements. The Commisston viewed pictures of the property taken by the Fare Marshal) on August 3Oth0 Director Gal lop read the list of requirements set out t n Resol ut ton 732 84 V, and pointed out that 7 of the 8 conditions are conditions of safety and fire proteetton measures. Director Gallop farther advised that the report from the Eire Marshall, dated August 31, 1973 outlines the various areas of problems he has had In , aettins compliance with the requirements of the Variance. Director Gallop advised that an attempt to screen the lank on the northerly side was made by instal l iron, a reed fence, which has now collapsed. He further noted that Mr. Looney and Mr. Garrison have both been contacted requesting compliance; and we have had promises, but no acttor`o. COMM D SSS I ONE'R PORTER ENTERED THE MEETING After discussion, the following action was taken: CONTINUATION - TALLY HO ROAD PLAN L I N E RESOLUTION NO. 13312 Director G a l l o p informed the Commission they have 'two alternatives; .they can .either give der. Looney additional time to bring the business into com- p'➢lance with the Resotuutton, or take action recommending that the Variance be revoked. D C HEARING TO CONSIDER REVOCATION OF VAROANCE CASC NO. 73 On motion by Commissioner Goulart, seconded by Commissioner Spierltn and on the following roll call vote, to wit: AYES: Commissioners Calhoon, Goulart, Gul l ickson, Jones, Porter, Spterting and Chairman Pope NOES: None ABSENT: None The forego t ng Reso 1 not i ran was adopted this 4th day of September 1973. Chairman Pope referred to a letter from City Attorney Shipsey, dated September 4, 1973. City Administrator Bitch stated he d°oscuassed the subject very briefly with Mr. Shtpsey, who had called the League of Cattfernea Cities on the matter, and although Mr. Shipsey felt it is very mintmai, he felt the best course for the Plannong Commission would be to recommend to the Ctty Council that the Telly Ho Road Plan lane be reinitiated from the start and another engineer be engaged to conduct the study. Arroyo Grande Planning Commission, 9 -4-73 Page , 2 Commissioner Spierlir°g read the following prepared statementpo rrt-ing out the purpose of the proposed plan line and some of the objections brought 'out by the property owners: "I'd like to examine the issues here, and separate each item into its proper perspective. First, the avowed purpose of describing the plan lone is to • circumscribe the area of operations for flood and drainage control and to provide space for future traffic. What are the objections "? 1. Acquisition of private property for public use. 2. Belief that the road is currently adequate to handle future traffic. 3. Improvement of the road will accelerate development._ Let's lock at the last two items together as a single problem. On essence the object there isn't the road, it its to stop growth. But will this be successful? Is our growth due to our wonderful streets; our sewage system; our Fire Department; our schools? No - people are moving from less desir- able areas to those more attractive; Is it these factors that make our area more attractive? Can we stop growth by saying "I'm aboard -- pull up the gangplank". Can we stop people from purchasing land and developing that land? The answer to me is clear. Failure to provide adequate road width at this point in time would allow future builders to encroach on the street until expanded width is impossible. The future residents of Tally Ho Road will be unable to move out Of their driveways due to bumper to bumper traffic (wherever it comes from). We cannot legislate 00 no growth" even should we wish. B want the people to know O share their feelings. I'd like to see things as they wereiin 1956 when O started my family -- but its impossible. believe an environmental study would show that Tally Ho Road and all the houses on the south side of that road have been constructed on the flood plain of a goodly sized watershed. Any . attempt to divert or channel the water from its natural course is an alteration of the environment. .. 00r choice :here is to leave the valley as it is and aiTow the homes to be flooded .periodically, or alter the .environment with structures large enough to carry the run -off from at least a "50 year storm The homes are there -- wec®uld consider condemning all property within 50.yards of the wain channel on environmental grounds and make this a greenbelt. Or, more practically, we can build structures to carry the run -off from the drainage, area. The only question then tha.t.t!his. Commission can examine is: "how can we get the greatest benefit (that is - rbad, drainage) with the least possible harm to property owners ?" We need facts to make a decision. Therefore, Mr. Chairman, move that another study of the plan be done, and that stakes be placed at each property line at the correct places to designate 40', 50° and 60' right-of-way widths. Maybe then both we and the property owners can see for ourselves exactly what !portion of their property will be affected. Special consideration should be given the three homes on the north side of the road just went of James Way so that they may have reasonable access to their garages. The above motion was seconded by Commissioner Porter, and upon request of the Chairman, the following roll call vote was taken: Ayes: Commissioners Calhoon, Goulart, Gulllckson, Jones, Porter, Spierling and Chairman Pope. Noes: None. Absent: None. Motion carried. Director Gallop advised that when a new Plan has been prepared, all legal property owners will be notified of the public hearing and a public notice will also be placed in the local paper. 23 24 Arroyo Grande Planning Commission, 9 ®4 -73 Page 3 Mr, Charles Akers, 254 Tally Ho Road, stated that he did, in the past, sign a petition against the improvement of Tally Ho Road, and that he would like at this time to go on record as wanting to have his name removed from that petition. He stated he was misinformed about the petition, and that he is for the betterment of Arroyo Grande and the improvement of the streets. Mrs. Akers stated she was in agreement with her husband and would lie her name removed from the petition also. ADJOURNMENT There being no further business before the Commission, Chairman Pope adjourned the meeting to a study session at 8 :10 P.M.
