PC R 92-1396,. 2� 6`9 RESOLUTION NO. 92-1396 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARROYO. GRANDE RECOMMENDING APPROVAL OF LOT LINE ADJUSTMENT CASE NO. 92-504 LOCATED AT 1197 JAMFS WAY APPLIED FOR BY RUSS SHEPPEL WHEREAS, the Planning Commission of the City of Anoyo Grande has held a public hearing on Lot Line Adjustment Case No. 92-504 in accordance with City Code; and WHEREAS, the Planning Commission has found that this project is consistent with the General Plan and the Environmental Documents associated therewith; and WHEREAS, the Planning Commission has reviewed this project in compliance with the California Environmental Quality Act (CEQA) and has determined that this project is exempt per Section 15305(a) of the CEQA guidelines; and WHEREAS, said Lot Line Adjustment was refened to the Planning Commission, by various City Departments and the Staff Advisory Committee; and VVIIEREAS, the Planning Commission finds, after due study, deliberation and public hearing, the following circumstances exist: This Lot Line Adjustment will not: 1. Create or delete any new lots. 2. Include any lots or parcels created illegally. 3. Impair any existing access or create a need for access to any adjacent lots or parcels. The access is commonly held by agreement for several adjacent parcels. 4. Impair any existing easements or create a need for any new easements serving adjacent lots or parcels. Minor revisions to exisdng easements serving the two affected pazcels will be required as a condition of approval for the lot line adjustment. 5. Constitute poor land planning or undesirable lot configurations due to existing environmental conditions or cunent zoning development standards. The lots to be created conform to size and coverage standards of the commercial subzone of PD 1.1. 6. Require substandal alteration of any existing improvements or create a need for any new improvements. 7. Create a non-conforming lot in the PD 1.1 zoning district. NOW, THEREFORE, BE IT RESOLVED that the Planning Commission of the City of Anoyo Grande hereby recommends approval of said Lot Line Adjustment Case No. 92-504 to the City Council subject to the following condidons: General Conditions: 1. The applicant shall ascertain and comply with all State, County and City requirements as aze applicable to this project. 2. This application shall automatically expire on December 1, 1994 unless the lot line adjustment is recorderl. Thirty (30) days prior to the expiration of the approval, the applicant may apply for an extension of one (1) year from the original date of expiration. /::,. �, -.._.; _. . 3. The applicant shall agree to defend at his/her sole expense any action brought against the City, its agents, officers, or employees because of the issuance of said approval, or in the alternative, to relinquish such approval. The applicant shall reimburse the City, its agents, officers, or employees, for any court costs and attorney's fees which the City, its agents, officers, or employees may be required by the court to pay as a result of such action. The City may, at its sole discretion, participate at its own expense in the defense of any such action but such participation shall not relieve applicant of his/her obligations under this condition. Planning Department Conditions: 5. Development shall conform with the PD 1.1 zoning, subzone H-S, requirements unless otherwise approved. 6. Signage shall be subject to the requirements of Chapter 9-13 of the Development Code. 7. Prior to or concurrent with recordation of the lot line adjustment, access and parking easements, drainage easements, and maintenance agreements shall be modified and recorded to reflect the new lot configuration. On motion of Commissioner Tappan, seconded by Commissioner Moore, and on the following roll call vote, to wit: AYES: Commissioners Moore, NOFS: None ABSENT: Commissioner Soto Tappan, Reilly, and Vice Chairman Carr the foregoing Resolution was passed and adopted this lst day of December, 1992.
