RESOLUTION N0. 90-1307
A RESOLUTION OF THE PLANNING COMMISSION OF TAE
CITY OF ARROYO GRANDE RECOMMENDING ADOPTION OF
A NEGATIVE DECLARATION AND APPROVAL TO THE
CITY COUNCIL OF AMENDMENTS TO ORDINANCE N0.
333 C.S., WHICH ESTABLISHED A COMPREHENSIVE
COMMUNITY TREE PROGRAM .
WHEREAS, the Planning Commission of the City of Arroyo Grande
has considered amendments to Ordinance No. 333 C.S., the City's
Community Tree Program; and
WHEREAS, the more significant amendments are tree removal,
permit requirements, and criteria for evaluating removal requests;
protection requirements for existing.trees during construction;
street tree fees and development impact fees; clarification of the
method of designating Landmark Trees, with voluntary registration
emphasized, and a legal description of the property on the recorded
resolution, and a minimum penalty amount set for each section of
the ordinance, with a statement of whether it is a misdemeanor; and
WHEREAS, the Planning Commission has found that the amendments
are consistent with the General Plan of the City of Arroyo Grande
and the environmental documents associated therewith; and
WHEREAS, the proposed ordinance was reviewed in compliance
with the requirements of the California Environmental Quality Act
(CEQA), and it was determined that the project would result in no
significant effects on the environment, and therefore the
recommendation of a Negative Declaration is appropriate.
NOW, THEREFORE, BE IT RESOLVED that the Planning Commission
of the City of Arroyo Grande hereby recommends adoption of the
Negative Declaration and approval to the City Council of the
amendments to Ordinance No. 333 C.S., the Comprehensive Community
Tree Program.
On motion of Commissioner Soto, seconded by Commissioner
Sousa, and on the following roll call vote, to wit:

ABSENT: Commissioners
Soto, Moore, Souza, and Chairman Carr
Gallagher and Brandy
the foregoing resolution was passed and adopted this 4th day of
September, 1990.
