PC R 90-1287►.�98 RESOLUTION N0.90-1287 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF ARROYO CRANDE GRANTING A VARIANCE, CASE N0. 90-146, APPLIED FOR BY ULTR�MAR (BEACON OIL CCk�IPANY) LOCATF.D AT 610 GRAND AVIIVUE, FOR LANDSCAPING REQUIRIIKIIVT AROUND SIGN AREA AND MTMBER OF SIGNS PE�MITT�,'D WHEREAS, the Planning Commission of the City of Arroyo Grande has considered Variance Case No. 90-146, filed by Ultrarnar (Beacon Oil Company), for a variance for the landscaping requirement around sign area and the nLmiber of signs as required in the zoning ordinance cannot be met; and WHEREAS, the Planning Comnission has held a public hearing on this application in accordance with the City Code; and WHEf2EAS, the project has been found to categorically exempt under the provisions of the California IIzvironmental Quality Act (C�QA); and WHII2F.AS, the Planning Co�miission finds, after due study, deliberation and public hearing, the following circwns,tances exist: l. The granting of this variance will not be detrimental to other properties. 2. There are exceptions or extraordinary circumstances applicable to this property because state law requires clearly visible signage indicating the pricing of gasoline and dictates minimlun copy size, These state requirements can not be met without granting of the variance. 3. The strict application of the C-2 zone does deprive such property of privileges enjoyed by other properties in the vicinity or same zone because other service stations have signage which was approve� by the city and meets state requirements. 4. The granting of the deviation compatible with the objectives, policies and general plan uses specified in the general plan. NQ�1, �pRE, BE IT RESOLVID that the Planning Camnission of the City of Arroyo Grande hereby approves said variance subject to the standard conditions of the City and those listed below: l. 2. The applicant shall ascertain and comply with all State, County and City requirements as are applicable to this project. Development shall occur in substantial conformance with the plans presented to the Planning Carrmission at the meeting of Apri 1 17 , 1990 , and roarked "Exhibi t A" . Planning Department Conditions 3. 4. Development shall conform with the C-2 zoning requirements unles.s otherwise approved. All existing signage shall be r�noved prior to issuance of buildir.�� permits for new signage. Parks and Recreatioa� Department Canditians 5. Prior to issuance of building permits, the applicants shall furnish a landscape and irrigation plan for the planter around the monl,unent sign, to the satisfaction of the Parks and Recreation Director. All landscaping shall be installed prior to Building Department final inspection.
