AI.IX RAME.Y, ADOPTING A NF]('�ATIVE D�Q�ARATION AND INSIRLTCTING THE SDCa2ErARY �0 FILE A NO�ICE OF DETII2�iINATION W�S, the Planning Co�nussion of the City of Arroyo Grande has held a public hearing on Parcel Map Case No. 89-482 in accordance with Chapter 3 of the Subdivision Ordinance of the City of Arroyo Grande; and FlF�2FAS, the Planning Camnission has found that this project is consistent with the General Plan and the Fhvironmental Docwnents associated therewith; and Wf�S, a Negative Declaration has been declared Lmder the provisions of the California �ivironmental Quality Act (CDQA); and �F1�S, the Planning Co�mi.ssion hereby directs the Secretary to file a Notice of Detern�ination; and ���II�IS, said Parcel Map was referred to the Planning Coa�cYnission, by various City Departments and the Staff Advisory Coamuttee; and Wt�2FAS, the Planning Coannission finds, after due study, deliberation and public hearing, the following circwnstances exist: 1. The proposed map, design and improvemP.nts of this subdivision are consistent with the general plan map and text because the general plan designation for this site is low density residential, 0.2 - 4.5 dwelling units per acre and the applicant is requesting 3.8 dwelling �its per acre. 2. This site is physically suitable for the proposed type and density of development because all requir�nents for yards, setbacks, access and parking can be met. 3. The proposed subdivision design is not likely to cause substantial and considerable damage to the natural envirorunexit, including fish, wildlife or their habitat because measures have been included in the conditions of approval for the project which mitigate potential impacts to the environment. 4. The proposed design of the subdivision or proposed improvements are not likely to cause public health problems. 5. The proposed subdivision design will not conflict with public easements within or through the site. NQ+�, Tf�'ORE, BE IT RE90LVID that the Planning Co�mission of the City of Arroyo Grande hereby approves said Parcel Map Case No. 89-482 subject to the following conditions. MITIGATION �JRES *1. A negative declaration with conditions has been prepared for this project. All mitigation measures as outlined in the Conditions of Approval shall be implc�nented and monitored by appropriate City Departments and other responsible agencies. Verification in writing that mitigation measures have been implern�ited shall be provided by the monitoring department.. *2. In the event that during grading, construction or develop�nent of the project, any archaeological resources are uncovered, all work shall be halted until the City has reviewed the resources for their significance. The applicant may be required to provide additional archaeological studies and/or mitigation measures. All grading and irnprovement plans shall be noted to reflect said condition. ManitorinQ Departsnent: Planning Department Time Frame Prior to issuance of permits for grading or construction and during grading and construction. �� 6 *3. Prior to recordation of the final map, the developer shall enter inta an agrezment with the City, in a form approved by the City Attorney, whereby the developer agrees, on behalf of himself and his successo.rs in interest, to pay the City a fee of 'Itao Thousand Six Hundred and Fifty Six Dollars ($2,656.00) for traffic mitigation for development of Parcel 2. This fee shall be paid prior to issuance of a building permit on Parcel 2 or within five (5) years of recordation of the final map, whichever is sooner. In the event that the City should adopt a method of funding traffic mitigations which shall include assessment of these lots, the fees provided for herein shall be credited against the principal amount of the assessment. Monitorina Department Public Works Department Time Frame: Prior to recordation of final map. *4. All construction on both parcels shall utilize fixtures and designs which minimize water usage. If the existing residence is to be retained, it shall be included in this condition. Such fixtures and designs shall include, but are not limited to, low flow shower heads, water saving toilets, instant water heaters or hot water recirculating systems, drip irrigation with drought tolerant landscaping, and etcetera. CC&R's which shall require the above, shall be reviewed by the Planning Department and the City Attorney, and recorded prior to, or concurrently with the parcel map. M�itorinq Department: Public Works Department Time Frame: Prior to recordation of the parcel map � �5 Prior to final occupancy of any structure constructed on either lot 1 or 2, all water conserving designs or fixtures shall be installed. The applicant shall ascertain and co�nply with all state, county and city requirements, as are applicable to this project. 7. Development shall occur in substantial conforrr�ice with the plans su}�utted to the Planning C�rni.ssion at the meeting of April 3, 1990 �lu marked "Exhibit A". PI�AIVNING DE:PAI�Il�1�1'P: 8. If an access ease�nent is granted to Parcel 1 across the access to Parcel 2, a joint maintenance agreemP_nt shall be drafted to the satisfaction of the City Attorney and shall be recorded simultaneously with the parcel map. 9. Prior to recordation of the parcel map, the applicant shall construct wood fences, of a design approved by the Planning Director, along the East and North property lines. Said fences shall meet the height requirerr►ents of the R-1 zone. 10. Al1 developmPalt shall meet the requirements of the R-1 zone�, unless otherwise approved: P[JBLIC WORKS DII'ARZi�IdT 11. Frontage improv�zts on Maple Street shall be constructed as necessary including, but not limited to curb, gutter, sidewalk, conform paving, street lights, and underground utilities (including water and sewer laterals). 12. Field locate, and if appropriate, abandon or relocate exi�ting utilit1 connections to match newly created subdivision parcel lines. 13. Relocate and/or remove buildings conflicting with proposed subdivision lct lines and appropriate setbacks. 14. Prepare a drainage plan for review and approval by the Department or Public Works. If grading or other improvements are required, the scheduling of that work with respect to the date of recordation of the map shall be determined after approval of the drainage plan. 15. Any permanent driveways shall be constructed with a paved surface �f 7 asphalt or Portland Ce�ient Concrete. Pernianent driveways will not be required until building permits are issued unless comrpletion of the requirement is prerequisite to impl�itation of a drainage scheme which must be in place prior to recordation of the map. 16. An access, utility and sewer easement should be created along the 20 foot flag to provide access to Parcel 2. A separate drive access for Parcel 1 may be developed at the westerly end of the parcel should the drainage pond proposed not be required. 17. Conditions 9 through 14 above must be met prior to recordation of the map unless otherwise noted. Bonding for improvements in lieu of construction prior to recordation in conform�lce with the State Subdivision Map Act may be permitted at the discretion of the City �gineer. BUILDING DEPAI�II�V'P: 18. Prior to issuance of building permits, the applicant shall properly abandon existing wells or septic systerrtis on the property. FIRE DII'AR�'i�J`P: 19. Access driveway to rear property to serve only one residential structure and be maintained at a minimwn of twenty feet.
