A RTSOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF ARROYO GRANDE APPROVING AMENDED
ARCHITECTURAL R�VIEW CASE NO. 81-238; 1198

WHEREAS, on November 21, 1995 the Planning Commission held a non-public hearing
pursuant to State Law and City Codes on Amended Architectural Review Case No. 81-238; and
WH�REAS, the Planning Comrnission of the City of Arroyo Grande, after due study,
and deliberation, finds that the following circumstances exist:
1. The proposal is consistent witli the "General Architectural Review Guidelines" for the
City of Arroyo Grande.
2. The proposal is consistent with the text and maps of tl�e Arroyo Grande General Plan,
and the City of Arroyo Grande Development Code.
3. The proposal will not be detrimental to the health, safety, comfort and general welfare
of the persons working or residing in the neighborhood of the proposed project.
4. The general appearance of tl�e proposal is in keeping with the character of the
neighborhood.
5. The proposal is not detrimental to the orderly and harmonious development of the City.
6. The proposal will not impair the desirability of investment or occupation in the
neighborhood.
NOW THEREFORE, BE IT RF.SOLV�D that the Planning Commission of the City of Arroyo
Grande hereby approves Amended Arcl�itectural Review Case No. 81-238 subject to the
fvllowing conditions:
CONDITIONS OT APPROVAL
Gener�l Conditions
1. The applicant shall ascertain and comply with all State, County and City requirements
as are applicable to this project.
2. All painting shall be completed pursuant to this approval, no later than February 21,
1996. If inclement weather or ot}ier factors beyond the applicant's control make
completion of painting infeasible witl�in that time frame, the applicant may request one
(1) tliirty (30) day extension from t1�e Community Development Director.
3. Colors shall be per the color board on file at the Community Development Department
office, and sliall be painted as follows:
Medium Blue - Waterlines around the first and second stories;
Awnings;

4. The applicant shall agree to defend at his/lier sole expense any action brought against the
City, its agents, officers, or employees because of the issuance of said approval, or in
the alternative, to relinquish such approval. The applicant shall reimburse the City, its
agents, officers, or employees, for any court cosEs and attorney's fee's which the City,
its agents, officers or emFloyees may be required by a court to pay as a result of such
action. The City may, at its sole discretion, participate at its own expense in the defense
of any such action but such participation shall not relieve applicant of his/her obligations
under this condition.
Architectural Advisory Committee Conditions
5. The applicant shall provide a trim board to separate tlle waterline from the main body
of the building.
Community Development Depai-tment Conditions
6. Development shall conform with lhe GC zoning requirements unless otherwise approved.
7. The applicant, AAC Mem�er Detweiler and Current Planner shall review and come to
an agreement on the "Moby Dick" color.
On motion by Commissioner Carr, seconded by Commissioner Soto, and by the
following roll call vote to wit:
