IAT AT 1040 FAIR OAKS AVFMJE, APPLIID FOR BY FRID BAUR WHIItEAS, the Planning Comnission of the City of Arroyo Grande has considered the Tentative Tract Map. No. 1915, filed by Fred Baur, for a resubdivision of one lot into two residential lots; and WI�F1�S, said tentative map was referred to various public utility companies, City departments, and the Staff Advisory Cormuttee for recom�7dations; �nd WHERFAS, a Negative Declaration with mitigation measures has been prepared on the project and was reviewed by the Plaruzing Comnission at a public hearing; and WI�FAS, the Negative Declaration has found that no significant potential impacts are anticipated provided the mitigation measures are implemented; and Wf�RRF,AS, the Planning Commission instructs the secretary to file a Notice of Determination; and Wf�S, the Planning C�mission has determined that the proposed development is an appropriate use of the subject property and is desirable for the orderly developrne�it of the c�zity. N�i, Tf�'ORE, BE IT R�SOLVID that the Planning Cormussion of the City of Arroyo Grande hereby approves said tentative map subject to the following findings and conditions: FINDINGS 1. The proposed map, design and improvc�nents of this subdivision are consistent with the general plan map and text because the designation for this site is low density residential 0.2 - 4.5 dwelling units per acre and the applicant is proposing 4.34 dwelling units per acre. 2. This site is physically suitable for the proposed type and density of development because all required parkinq, setbacks and yards can be provided. 3. The proposed subdivision design is not likely to cause substantial and considerable damage to the natural envirorunsnt, including fish, wildlife or their habitat because measures have been included in the conditions of approval for the project which mitigate any potential impacts. 4. 5. The proposed design of the subdivision or proposed improv�xnents are not likely to cause public health problems. The proposed subdivision design will not conflict with public ease�nents within or through the site. •�, � � • • • ���- Mitigation Measures l. A negative declaration with mitigation measures has been prepared for this project. All mitigation measures as outlined in the Conditions of Approval shall be impleqnented and monitored by appropriate City Departments and other responsible agencies. Verification in writing that mitigation measures have been implemented shall be provided by the monitoring department. 1 r ���3; 2. In the event that during grading, construction or development of the project, any archaeological resources are uncovered, all worl{ shall be halted until the City has reviewed the resources for their significance. If human burials are encountered the County Coroner (549-4513) shall be contacted inrnediately. The applicant may be required to provide additional;archaeological studies and/or mitigation measures. All grading and improve9nent plans shall be noted to reflect said condition. All new construction on parcel 1 shall utilize fixtures and designs which minirnize water usage. Such fixtures and designs shall include, but are not limited to, low flow shower heads, water saving toilets, instant water heaters or hot water recirculating systems, drip irrigation with drought tolerant landscaping and etcetera. CC&R's which shall require the above, shall be reviewed by the Planning Department and the City Attorney, and recorded prior to, or concurrently with the parcel map. Prior to occupancy of any structure constructed on parcel 1, all water co�~iserving designs or fixtures shall be installed. Prior to recordation of the final map, the applicant shall enter into an agree�nent, in a form approved by the�City Attorney, whereby the applicant agrees, on behalf of himself and his successors in interest to pay the City $2656.00 (two thousand, six hundred, fifty six dollars) for tracfic mitigation prior to issuance of building permits on parcel 1 or within five (5) years of recordation of the final map, whichever comes fi�st. 1�Unitorina Departrrnnt: Public Works Department ?ime Frame: Prior to recordation of the parcel map. General Canditians: 6. L'he applicant shall ascertain and comply with all state, county and city !requirements, as are applicable to this project. 7. ��Development shall occur in substantial conforn�zce with the inforniation su�anitted to the Planning Comrussion at the meeting May l, 1990 and marked "Exhibit A". 8.- Construction on parcel 1 shall be limited to single story structures.
