WII�RT:AS, the Planning Commission has held a public hearing �dn Reversion to
Acreage Case No. 94-522 in accordance with the Development Code of the City of Arroyo
Grande; and
WIIEREAS the Planning Cominission has found that this project is consistent with the
General Plan and the Environmental documents associated therewilh; and
WI the Planning Commission has reviewed this project in compliance with the
California Environmental Quality Act (CEQA) and has determined that a Negative Declaration
can be adopted, and instructs the Secretary to file a Notice of Determination; and
WIIEREAS, said Reversion to Acreage Map was referred to the Planning Commission,
Uy various City Departments and the Staff Advisory Committee; and
WHEREAS, the Planning Commission finds, after due study, deliberation and public
hearing, the following circumstances exist:
1. No dedications or offers of dedication will be vacated or abandoned as part of the
reversion to acreage.
2. I\11 owners of an interest in the real property within the subdivision have consented to
the reversion. In this case, the only property owner is the applicant.

1. The City of Arroyo Grande has prepared an initial study pursuant to Section 15063 of
the Guidelines of the California Fnv.ironmental Quality Act for Reversion to Acreage
Case No. 94-522.
2. Based on the initial study, a negative declaration was prepared for review by the public
an review and approval by the Planning Commission.
3. Afler holding a public hearing pursuant to State and City Cades, and considering the
record as a whole, the Planning Commission adopted the negative declaration and found
that there is no substantial evidence of any significant adverse effect, either individually
or on the I�abitat tipon wl�ich the wildlife depends as a result of development of this
project.

NOW, TI-IER�FORE, B� IT R�SOLVED that lhe Planning Commission of the City
of Arroyo Grande hereby approves said reversion to acreage, subject to the standard conditions
of the City and tt�ose conditions ]isled below:
General Conditions
1. 'The applicant shall ascertain and comply with all State, County and City requirements
as are applicable to tllis project. •
2. This application shall automatically expire on Marcli 7, 1997 unless the Reversion to
Acreage map is recorded. Prior to the expiration of the approval, the applicant may
apply to tl�e Planning Commission for an extension of one (1) year from the original date
of expiration.
3. Development shall occur in substa�tial conformance with the plans presented to the
Planning Commission at tl�e meeting of March 7, 1995 and marked "Exhibit A" and AG
94-142.
4. The subdivider shall defend, indenu�ify and hold hannless the City, its agents, officers
and employees, from any claim, action or proceeding brought within the time period
provided for in Government Code Section 66499.37, against the City, its agents, officers
or employees, to attack, set aside, void, or annul the City's approval of this subdivision.
In order for this condition to be effective, the City must promptly notify subdivider of
any such claim, action or proceeding and must cooperate fully in tl�e defence thereof.
Public Works Deparl�nent Conditions
5. All improvement plans shall be prepared by a registered civil engineer in the State of
California and shall be approved by the Public Works Director prior to issuance of any
City permits for construction. Improvement plans sl�all include, but are not limited to
grading, street, drainage, water, sewer, and appurtenant improvements. As required, the
plan submittal shall include construction cost estimates, soils reports and all other
pertinent engineering calculations.
6. The applicant shall install c�trb, gutter, and sidewalk on the South Elm Street frontage
of tlie project where there is no c�irb, gulter, and sidewalk.
7. Underground all utilities to tt�e project and along the project frontage.
8. Conform street paving to the c��rb and gutter along the frontage of the project with the
necessary transition on tl�e south end.
9. Street cross-fall shall be as sliown on the Elm Street plans on file in the Engineering
Department in the City. Structural section shall be designed with a minimum of 5.5 T.I..

All public improvements and lot monumentation shall be bonded if they are not installed
prior to recor.dation of the reversion to acreage.
The applicant shall pay storm drainage fees in accordance with City ordinances.
All improvement water shall drain to the street.
All units to Ue served with City water ai�d sewer.
Install street lights as necessary to PG&E standards.
