PC R 93-1434RESOLUTION NO. 93-1434 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARROYO GRANDE APPROVING PLANNED SIGN PROGRAM CASE NO. 93-110, FOR A PROrESSIONAL OFFICE APPLIED FOR BY CUESTA TITLE GUARANTY AT 129 -135 NORTH HALCYON ROAD WHEREAS, the Planning Commission of the City of Arroyo Grande has considered an application by Cuesta Title Guaranty for a Planned Sign Program at 129 - 135 North Halcyon Road in the General Commercial District; and WHEREAS, the Planning Commission has found that this planned sign program is consistent with the General Plan and the Environmental Documents associated therewith; and WHEREAS, the Planning Commission has reviewed this project in compliance with the California Environmental Quality Act (CEQA) and has determined that the project is categorically exempt per CEQA Guidelines Section 15311; and � WHEREAS, the Planning Commission finds, after due study, deliberation and public hearing, the following circumstances exist: l. The proposed signs are consistent with the goals, objectives, policies and prograrns of the Arroyo Grande General Plan. The proposed signs balance the need for identification of businesses with the rural small town character of the community. 2. The proposed signs conform to applicable development standards and provisions of the Development Code and will not be detrimental to the public health, safety or welfare. 3. The physical location or placement of the signs are compatible with the surrounding neighborhood and do not pose a safety risk. NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Arroyo Grande hereby approves said Planned Sign Program, subject to the following conditions of approval: General Conditions 1. The applicant shall ascertain and comply with all State, County and City requirements as are applicable to this project. 2. This application shall automatically expire on September 7, 1995 unless a building permit is issued and substantial construction is commenced and diligently pursued toward completion, or a final inspection is conducted. Thirty (30) days prior to the expiration of the approval, the applicant may apply to the Planning Commission for an extension of one (1) year from the original date of expiration. - 3. Development shall occur in substantial conformance with tlie plans presented to the Planning Commission at the meeting of September 7, 1993 and marked "Exhibit A". 4. The applicant shall agree to defend at his/her sole expense any action brought against the City, its agents, officers, or employees because of the issuance of said approval, or in the alternative, to relinquish such approval. The applicant shall reimburse the City, its agents, officers, or employers, for any court costs and attorney's fee's which the City, its agents, officers or employees may be required by a court to pay as a result of such action. The City may, at its sole discretion, participate at its own expense in the defense of any such action but such participation shall not relieve applicant of his/her obligations under this condition. Architectural Advisory Committee Conditions 5. The roof sign shall be eliminated. 6. A second wall sign, in proportion with existing wall signs, may be installed to tlie rigtit of the Title Company door and window. Prior to finai building inspection, the applicant shall submit the proposed sign to AAC for review and approval. All signs not conforming to this planned sign program shall be removed prior to issuance of building permits. 8. Individual tenants shall be allowed two wall signs per building frontage witt� a public entrance. Wall signs shall be 12 inches high and 30 inches wide. Colors and materials shall be as shown on Exhibit "A". 9. The monument and directory signs shall be as shown on Exhibit "A". 10. Tl�e major tenant in the rear building shall be allowed one standard size wall sign and wall sign in proportion to the other wall signs of a size subject to review and approval of the AAC prior to final inspection of tl�e signs. Building and Fire Department Conditions 11. Within six months of project approval, the applicant shall apply for and obtain building permits for the signs. 12. The applicant shall request a final inspection of the signs and shall comply with corrections if any are required.
